nited States Environmental Protection Agency Approves State Imple-
mentation Plan for Riverside Laboratories, Inc., located in Kane
County, Illinois
On July 1, 1998, the United States Environmental Protection Agency
(USEPA) approved a state implementation plan (SIP) revision requested by the
State of Illinois on behalf of Riverside Laboratories, Inc. (Riverside), a facility
located in Kane County, Illinois. 63 Fed. Reg. 35842 (July 1, 1998).
On August 21, 1995, USEPA promulgated a site-specific volatile organic
material (VOM) rule for Riverside. See 60 Fed. Reg. 43388 (August 21, 1995).
The rule consisted primarily of a compliance date extension for Riverside
through December 31, 1996, after which time Riverside was required to meet the
applicable requirements of the Chicago-area federal implementation plan (FIP).
On October 10, 1997, Illinois requested that USEPA approve a change in
regulatory status for Riverside, based on Riverside’s compliance with the
applicable SIP rule at that time.
This direct final rule is effective August 31, 1998, unless adverse written
comments or a request for public hearing were received by July 31, 1998.

to the National Emission Standards for Hazardous Air Pollutants for
Wood Furniture Manufacturing Operations
On June 24, 1998, the United States Environmental Protection Agency
(USEPA) proposed amendments to the National Emission Standards for
Hazardous Air Pollutants (NESHAP) for wood furniture manufacturing opera-
tions. 63 Fed. Reg. 34336 (June 24, 1998). The proposal amends rules

costs that taxpayers have spent to clean up certain
contaminated properties (or “brownfields”). The tax
credit is intended to spur the cleanup and redevelopment
of brownfields. A taxpayer who wishes to claim the tax
credit must first submit to the IEPA an application for
review of its cleanup (or “remediation”) costs. The
Board’s first notice proposal establishes the procedures
and standards under which the IEPA will consider these
applications.
The Board held three public hearings in this matter:
the first, in Chicago, on February 24, 1998; the second, in
Springfield, on February 27, 1998; and the third, also in
Springfield, on March 17, 1998. The March 17, 1998
hearing was solely for the purpose of receiving comment
on the Department of Commerce and Community Affairs’
decision not to perform an economic impact study on the
IEPA’s proposed rules pursuant to Pub. Act 90-489,
effective January 1, 1998. On April 16, 1998, the Board
adopted the proposal for first notice publication in the
Illinois Register
, whereupon a 45-day public comment
period commenced.

oard Adopts Rules in In the Matter of: Enhanced
Vehicle Inspection and Maintenance Regulations:
Amendments to 35 Ill. Adm. Code 240, R98-24
On July 8, 1998, the Board adopted amendments to 35
Ill. Adm. Code 240, the Enhanced Vehicle Inspection and
Maintenance (I/M) Regulations. The amendments are
required by Sections 182(b) and (c) of the federal Clean
Air Act Amendments (CAAA), 42 U.S.C. §§ 7582(b), (c)
(1990) and by the Vehicle Emissions Inspection Law, 625
ILCS 5/13B-5 (1996). The CAAA require the use of I/M
programs in areas that do not meet the National Ambient
Air Quality Standards for ozone or carbon monoxide. In
Illinois, the Chicago and Metro-East St. Louis areas are
classified as “severe” and “moderate” nonattainment areas
for ozone. Pursuant to Section 5/13B-5 of the Vehicle
Emissions Inspection Law (625 ILCS 5/13B-5 (1996)),
Chicago and Metro-East St. Louis are subject to these I/M
regulations. In 1994, the Board adopted the bulk of the
I/M standards necessary for implementation of the I/M
program (see R94-19, 18 Ill. Reg. 18228 (December 14,
1994) and R94-20, 18 Ill. Reg. 18013 (December 12,
1994)).
The adoption by the Board of these amendments is
authorized under Section 28.5 of the Environmental
Protection Act (Act), (415 ILCS 5/28.5 (1996)). The
Board found that as the federal Clean Air Act requires the
Board to adopt the amendments, the amendments should
be adopted in accordance with the Section 28.5
rulemaking procedures. The Board adopted the proposal
for first notice publication in the
Illinois Register
on
January 22, 1998. See 22 Ill. Reg. 2720 (February 6,
1998). On March 17, 1998, the Board held one hearing
on the merits of the proposal. The Board received three
public comments in this proceeding. On May 21, 1998,
the Board voted to submit amendments for second notice
review by the Joint Committee on Administrative Rules
(JCAR). On June 16, 1998, JCAR voted “no objection”
to the rules as proposed.
The rules contain clarifications and modifications to
existing standards, and new standards for the remaining
portions of the enhanced I/M testing program. More
specifically, the amendments replace the current evapora-
tive system testing program (which uses a pressure test
and a purge test to test the entire system’s integrity) with a
fuel cap only inspection. The rules also add fast-pass
standards to allow vehicles undergoing I/M 240 exhaust
emissions tests to be tested more quickly. Further, the
rules add standards for the required on-road sensing test.
Finally, the rules add a program for on-board diagnostic
testing that will become mandatory on January 1, 2001,
consistent with very recent federal action. See 63 Fed.
Reg. 24429 (May 4, 1998).

