Reached with the City of Canton Regarding the Canton Industrial
Corporation Site, Canton, Fulton County
On September 1, 1999, the City of Canton and the United States Office of
the Attorney General reached a proposed agreement concerning a Canton
Industrial Corporation (CIC) site located at 260 East Elm Street, Canton,
Fulton County.

n October 7, 1999, Governor George H. Ryan formally announced
Board member Dr. Ronald C. Flemal’s reappointment to a sixth term!
Dr. Flemal earned a BS from Northwestern University, and a Ph.D. in
Geology from Princeton University. From 1967 to 1985, he served as a
Professor of Geology at Northern Illinois University, during which time he
authored over eighty articles dealing principally with environmental and
natural science issues. Dr. Flemal also serves as a member of the Illinois State
Bar Association Environmental Law Council.
Dr. Flemal was appointed by Governor James R. Thompson in 1985 and was
reappointed by Governor Jim Edgar in 1996. Dr. Flemal’s new term will
expire on July 1, 2002. The Board wishes Dr. Flemal congratulations and
continued success during his new term.

oard Adopts Proposal for Public Comment in
In the Matter of: RCRA Update, USEPA
Regulations (January 1, 1999, through June 30,
1999)

On September 23, 1999, the Board proposed
amendments to the Illinois regulations that are
identical-in-substance to hazardous waste
regulations that the United States Environmental
Protection Agency (USEPA) adopted to
implement Subtitle C of the federal Resource
Conservation and Recovery Act of 1976 (RCRA
Subtitle C) (42 U.S.C. §§ 6921
et seq.
(1998)). The
proposed amendments include federal RCRA
Subtitle C amendments that the USEPA adopted
from January 1, 1999, through June 30, 1999. See
64 Fed. Reg. 3382 (January 21, 1999); 64 Fed. Reg.
4975 (February 2, 1999); 64 Fed. Reg. 26315 (May
14, 1999); and 64 Fed. Reg. 30417 (June 8, 1999).
The proposed amendments clarify and correct
references to organic material emission rules
applicable to hazardous waste tanks, containers,
and surface impoundments. In addition, the
proposed amendments modify the methods for
whole effluent toxicity testing for the purposes of
compliance with the Clean Water Act. Moreover,
the proposal introduces the use of new methods
for analyzing oil and grease in compliance with
the Clean Water Act and RCRA regulations.
Finally, the proposed amendments incorporate the
USEPA’s modifications to its guidance on the
analysis of mercury in water in conformity with
the Clean Water Act’s water quality requirements.

64 Fed. Reg. 47806 (September 1, 1999). According to the
terms of the proposed agreement, the City of Canton will pay
$500 to the Hazardous Substance Superfund; enroll the CIC site,
or portions thereof, that are appropriate for redevelopment and
reuse, into the State of Illinois Site Remediation Program;
implement site security measures; and impose appropriate
institutional controls. The proposed agreement includes a
covenant not to sue the City of Canton under Sections 106 and
107(a) of the Comprehensive Environmental Response, Compen-
sation, and Liability Act (CERCLA) (42 U.S.C. §§ 9606,
9607(a)), contribution protection for the City of Canton under
Section 113(f)(2) of CERCLA (42 U.S.C. § 9613(f)(2)), and
removal of any liens under Section 107(a) of CERCLA (42
U.S.C. § 9607(a)).
The proposed agreement is available at the United States

llinois Submits Partial Application for United States
Environmental Protection Agency Approval to Administer
and Enforce Standards for Lead-Based Paint Activities in Target
Housing and Child-Occupied Facilities
On August 19, 1998, the State of Illinois submitted a partial
application to the United States Environmental Protection
Agency (USEPA) for approval to administer and enforce training
and certification requirements, training program accreditation
requirements, and work practice standards for lead-based paint
activities in target housing and child-occupied facilities under
Section 402 of the Toxic Substances Control Act (TSCA) (15
U.S.C. § 2682). On April 16, 1999, Illinois submitted supple-
mental application materials for self-certification for interim
approval. On September 1, 1999, the USEPA issued notice of
receipt of Illinois’ application and announced the commencement
of a 45-day public comment period. 64 Fed. Reg. 47807
(September 1, 1999). Comments on the authorization applica-
tion must be received on or before October 18, 1999. Submit all

