Promulgates National Emission Standards for
Hazardous Air Pollutants for New and Existing Lead
Smelters
On June 4, 1999, the United States Environmental
Protection Agency (USEPA) adopted national
emission standards for hazardous air pollutants
(NESHAPs) for new and existing primary lead
smelters pursuant to Section 112 of the Clean Air
Act (42 U.S.C. § 7412 (1990)). 64 Fed. Reg. 30193
(June 4, 1999). Primary lead smelters have been
identified by the USEPA as significant emitters of
lead compounds, and other metal NESHAPs includ-
ing arsenic, antimony, and cadmium. Exposure to
lead compounds may result in adverse effects of
the blood, central nervous system, and kidneys.
Chronic exposure to arsenic is associated with skin,
bladder, liver, and lung cancer and other develop-
mental and reproductive problems. The USEPA
states that these new standards provide protection
to the public by requiring all primary lead smelters
to meet emission standards that reflect the applica-
tion of maximum achievable control technology.
The standards became effective June 4, 1999.
These amendments are directly applicable, with-
out further rulemaking, in Illinois in accordance
with Section 9.1(b) of the Environmental Protec-
tion Act (415 ILCS 5/9.1(b) (1998)).

oard Adopts for Second Notice Amendments in In the Matter of:
Permitting Procedures for the Lake Michigan Basin: 35 Ill. Adm.
Code 301, 302, and 309.141, R99-8
On June 17, 1999, the Board adopted for second-notice review by the
Joint Committee on Administrative Rules (JCAR) amendments to 35 Ill.
Adm. Code 301, 302, and 309.141 regarding permitting procedures for
the Lake Michigan Basin. On July 28, 1998, the Illinois Environmental
Protection Agency (IEPA) filed a rulemaking proposal which amends
portions of the Board’s rules dealing with the issuance permits under the
National Pollution Discharge Elimination System (NPDES). The IEPA
stated that these amendments were necessary to implement the federal
Great Lakes Initiative (GLI) which was previously adopted by the Board.
See In the Matter of: Conforming Amendments for the Great Lakes Ini-
tiative: 35 Ill. Adm. Code 302.101, 302.105, 302.Subpart E, 303.443, and
304.222 (December 18, 1997), R97-25. The proposal was filed pursuant
to Section 27 of the Environmental Protection Act (Act) (415 ILCS 5/27
(1996)).
The IEPA’s amendments to the Board’s rules update the citation to the
Code of Federal Regulations at Section 301.105, add specialized defini-
tions that are contained in the IEPA’s rule at Section 352.104, and add
implementation procedures under Section 309.141(h). The amendments
to the incorporations by reference under Section 301.105(c) update the
citation to 40 C.F.R. § 136 to reflect the 1996 edition of the federal rules,
which contain approved test methods, and add a new incorporation by
reference to a test procedure specified at 40 C.F.R. § 132. The definitions
proposed at first notice were, for the most part, derived from the federal
GLI regulations at 40 C.F.R. § 132.2.

resident of the United States of America Issues Executive
Order 13123 Regarding Greening the Government Through
Efficient Energy Management
On June 8, 1999, pursuant to the National Energy Conserva-
tion Policy Act (42 U.S.C. §§ 8251
et seq.
(1992)), the Presi-
dent of the United States of America issued executive order
13123 regarding “greening” the government through efficient
energy management. 64 Fed. Reg. 30851 (June 8, 1999). In
the executive order, the President stated that the federal gov-
ernment, as the nation’s largest energy consumer, must sig-
nificantly improve its energy management in order to save tax-
payer dollars and reduce emissions that contribute to air pollu-
tion and global climate change. With more than 500,000 build-
ings, the federal government is directed to lead the nation in
energy efficient building design, construction, and operation.
The President set forth the following goals: achieve green-
house gases reduction; make energy efficient improvements;
promote energy efficient industries and laboratories; promote
renewable energy; reduce petroleum use; diminish total en-
ergy use; and reduce water consumption. Each federal agency
is directed to annually request any necessary implementation
plans and measure and report its progress to the President.

nited States Environmental Protection Agency Reaches
Proposed Administrative Settlement with Samuels
Recycling Company for the Standard Scrap Site, a/k/a
Standard Scrap Metal/Chicago International Exporting Site,
Chicago, Cook County, Illinois
On June 28, 1999, the United States Environmental Protection
Agency (USEPA) reached a proposed administrative settle-
ment with Samuels Recycling Company (Samuels) for the Stan-
dard Scrap Site, a/k/a Standard Scrap Metal/Chicago Interna-
tional Exporting Site, located in Chicago, Cook County, Illi-
nois. 64 Fed. Reg. 34654 (June 28, 1999). The proposed ad-
ministrative settlement for recovery of past response costs was
made pursuant to Section 122(i) of the Comprehensive Envi-
ronmental Response, Compensation, and Liability Act
(CERCLA) (42 U.S.C. § 9622(i) (1990)). The proposed ad-
ministrative settlement requires Samuels to pay $74,771.45 to
the Hazardous Substance Superfund. The proposed adminis-
trative settlement includes a covenant not to sue Samuels pur-
suant to Section 107(a) of CERCLA (see 42 U.S.C. § 9607(a)
(1986)).
The USEPA is accepting comments regarding this proposed
administrative settlement. All written comments must be sub-

