    1 HEARING OFFICER KNITTLE: Hello. I'm John
    2 Knittle, Hearing Officer for the Illinois
    3 Pollution Control Board. I'm also the assigned
    4 Hearing Officer for the case PCB 1997-234, which
    5 is Antonio D.H. Nam vs. Kikon Suh. We had a
    6 hearing scheduled today, October -- my watch says
    7 the 4th, but I know it's the 5th -- October 5th at
    8 9:30, and on my answering machine this morning,
    9 there was a message from the complainant's
    10 attorney indicating that they will be filing a
    11 written motion to continue the hearing for three
    12 weeks.
    13 I've not yet seen this motion, but
    14 based on this representation, I will continue this
    15 matter on the record for three weeks, namely, I
    16 will continue this hearing until October 26th and
    17 October 27th, 1999, at 9:30 each day here at the
    18 Board's offices at Suite 11-512.
    19 I should state for the record that

    20 neither of the attorneys is present at this point
    21 regardless. So we couldn't actually have the
    22 hearing even if I weren't inclined to grant the
    23 motion to continue, but I am. So this matter will
    24 be continued on the record until October 26th and

    1 27th.

    5 HEARING OFFICER KNITTLE: We're back on
    6 the record. As I've said, this will be
    7 continued. We are going to leave this hearing
    8 open for another 15 minutes until 10:05 a.m. in
    9 case any members of the public come. If any of
    10 the members of the public do come after that, I
    11 will alert them that the hearing has been
    12 continued and let them know the appropriate place
    13 and time to come and give their public comments.
    14 That's all I have for now. Let's go off the
    15 record for 15 minutes just to make sure.

    17 HEARING OFFICER KNITTLE: We're back on
    18 the record. It's a little after 10:00 o'clock.
    19 No members of the public have shown up, and, as
    20 I've stated before, we are going to continue this
    21 hearing.
    22 In the interim, I received from
    23 Jacob Reese a joint motion to continue the hearing
    24 which states that the parties move to continue the

    1 hearing and/or trial of this matter for a period
    2 of 30 days. As I said, that's granted in part.
    3 We are going to stick to the October 26th and 27th
    4 dates that we've already picked primarily because
    5 I have a hearing that next week and we can't do
    6 the 30-day period.
    7 I've talked to Mr. Reese about this,
    8 and he did not object to this scheduling of the
    9 hearing. So that's it. This matter for the time
    10 being is closed, and we are going to continue this
    11 on the record until October 26th at 9:30.
