STAFF UPDATE
The Board welcomes Missy Clark, Karen Newbold,
and Carol Sudman. Ms. Clark joins the Board as
an Account Technician. She has an Accounting
Diploma from Brown’s Business College. Prior to
coming to the Board, Ms. Clark was a Human Re-
source Assistant with Central Management Ser-
vices, an Accountant Advanced/Account Techni-
cian for former Governor Edgar, and an Account
Technician for former Governor Thompson. Ms.
Newbold joins the Board as the new Human Re-
source Manager. She most recently worked as
Labor Liaison for the Department of Personnel in
the Secretary of State’s Office. Ms. Sudman joins
the Board as the Springfield Attorney Assistant to
Chairman Manning. She was previously an Attor-
ney for the Secretary of State and Joint Committee
on Administrative Rules. She received her J.D.
from the University of Illinois - Champaign. All
three will work out of the Board’s Springfield of-
fice.

OARD ADOPTS FOR FIRST NOTICE AMENDMENTS IN IN THE MATTER OF:
PERMITTING PROCEDURES FOR THE LAKE MICHIGAN BASIN: 35 ILL. ADM.
CODE 301, 302, AND 309.141, R99-8
On March 4, 1999, the Board adopted for first-notice publication in the
Illinois Register
amendments to 35 Ill. Adm. Code 301, 302, and 309.141
regarding permitting procedures for the Lake Michigan Basin. On July 28,
1998, the Illinois Environmental Protection Agency (IEPA) filed a
rulemaking proposal which amends portions of the Board’s rules dealing
with the issuance permits under the of National Pollution Discharge Elimi-
nation System (NPDES). The IEPA states that these amendments are nec-
essary to implement the federal Great Lakes Initiative (GLI) which was
previously adopted by the Board. See In the Matter of: Conforming Amend-
ments for the Great Lakes Initiative: 35 Ill. Adm. Code 302.101, 302.105,
302.Subpart E, 303.443, and 304.222 (December 18, 1997), R97-25. The
proposal was filed pursuant to Section 27 of the Environmental Protection
Act (Act) (415 ILCS 5/27 (1996)).
The IEPA proposes to amend the Board’s rules by updating the cita-
tion to the Code of Federal Regulations at Section 301.105, adding spe-
cialized definitions that are contained in the IEPA’s rule at Section 352.104,
and adding implementation procedures under Section 309.141(h).

ROPOSED ADMINISTRATIVE AGREEMENT AND
COVENANT NOT TO SUE EXECUTED BY PRECI-
SION CHROME, INC. FOR THE DAVID CHEMICAL
SUPERFUND SITE, CHICAGO
On March 8, 1999, the United States Environmen-
tal Protection Agency (USEPA) issued notice of a
proposed administrative agreement and covenant
not to sue under Section 122(h) of the Compre-
hensive Environmental Response, Compensation,
and Liability Act (CERCLA) of 1980 (42 U.S.C.
§ 9622(h) (1980)) for the David Chemical
Superfund Site located in Chicago, between the