nited States Environmental Protection Agency Approves
Site-Specific Revision to Illinois State Implementation
Plan for W.R. Grace, Chicago, Cook County, Illinois
On June 18, 1999, the United States Environmental Protection
Agency (USEPA) approved a site-specific revision to the Illi-
nois State Implementation Plan (Illinois SIP) for volatile or-
ganic materials (VOMs). 64 Fed. Reg. 32810 (June 18, 1999).
This revision is an exemption from the otherwise applicable
Illinois SIP VOM requirements for W.R. Grace’s facility lo-
cated at 6050 West 51
st Street, Chicago, Cook County, Illinois.
The W.R. Grace facility manufactures container sealants, lu-
bricant fluids, and concrete additives. The Board granted W.R.
Grace an exemption from the VOM control requirements at 35
Ill. Adm. Code 218,Subpart Q on July 8, 1998. See In the
Matter of: W.R. Grace & Company - Connecticut and the Illi-
nois Environmental Protection Agency for Site-Specific Air
Regulation: 35 Ill. Adm. Code 218.940(h) (July 8, 1998), R98-
16. On September 17, 1998, the Illinois Environmental Pro-
tection Agency submitted the Illinois SIP revision request to
the USEPA.
The proposed procedures for the implementation of the federal
GLI are set forth at 35 Ill. Adm. Code 309.141(h). Section
309.141(h)(1) provides that the Total Maximum Daily Loads
(TMDLs) or the Waste Load Allocation (WLA) will be set either
through the Lake Michigan Lakewide Management Plan or the
remedial action plan for an area of concern. This proposed provi-
sion is consistent with the federal GLI procedure concerning
TMDL and WLA at 40 C.F.R. § 132.
Section 309.141(h)(2) specifies an acceptable additive risk level
of one in 100,000 for establishing Tier I criteria and Tier II values
for combinations of substances exhibiting carcinogenic or other
nonthreshold toxic mechanism. Section 309.141(h)(3) sets forth
the conversion factors for determining the dissolved concentra-
tion of metals from the total recoverable concentration.
Section 309.141(h)(4) together with 35 Ill. Adm. Code 352.Sub-
part D, provides guidance to the IEPA in choosing which pollut-
ants require water quality based effluent limits and, if required, at
what level in NPDES permits. Subsection (h)(4)(A) specifically
provides the first step in the process which involves the estima-
tion of projected effluent quality (PEQ) of a pollutant in the dis-
charge of a facility, taking into account the chronic or acute expo-
sure periods of the standard, criteria or value. If the PEQ for a
parameter is greater than the water quality standard, criteria or
value for that parameter, the next step involves the consideration
of dilution and mixing in accordance with Section 309.141(h)(5),
which allows for such consideration based on the degree of treat-
ment.
Section 309.141(h)(6), the next step in the process, sets forth a
simple mass balance formula for calculating a projected effluent
limitation (PEL) giving consideration to the water quality stan-
dard, relative flowrates of effluent and receiving water, dilu-

tion allowance and the background concentration of the pol-
lutant. Section 309.141(h)(7) sets forth the conditions under
which a water quality based effluent limit or certain monitor-
ing requirements must be included in the NPDES permit based
upon a comparison of PEQ and PEL.
Finally, the Board proposed amendments to 35 Ill. Adm. Code
302 because at the close of the rulemaking in docket R97-25,
JCAR submitted a list of typographical errors which occurred
in the text of Part 302. The Board therefore proposed only
nonsubstantive typographical amendments to Part 302.
Two hearings were held in this matter: the first, on October 5,
1998, in Chicago; and the second, on December 8, 1998, in
Springfield. On December 17, 1998, the Board denied a mo-
tion to dismiss this docket filed by the Illinois Environmental
Regulatory Group and supported by the Chemical Industry
Council of Illinois. On March 4, 1999, the Board adopted the
amendments for first-notice publication in the
Illinois Regis-
ter
(see 22 Ill. Reg. 3563 (March 26, 1999)). JCAR is sched-
uled to consider these rules at its July 20, 1999 meeting.