nited States Environmental Protection Agency Approves
State of Illinois Implementation Plan Revision Amending
Volatile Organic Compound Reasonably Available Control
Technology Requirements for Sun Chemical Corporation in
Northlake, Cook County
On September 13, 1999, the United States Environmental
Protection Agency (USEPA) issued notice of its approval of
Illinois’ state implementation plan (SIP) revision amending volatile
organic compound reasonably available control technology
requirements for Sun Chemical Corporation (Sun) located in
Northlake, Cook County. 64 Fed. Reg. 49400 (September 13,
1999). The SIP revision exempts 17 resin storage tanks from
bottom or submerged pipe fill requirements, subject to certain
conditions. On May 20, 1999, the Board adopted an order
granting Sun an adjusted standard, which provides that 35 Ill.
Adm. Code 218.626(b) of the Board’s regulations controlling
VOM emissions from paint and ink manufacturing processes shall
not apply to Sun’s 17 storage tanks. See In the Matter of: Petition

nited States Environmental Protection Agency Approves
Revisions to the Unregulated Contaminant Monitoring
Regulations for Public Water Systems
On September 17, 1999, the United States Environmental
Protection Agency (USEPA) approved revisions to the unregu-
lated contaminant monitoring regulations (UCMR) for public
water systems. 64 Fed. Reg. 50555 (September 17, 1999). The
Safe Drinking Water Act (SDWA), as amended in 1996 (42
U.S.C. § 300f
et seq
. (1996)), required the USEPA to establish
criteria for a program to monitor unregulated contaminants and,
by August 6, 1999, to publish a list of contaminants to be
monitored. To conform with the SDWA amendments, the
USEPA has promulgated the UCMR for public water systems,
which revises substantially the existing regulations for unregulated
contaminant monitoring.
The rule includes a list of contaminants to be monitored, proce-
dures for selecting a representative nationwide sample of small
public water supplies that will be required to monitor the
frequency and schedule for monitoring, the sampling points, the
approved analytical methods to be used, and the procedures for
entering the monitoring data in the National Drinking Water
Contaminant Occurrence Database, as required under Section
1445 of the SDWA (42 U.S.C. § 1445 (1996)). The data in the
database will be used to identify contaminants on the Drinking
Water Contaminant Candidate List to support the USEPA
Administrator’s determination of whether or not to develop
drinking water standards for a particular contaminant, and to
develop standards for the contaminants that the Administrator
selects.

The proposal for public comment was adopted in
accordance with Sections 7.2 and 22.4(a) of the
Environmental Protection Act (Act) (415 ILCS 5/7.2, 22.4(a)
(1998)), which provide for the quick adoption of regulations
that are identical-in-substance to federal regulations that the
USEPA adopts to implement Sections 3001 through 3005 of
RCRA (42 U.S.C. §§ 6921-6925 (1998)). Section 22.4(a) of the
Act also provides that Title VII of the Act and Section 5 of
the Administrative Procedure Act (5 ILCS 100/5-35, 5-40
(1998)) do not apply to the Board’s adoption of identical-in-
substance regulations.
On October 8, 1999, the proposed amendments were
published in the
Illinois Register
(23 Ill. Reg. 12087 (October
8, 1999)), thereby commencing the 45-day public comment
period. The public comment period will expire on November
22, 1999. Public comments may be filed during this time
frame with the Clerk of the Board.

1999 Order in SDWA Update Docket R99-6)

On September 23, 1999, the Board adopted proposed
amendments to the Illinois regulations that are identical-in-
substance to National Primary Drinking Water regulations
(NPDWRs) adopted by the United States Environmental
Protection Agency (USEPA). These regulations implement
Sections 1412(b), 1414(c), 1417(a), and 1445(a) of the Safe
Drinking Water Act (SDWA) (42 U.S.C. §§ 300g-1(b), 300g-
3(c), 300g-6(a), 300j-4(a) (1996)). The proposed amendments
were adopted pursuant to Section 17.5 of the Environmental
Protection Act (Act ) (415 ILCS 5/17.5 (1998)), which
provides for quick adoption of regulations that are identical-
in-substance to federal regulations that the USEPA adopts
to implement Sections 1412(b), 1414(c), 1417(a), and 1445(a)
of the SDWA. Section 17.5 of the Act also provides that
Title VII of the Act and Section 5 of the Administrative
Procedure Act (5 ILCS 100/5-35, 5-40 (1998)) do not apply to
the Board’s adoption of identical-in-substance regulations.
The federal SDWA regulations are found at 40 C.F.R. §§ 141
and 142.