The amendments to the incorporations by reference under Sec-
tion 301.105(c) update the citation to 40 C.F.R. § 136 to re-
flect the 1996 edition of the federal rules, which contain ap-
proved test methods, and add a new incorporation by refer-
ence to a test procedure specified in 40 C.F.R. § 132. The
definitions proposed at first notice are, for the most part, de-
rived from the federal GLI regulations at 40 C.F.R. § 132.2.
The proposed procedures for the implementation of the fed-
eral GLI are set forth at 35 Ill. Adm. Code 309.141(h). Sec-
tion 309.141(h)(1) provides that the Total Maximum Daily
Loads (TMDL) or the Waste Load Allocation (WLA) will be
set either through the Lake Michigan Lakewide Management
Plan or the remedial action plan for an area of concern. This
proposed provision is consistent with the federal GLI proce-
dure concerning TMDL and WLA at 40 C.F.R. § 132.
Section 309.141(h)(2) specifies an acceptable additive risk
level of one in 100,000 for establishing Tier I criteria and
Tier II values for combinations of substances exhibiting
carcinogenic or other nonthreshold toxic mechanism. Sec-
tion 309.141(h)(3) sets forth the conversion factors to be used
in translating between water quality standards, criteria or val-
ues for metals expressed in either the dissolved form or as total
amount recoverable.
Section 309.141(h)(4), together with 35 Ill. Adm. Code
352.Subpart D, provides guidance to the IEPA in choosing
which pollutants require water quality based effluent lim-
its and, if required, at what level in NPDES permits. Sub-
section (h)(4)(A) specifically provides the first step in the
process which involves the estimation of projected effluent
quality (PEQ) of a pollutant in the discharge of a facility, tak-
ing into account the chronic or acute exposure periods of the
standard, criteria or value. If the PEQ for a parameter is greater
than the water quality standard, criteria or value for that pa-
rameter, the next step involves the consideration of dilution
and mixing in accordance with Section 309.141(h)(5), which
allows for such consideration based on the degree of treatment.
Section 309.141(h)(6), the next step in the process, sets forth a
simple mass balance formula for calculating projected efflu-
ent limitation (PEL) giving consideration to the water quality
standard, relative flowrates of effluent and receiving water,
dilution allowance and the background concentration of the
pollutant. Section 309.141(h)(7) sets forth the conditions un-
der which a water quality based effluent limit or certain moni-
toring requirements must be included in the NPDES permit
based upon a comparison of PEQ and PEL.
Finally, the Board proposed amendments to 35 Ill. Adm. Code
302 because at the close of the rulemaking in docket R97-25,
the Joint Committee on Administrative Rules submitted a list
of typographical errors which occurred in the text of Part 302.
The Board therefore proposed only nonsubstantive typographi-
cal amendments to Part 302.
To date, two hearings have been held in this matter: the first,
on October 5, 1998, in Chicago; and the second, on December
8, 1998, in Springfield. On December 17, 1998, the Board
denied a motion to dismiss this docket filed by the Illinois
Environmental Regulatory Group and supported by the Chemi-
cal Industry Council of Illinois. Upon publication of the pro-
posal in the
Illinois Register
, a 45-day public comment period
will begin. During that time, all public comments may be filed
with the Clerk of the Board.

OARD ADOPTS FOR SECOND-NOTICE PROPOSED RULES IN IN
THE MATTER OF: HOSPITAL/MEDICAL/INFECTIOUS WASTE
INCINERATORS: ADOPTION OF 35 ILL. ADM. CODE 229, R99-10
On March 18, 1999, the Board adopted rules for second-notice
review by the Joint Committee on Administrative Rules to es-
tablish requirements for the control of emissions from the in-
cineration of hospital, medical and infectious waste. On No-
vember 30, 1998, the Illinois Environmental Protection Agency
(IEPA) filed the proposal to add 35 Ill. Adm. Code 229.
The adoption by the Board of this new part is authorized under
Section 28.5 of the Environmental Protection Act (Act) (415
ILCS 5/28.5 (1996)). Section 28.5 provides for “fast-track”
adoption of certain regulations necessary for compliance with
the Clean Air Act Amendments of 1990 (CAAA) (42 U.S.C.
§§ 7401
et seq
. (1990)).
Section 111(d) of the CAAA (42 U.S.C. § 7401 (1990)) re-
quires that states submit a plan for the control of emissions
from any source for which the United States Environmental
Protection Agency (USEPA) has promulgated a performance
standard. The USEPA has promulgated new source perfor-
mance standards (NSPS) and emissions guidelines (EG) to re-
duce emissions from hospital, medical, and infectious waste
incinerators (HMIWIs). 40 C.F.R. §§ 60.50c-60.58c, 60.30e-
60.39e. The NSPSs apply to HMIWIs for which construction
began after June 20, 1996, or for which a modification is be-
gun after March 16, 1998. The EGs apply to existing HMIWIs,
or rather, ones for which construction began on or before June
20, 1996. Unlike the NSPSs, the EGs do not establish stan-
dards for HMIWIs. Rather, EGs direct the states to adopt plans
regulating existing HMIWIs and establish minimum elements
required in the states’ plans.
Pursuant to Section 28.5, the Board is required to proceed
within set timeframes toward adoption of the regulations.
The Board has no authority to adjust their timeframes under
any circumstances. On December 3, 1998, the Board adopted

Ill. Reg. 22177 (December 28, 1998)). The first hearing on
this proposal was held on January 21, 1999, in Chicago; and
the second hearing was held on February 3, 1999, in Spring-
field. The Board received and considered two timely-filed
public comments prior to adopting the second-notice opinion
and order.