oard Adopts Amendments in Identical-in-Substance
Rulemaking, In the Matter of: RCRA Update, USEPA
Regulations (July 1, 1998, through December 31, 1998),
R99-15
On June 17, 1999, the Board adopted amendments to the Illi-
nois regulations that are “identical-in-substance” to hazardous
waste regulations that the United States Environmental Pro-
tection Agency (USEPA) adopted to implement Subtitle C of
the federal Resource Conservation and Recovery Act of 1976
(RCRA Subtitle C) (42 U.S.C. §§ 6921
et seq.
(1998)). The
rules incorporate several amendments that the USEPA adopted
during the period from July 1, 1998, through December 31,
1998. See 63 Fed. Reg. 42109 (August 6, 1998); 63 Fed. Reg.
47409 (September 4, 1998); 63 Fed. Reg. 50387 (September
21, 1998); 63 Fed. Reg. 51253 (September 24, 1998); 63 Fed.
Reg. 56709 (October 22, 1998); 63 Fed. Reg. 65873 (Novem-
ber 30, 1998); and 63 Fed. Reg. 71225 (December 24, 1998).
The rules also include amendments adopted by the USEPA in
1999. See 64 Fed. Reg. 6806 (February 11, 1999).
Section 22.4(a) of the Environmental Protection Act (Act) (415
ILCS 5/22.4(a) (1996)) provides for quick adoption of regula-
tions that are “identical-in-substance” to federal regulations
that the USEPA adopts to implement Sections 3001 through
3005 of RCRA (42 U.S.C. §§ 6921-6925 (1998)). The federal
RCRA Subtitle C regulations are found at 40 C.F.R. 260 - 266,
268, 270, 271, 273, and 279. Section 22.4(a) also provides
that Title VII of the Act and Section 5 of the Administrative
Procedure Act (5 ILCS 100/5-35, 5-40 (1996)) do not apply to
the Board’s adoption of identical-in-substance regulations.
Accordingly, this rulemaking is not subject to first or second-
notice review by the Joint Committee on Administrative Rules.
The adopted amendments add new waste listings and land dis-
posal restrictions (LDRs) for petroleum wastes, as well as cer-
tain exclusions from regulations as hazardous waste. The
amendments also change the effective dates and adopted emer-
gency amendments to the LDRs applicable to certain carbam-
ate wastes and waste constituents. The rules also amend the
LDR treatment standards applicable to spent potliners from
primary aluminum production.
The adopted amendments modify the treatment, storage, and dis-
posal facility standards to allow states to use mechanisms other
than permits to approve facility post-closure care plans and to
allow the closure of certain units through the corrective action
program. Further, the amendments adopt new remedial action
plan requirements applicable to the treatment, storage, or dis-
posal of hazardous remediation wastes during cleanup actions.
The amendments also adopt corrective and clarifying amend-
ments to the May 11, 1995 (60 Fed. Reg. 25492) universal
waste rule. The amendments correct aspects of the standards
for spent lead-acid battery management and the definition of
small quantity universal waste handler, and they clarify the
export requirements for destination facilities that are universal
waste handlers.
Finally, the rules amend the exclusions from the definition of
hazardous waste that will have the effect of deferring regula-
tion of certain materials as hazardous waste until February 13,
2001. The wastes affected are landfill leachate and landfill
gas condensate derived from previously-disposed petroleum
refining wastes.
On April 8, 1999, the Board adopted the amendments for publica-
tion in the
Illinois Register
(see 22 Ill. Reg. 4700 (April 23, 1999)).

oard Dismisses Reserved Identical-In-Substance
Rulemaking Docket, R99-14
On June 17, 1999, the Board dismissed reserved identical-in-
substance rulemaking docket in In the Matter of: RCRA Sub-
title D Update, USEPA Regulations (July 1, 1998, through
December 31, 1998), R99-14. The United States Environmen-
tal Protection Agency (USEPA) did not amend its rules during
the period from July 1, 1998, through December 31, 1998.
Accordingly, no Board action was required. Section 7.2 of the
Environmental Protection Act (Act) (415 ILCS 5/7.2 (1996))
requires the Board to adopt regulations which are identical in
substance to regulations adopted by the USEPA. The term
identical in substance is defined at Section 7.2 of the Act (415
ILCS 5/7.2 (1996)).

RESTRICTED STATUS LIST -- PUBLIC WATER SUPPLIES
The Restricted Status List was developed to give additional notification to officials of public water supplies which are in violation of 35 Ill. Adm. Code,
Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental Protection Act.
The Restricted Status List will include all Public Water Supplies for which the Agency has information indicating a violation of any of the following
requirements: Finished water quality requirements of 35 Ill. Adm. Code, Part 604, Subparts B and C; maintenance of adequate pressure on all parts of the
distribution system under all conditions of demand; meeting raw water quantity requirements of 35 Ill. Adm. Code 604.502; or maintenance of treatment
facilities capable of providing water “assuredly adequate in quantity” as required by Section 18 of the Illinois Environmental Protection Act.
A public water supply on the Restricted Status List will not be issued permits for water main extensions, except for certain limited situations, or unless the
supply has been granted a variance from the Illinois Pollution Control Board for the violation, or from permit issuance requirements of Section 39 of the Act.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the status of any public water supply should
be directed to the Division of Public Water Supplies for final determination. This list reflects the status as of July 1, 1999.

CRITICAL REVIEW LIST -- PUBLIC WATER SUPPLIES
The Critical Review List was developed to give additional notification to officials of public water supplies which may be close to being in violation of 35 Ill.
Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental Protection Act.
A supply will be placed on the Critical Review List when Agency records indicate that it is approaching any of the violations which would place it on the
Restricted Status List.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the status of any public water supply should
be directed to the Division of Public Water Supplies for final determination. This list reflects the status as of July 1, 1999.