oard Dismisses Proposed Rulemaking in In the Matter of
Amendments to 35 Ill. Adm. Code 611 (Cross-Reference to
Laboratory Accreditation Rules at 35 Ill. Adm. Code 186)

On September 23, 1999, the Board dismissed this proposed
rulemaking that the Illinois Environmental Protection Agency
(IEPA) filed on June 2, 1997. The IEPA proposed that the
laboratory accreditation rules currently found at 35 Ill. Adm.
Code 611 be cross-referenced to the IEPA’s own laboratory
accreditation rules proposed in Part 186. After discussions
with the IEPA, the Board determined that the IEPA intends to
submit a revised proposal in this matter, but that the date for
submittal is uncertain. Due to the age and relative inactivity
in this rulemaking, the Board, on its own motion and with the
IEPA’s concurrence, dismissed this docket. Dismissal of this
rulemaking does not in any way preclude the filing of
additional proposals by the IEPA.

In this action, the Board proposed amendments to correct a
discrepancy between the federal rules and the amendments
adopted in In the Matter of: SDWA Update, USEPA
Regulations (January 1, 1998, through June 30, 1998)
(February 4, 1999), R99-6. The Illinois Environmental
Protection Agency (IEPA) brought the discrepancy to the
Board’s attention. The IEPA requested that the Board make
the necessary correction in order to facilitate state primacy
review of the amended text by the USEPA. On April 28, 1998,
the USEPA amended the 40 C.F.R. § 141.2 definition of
“public water system” at 63 Fed. Reg. 23366 (April 28, 1998).
In docket R99-6, the Board sought to incorporate the federal
amendment of April 28, 1998; however, it neglected to remove
and replace a few necessary words. At the IEPA’s request,
the Board also proposes adding a note appended to the
definition of “public water system,” clarifying that this term is
synonymous to “public water supply,” which is also used in
the regulations.
The proposal for public comment was published in the
Illinois Register
on October 8, 1999 (23 Ill. Reg. 12160
(October 8, 1999)), thereby commencing the 45-day public
comment period. The 45-day public comment period will
expire on November 22, 1999. Public comments may be filed
with the Clerk of the Board during this 45-day public com-
ment period.

Restricted Status List -- Public Water Supplies
The Restricted Status List was developed to give additional notification to officials of public water supplies which are in violation of 35 Ill.
Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental Protection Act.
The Restricted Status List will include all Public Water Supplies for which the Agency has information indicating a violation of any of the
following requirements: Finished water quality requirements of 35 Ill. Adm. Code, Part 604, Subparts B and C; maintenance of adequate
pressure on all parts of the distribution system under all conditions of demand; meeting raw water quantity requirements of 35 Ill. Adm.
Code 604.502; or maintenance of treatment facilities capable of providing water “assuredly adequate in quantity” as required by Section 18
of the Illinois Environmental Protection Act.
A public water supply on the Restricted Status List will not be issued permits for water main extensions, except for certain limited situations,
or unless the supply has been granted a variance from the Illinois Pollution Control Board for the violation, or from permit issuance
requirements of Section 39 of the Act.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the status of any public
water supply should be directed to the Division of Public Water Supplies for final determination. This list reflects the status as of October
1, 1999.

Critical Review List -- Public Water Supplies
The Critical Review List was developed to give additional notification to officials of public water supplies which may be close to being in
violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental Protection Act.
A supply will be placed on the Critical Review List when Agency records indicate that it is approaching any of the violations which would
place it on the Restricted Status List.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the status of any public
water supply should be directed to the Division of Public Water Supplies for final determination. This list reflects the status as of October
1, 1999.