OARD ADOPTS FINAL RULES IN IDENTICAL-IN-SUBSTANCE
RULEMAKING IN IN THE MATTER OF: WASTEWATER PRETREAT-
MENT UPDATE, USEPA REGULATIONS (JANUARY 1, 1998, THROUGH
JUNE 30, 1998), R99-4
On March 18, 1999, the Board adopted as final rules amend-
ments in the identical-in-substance rulemaking, In the Matter
of: Wastewater Pretreatment Update, USEPA Regulations
(January 1, 1998, through June 30, 1998) (December 17, 1998),
R99-4. Adopted pursuant to Sections 7.2 and 13.3 of the En-
vironmental Protection Act (415 ILCS 5/7.2 and 13.3 (1996)),
the amendments establish effluent limitations guidelines and
standards under the Federal Water Pollution Control Act
(FWPCA) (see 33 U.S.C. §§ 1317(b), (c), (d), 1342(b)(9)
(1996)) for a portion of the pulp, paper, and paperboard indus-
try. The amendments are intended to streamline the permit
application process to more closely reflect the processes found
in pulp, paper, and paperboard mills in the United States. The
rules incorporate federal amendments that occurred during the
period of January 1, 1998, through June 30, 1998 (see 63 Fed.
Reg. 18503 (April 15, 1998)). In the rules, the Board incorpo-
rated the federal amendments of April 15, 1998, either by use
of the actual text or through incorporation by reference, with
only minor deviation from the federal text. The Board also
incorporated the federal amendments of August 7, 1998 (see
63 Fed. Reg. 42238 (August 7, 1998)), correcting minor errors
in the effluent limitations guidelines and standards for hazard-
ous pollutants promulgated under the FWPCA for the pulp and
paper production category contained in the April 15, 1998 ac-
tion.
On December 17, 1998, the Board adopted a proposal for pub-
lic comment in this identical-in-substance rulemaking. See 23
Ill. Reg. 631 (January 15, 1999). Upon publication of the pro-
posal, a 45-day public comment period commenced. No pub-
lic comments were filed during the comment period.

United States and the settling party, Precision Chrome, Inc.
(Precision Chrome). 64 Fed. Reg. 11005 (March 8, 1999).
The proposed agreement has been approved by the United
States Attorney General’s delegate. The proposed agreement
would resolve certain potential claims of the United States under
Sections 106 and 107 of CERCLA (42 U.S.C. §§ 9606, 9607
(1980)) against Precision Chrome. The proposed agreement
would require Precision Chrome to pay the USEPA $95,000
for reimbursement of response costs.

NITED STATES ENVIRONMENTAL PROTECTION AGENCY
SETTLES WITH ROYAL CROWN BOTTLING COMPANY,
CHICAGO, COOK COUNTY, ILLINOIS
On March 16, 1999, the United States Environmental Protec-
tion Agency (USEPA) announced that it had signed a settle-
ment agreement with Royal Crown Bottling Company (Royal
Crown), located at 2801 West 47th Street, Chicago, Cook
County, Illinois (site), for violation of federal laws on the re-
porting of hazardous chemicals. Royal Crown will pay an
$8,248 fine and complete a supplemental environmental
project.
During a routine compliance inspection at the site in July 1996,
the USEPA learned that Royal Crown had never provided the
Illinois Commission or the Chicago Local Emergency Plan-
ning Committee with the required inventory forms for report-
ing hazardous chemicals stored on the site, including anhy-
drous ammonia. Anhydrous ammonia, which is used in Royal
Crown’s refrigeration systems, is a hazardous substance. Un-
der the Emergency Planning and Community Right-to-Know
Act of 1986 (42 U.S.C. § 11001
et seq.
(1986)), owners and
operators of facilities must submit forms for certain hazardous
chemicals every year by March 1. The USEPA calculated that
Royal Crown had 4,000 lbs. of anhydrous ammonia, 900 lbs.
of chlorine, and 624 lbs. of sulfuric acid. Under the regula-
tions, all amounts over 500 lbs. must be reported. The supple-
mental environmental project requires Royal Crown to pur-
chase and install ammonia sensors, plus an alarm, for its re-
frigeration systems. The new equipment is designed for early
detection of anhydrous ammonia releases. The cost of such
sensors, including three years of annual maintenance is $24,004.

