    1 HEARING OFFICER KNITTLE: My name is John
    2 Knittle. I'm the hearing officer with the Illinois
    3 Pollution Control Board. I'm also the assigned hearing
    4 officer for this matter which is PCB 1997, dash, 234,
    5 Antonio D.H. Nam vs. Kikon Suh scheduled for hearing
    6 today. Today's date is March 14th. It is
    7 approximately 9:34 a.m. And for the record I will note
    8 that there are no members of the public here, nor are
    9 either of the attorneys or parties represented. We are
    10 in receipt of a motion to continue the trial.
    11 Actually, it was filed on March 13th, and it's entitled
    12 motion to continue -- joint motion -- excuse me -- to
    13 continue trial.
    14 In the motion the parties, by their respective
    15 attorneys, move to continue the hearing and/or trial of
    16 this matter for a period not to exceed 30 days. I've
    17 talked to both parties. It is a joint motion. The
    18 complainant does not object, even though this was filed
    19 by the respondent. And the respondent's assertion that
    20 the complainant agrees to this motion is, to my
    21 understanding, correct.
    22 So we're going to grant this motion to
    23 continue the hearing. We've picked dates. How this is
    24 going to work is we're going to continue the hearing on

    1 the record to April 4th and April 5th at 9:30 a.m. here
    2 at the same place in the Thompson Center. This is
    3 suite 11, dash, 512, and I will provide notice of that
    4 in a hearing officer order.
    5 So what we're going to do now is we're going
    6 to stay on the record for 30 minutes in case any
    7 members of the public choose to show up for this
    8 hearing, and we're going to take a 30-minute recess.
    9 And if nobody shows up, we will close this portion of
    10 the hearing and continue it on the record until
    11 April 4th. That's it.
    12 (A short break was had.)
    13 HEARING OFFICER KNITTLE: We are back on the
    14 record after a 30-minute recess. I want to note for
    15 the record once again that no members of the public
    16 have appeared to give public comment in this case. As
    17 I stated before -- well, before I get into what I
    18 stated before, let me note for the record that we have
    19 two members of the Illinois Pollution Control Board
    20 that have chosen to join us for the wrap-up of this
    21 case. We have Gertrude Kelly and Charles King. So
    22 thank you both very much for attending.
    23 As I stated before, we have a motion to
    24 continue this case. This motion was granted as

    1 follows. As I stated, this will be continued on the
    2 record until April 4th and April 5th. One thing I
    3 wanted to notice -- or note, I should say, and I
    4 relayed this to the parties at our pre-hearing
    5 conference. I'm granting the motion to continue the
    6 hearing; but this has been going on for a while, and
    7 unless circumstances drastically change, this will be
    8 the last continuance that I grant. So this hearing
    9 will move forward on April 4th and April 5th, barring
    10 any unforeseen circumstances. That's all I have.
    11 You guys have anything you want to add?
    12 MS. KELLY: No.
    13 MR. KING: (Nodding.)
    14 HEARING OFFICER KNITTLE: Both employees of
    15 the board indicate they have no comment. This is
    16 continued on the hearing until April 4th and April 5th,
    17 same time and same location. Thank you very much.