STANDARDS FOR HAZARDOUS AIR POLLUTANT EMISSIONS: GROUP
I POLYMERS AND RESINS AND GROUP IV POLYMERS AND RESINS
AND STANDARDS FOR VOLATILE ORGANIC COMPOUND EMISSIONS
FROM THE POLYMER MANUFACTURING INDUSTRY
On March 9, 1999, the United States Environmental Protec-
tion Agency (USEPA) proposed amendments to the national
emission standards for hazardous air pollutant emissions
(NESHAPs) for Group I polymers and resins and Group IV
polymers and resins and standards for volatile organic com-
pound emissions (commonly referred to as volatile organic
material (VOM) in Illinois) from the polymer manufacturing
industry. 64 Fed. Reg. 11555, 11559 (March 9, 1999). On
September 5, 1996, the USEPA issued NESHAPs for Group I
polymers and resins (61 Fed. Reg. 46906 (September 5, 1996));
on September 12, 1996, the USEPA issued NESHAPs for the
Group IV polymers and resins (61 Fed. Reg. 48208 (Septem-
ber 12, 1996)); and on December 11, 1990, the USEPA is-
sued the standards of performance for VOM emissions from
the polymer manufacturing industry (55 Fed. Reg. 51035
(December 11, 1990)). In this action, the USEPA proposes
to revise the promulgated rules by adding clarifying provi-
sions and correcting minor errors in all of the above-men-
tioned rulemakings.
If adopted, these amendments are directly applicable, without
further rulemaking, in Illinois in accordance with Section 9.1(b)
of the Environmental Protection Act (415 ILCS 5/9.1(b)
(1996)).

APPROVES ILLINOIS STATE IMPLEMENTATION PLAN FOR
CENTRAL CAN COMPANY, CHICAGO, COOK COUNTY, ILLINOIS
On March 18, 1999, the United States Environmental Protec-
tion Agency (USEPA) approved an October 13, 1998 Illinois
State Implementation Plan (SIP) revision submittal revising
volatile organic compound (referred to in Illinois as volatile
organic material (VOM)) reasonably available control tech-
nology (RACT) requirements at Central Can Company (CCC)
in Chicago, Cook County, Illinois. 64 Fed. Reg. 13346 (March
18, 1999). The SIP revisions allow CCC to apply can coating
control rules to pail coating operations limited to certain con-
ditions.

OURTH DISTRICT APPELLATE COURT DISMISSES APPEAL IN
ESG WATTS, INC. V. ILLINOIS POLLUTION CONTROL BOARD
(NO. 4-98-0229), PCB 96-237
On February 4, 1999, the Fourth District Appellate Court en-
tered an Illinois Supreme Court Rule 23 (155 Ill. 2d R. 23)
order dismissing ESG Watts, Inc. v. Illinois Pollution Control
Board, No. 4-98-0229. The Fourth District agreed with the
Board that the matter should be dismissed since ESG Watts
failed to name all parties of record as party respondents in the
appeal as required by Illinois Supreme Court Rule 335(a) (155
Ill. 2d R. 335) and Section 3-113 of the Administrative Re-
view Law (735 ILCS 5/3-113).
In May 1996, the State of Illinois (State) filed a complaint be-
fore the Board against ESG Watts. The State alleged that ESG
Watts’ Sangamon Valley Landfill violated certain sections of
the Environmental Protection Act (Act) (415 ILCS 5/1
et seq
.
(1996)) and corresponding Board regulations pertaining to the
proper funding for closure and post-closure care of the land-
fill. The Board issued an order on February 19, 1998, finding
ESG Watts in violation of the Act and Board rules, and impos-
ing a penalty of $256,000, as well as $2,400 in attorney fees.
See People v. ESG Watts, Inc. (February 19, 1998), PCB 96-
237.
ESG Watts appealed the Board’s decision to the Illinois Ap-
pellate Court challenging the amount of the penalty. How-
ever, in its petition to the court, ESG Watts named only the
Board as a party respondent and failed to name the State as a
party respondent. As a result, the Board moved to dismiss the
petition arguing that the court lacked jurisdiction due to ESG
Watts’ failure to name as respondents all parties of record.

APPELLATE UPDATE
On December 5, 1994, CCC filed a petition with the Board for
an adjusted standard allowing CCC to apply the can coating
requirements found at 35 Ill. Adm. Code 218, including the
cross-line averaging provisions, to its pail coating operations.
On August 6, 1998, the Board granted an adjusted standard to
CCC to treat its pail coating as can coating for purposes of
complying with the State’s Part 218 rules, provided the fol-
lowing: (1) no more than 20 percent of the total number of
cans and pails coated on an annual basis are pails; (2) the pails
are geometrically identical to cans coated at the facility, in terms
of shape and volume; and (3) the pails are produced from metal
with a thickness of no more than 20 gauge (.039 inches).

As a threshold issue, ESG Watts requested that the court strike
the Board’s motion to dismiss due to a recent supervisory or-
der issued by the Illinois Supreme Court on December 2, 1998,
pertaining to two matters before the Third District Appellate
Court. In the two matters before it, the Third District dismissed
the appeals for lack of jurisdiction because ESG Watts failed
to name all necessary parties to the administrative review pro-
ceedings as required by Illinois Supreme Court Rule 335 (155
Ill. 2d R. 335) and Sections 3-107 and 3-113 of the Adminis-
trative Review Law (735 ILCS 5/3-107, 113). See ESG Watts,
Inc. v. Illinois Pollution Control Board, Nos. 3-98-0231 and 3-
98-0385 (November 1998); see also People v. ESG Watts, Inc.
(February 5, 1998), PCB 96-107 and People v. ESG Watts,
Inc. (April 16, 1998), PCB 96-233. ESG Watts filed a petition
for leave to appeal before the Illinois Supreme Court, but the
court denied ESG Watts’ leave to appeal. However, the Illi-
nois Supreme Court issued a supervisory order which directed
the Third District to vacate its orders in the two appeals (Nos.
3-98-0231 and 3-98-0385). The Illinois Supreme Court fur-
ther ordered the Third District to address the appeals on the
merits. The parties are presently briefing those appeals pursu-
ant to the schedule established by the Third District Appellate
Court.
Oral argument was held before the Fourth District on January
19, 1999, at which time arguments concerning both the juris-
dictional issues and the merits of the appeal were heard. Find-
ing that the Illinois Supreme Court’s December 2, 1998 super-
visory order did not constitute legal precedent guiding its dis-
position of the Board’s motion to dismiss, the Fourth District
granted the Board’s motion to dismiss. The court determined
that Illinois Supreme Court Rule 335(a) (155 Ill. 2d R. 335(a))
and the Administrative Review Law (735 ILCS 5/3-101
et seq
.
(1996)) required ESG Watts to name the State as a party re-
spondent. Relying on McGaughy v. Illinois Human Rights
Commission, 165 Ill. 2d 1, 6-7, 649 N.E.2d 404, 407 (1995),
the court stated that appellate courts have the capability to ex-
ercise special statutory jurisdiction when they review decisions
from administrative agencies. Additionally, the court reasoned
that it must strictly adhere to the prescribed procedures when
considering its jurisdictional limits and power as well as a
party’s remedy under a specific statute. Pursuant to McGaughy,
the appellate court concluded that it must dismiss a petition for
review if the party seeking review fails to comply with the
statutory procedures in filing the matter before the court.
For these jurisdictional reasons, the Fourth District Appellate
Court dismissed ESG Watts, Inc. v. Illinois Pollution Control
Board, No. 4-98-0229, for administrative review. Justice Rob-
ert J. Steigmann wrote the decision for the court and Justices
Rita B. Garman and Sue E. Myerscough concurred. On March
2, 1999, the Board received ESG Watts’ affidavit of intent to
appeal to the Illinois Supreme Court.

ECOND DISTRICT APPELLATE COURT DISMISSES APPEAL IN M.
SALEEM CHOUDRY V. ILLINOIS POLLUTION CONTROL BOARD
(NO. 2-98-1164), AC 97-13
On January 26, 1999, the Second District Appellate Court, in
an Illinois Supreme Court Rule 23 order (155 Ill. 2d R. 23),
dismissed this action because M. Saleem Choudry (Choudry)
failed to file a brief in support of his appeal. On September 5,
1998, Choudry filed a petition for appeal of an August 6, 1998
Board decision. In its August 6, 1998 decision, the Board found
that Choudry violated Section 21(p)(1) and (4) of the Environ-
mental Protection Act (415 ILCS 5/21(p)(1), (4) (1996)) and
ordered Choudry to pay a civil penalty of $1,000. The Board
also ordered Choudry to pay hearing costs to the Board in the
amount of $1,270 and to the County of DuPage in the amount
of $1,379.
On December 7, 1998, the court ordered Choudry to file a brief
in support of his appeal by January 8, 1999, stating that if
Choudry failed to do so, the court would dismiss the petition
for appeal. The dismissal order was entered on January 26,
1999.

IFTH DISTRICT APPELLATE COURT AFFIRMS BOARD DECISION
IN CITIZENS OPPOSED TO ADDITIONAL LANDFILLS V. GREATER
EGYPT REGIONAL ENVIRONMENTAL COMPLEX (NO. 5-97-1037),
PCB 97-233
On March 29, 1999, the Fifth District Appellate Court, in an
order issued pursuant to Illinois Supreme Court Rule 23 (155
Ill. 2d R. 23), affirmed the Board’s decision in Citizens Op-
posed to Additional Landfills v. Greater Egypt Regional Envi-
ronmental Complex (November 6, 1997), PCB 97-233.
In its November 6, 1997 decision, the Board affirmed the site
location suitability approval for a pollution control facility
granted by the Perry County Board (Perry County) to the
Greater Egypt Regional Environmental Complex (GERE) un-
der Section 39.2 of the Environmental Protection Act (Act)
(415 ILCS 5/39.2 (1996)). Citizens Opposed to Additional
Landfills (COAL) and Harvey Pitt (Pitt) appealed the landfill
siting decision granted by Perry County to GERE.
The decision by the Board in docket PCB 97-233 resolved an
appeal of the decision of Perry County after this matter was re-

The jurisdictional challenge involved the issue of whether
GERE had properly sent notice to adjoining landowners under
Section 39.2(b) of the Act in circumstances where it used the
authentic tax records of the Perry County treasurer, but where
these records did not contain current addresses. The Fifth Dis-
trict affirmed its earlier ruling in Bishop v. Pollution Control
Board, 235 Ill. App. 3d 925, 601 N.E.2d 310 (5th Dist. 1992),

RESTRICTED STATUS LIST -- PUBLIC WATER SUPPLIES
The Restricted Status List was developed to give additional notification to officials of public water supplies which are in violation of 35 Ill. Adm. Code, Subtitle F:
Public Water Supplies, Chapter I or the Illinois Environmental Protection Act.
The Restricted Status List will include all Public Water Supplies for which the Agency has information indicating a violation of any of the following requirements:
Finished water quality requirements of 35 Ill. Adm. Code, Part 604, Subparts B and C; maintenance of adequate pressure on all parts of the distribution system under
all conditions of demand; meeting raw water quantity requirements of 35 Ill. Adm. Code 604.502; or maintenance of treatment facilities capable of providing water
“assuredly adequate in quantity” as required by Section 18 of the Illinois Environmental Protection Act.
A public water supply on the Restricted Status List will not be issued permits for water main extensions, except for certain limited situations, or unless the supply has
been granted a variance from the Illinois Pollution Control Board for the violation, or from permit issuance requirements of Section 39 of the Act.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the status of any public water supply should be
directed to the Division of Public Water Supplies for final determination. This list reflects the status as of April 1, 1999.

CRITICAL REVIEW LIST -- PUBLIC WATER SUPPLIES
The Critical Review List was developed to give additional notification to officials of public water supplies which may be close to being in violation of 35 Ill. Adm.
Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental Protection Act.
A supply will be placed on the Critical Review List when Agency records indicate that it is approaching any of the violations which would place it on the Restricted
Status List.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the status of any public water supply should be
directed to the Division of Public Water Supplies for final determination. This list reflects the status as of April 1, 1999.