oard Adopts Site-Specific Air Regulation in In the
Matter of: Petition of W.R. Grace & Company -
Connecticut and the Illinois Environmental
Protection Agency for Site-Specific Air Regulation: 35
Ill. Adm. Code 218.940(h), R98-16
On July 8, 1998, the Board adopted a site-specific air
regulation in response to a petition filed on November 19,
1997, by W.R. Grace & Company - Connecticut (Grace)
and the Illinois Environmental Protection Agency (IEPA).
The petition was filed pursuant to Section 27 of the
Environmental Protection Act (Act) (415 ILCS 5/27
(1996)). The order grants the parties’ request to add a
site-specific regulation for Grace’s facility at Subpart QQ
of 35 Ill. Adm. Code 218, specifically at Section
218.940(h). Specifically, the site-specific rule pertains
solely to volatile organic material emissions resulting
from the production of solvent lining compound mixers
used to produce solvent-based sealants at Grace’s facility.
The Agency, as a joint proponent in the rulemaking,
agreed that the site-specific relief is appropriate. The
Board found that no add-on control technology is
reasonably available for the solvation process at Grace,

and that no impact to the land, water, or water supplies
will result from the VOM emission from Grace’s mixers.
On December 18, 1997, the Board adopted the
proposal for first notice publication in the
Illinois
Register
. See 22 Ill. Reg. 1091 (January 9, 1998). A
hearing in this matter was held on January 8, 1998, and
continued on the record until January 21, 1998. An
additional hearing was held pursuant to Section 27(b) of
the Act (415 ILCS 5/27(b) (1996)) on March 30, 1998, on
the single issue of the decision of the Illinois Department
of Commerce and Community Affairs not to conduct an
Economic Impact Study in connection with this rulemak-
ing. On May 7, 1998, the Board adopted the amendments
for second notice review by the Joint Committee on
Administrative Rules (JCAR). JCAR voted “no objec-
tion” to the rules as proposed at its June 16, 1998,
meeting.

oard Denies Petition for Adjusted Standard in In
the Matter of: Petition of City of Salem for
Adjusted Standard from 35 Ill. Adm. Code
814.Subpart D, AS 98-2
On July 8, 1998, the Board denied the City of Salem’s
(Salem) petition for an adjusted standard from 35 Ill.
Adm. Code 814.Subpart D. Salem operates a landfill,
Existing Landfill #2, in Marion County, Illinois. Pursuant
to Board regulations at 35 Ill. Adm. Code 814.Subpart D
and permits issued by the Illinois Environmental Protec-
tion Agency, Salem’s landfill was required to close by
September 18, 1997. Salem petitioned for the adjusted
standard so it could continue to operate the southern unit
of its landfill until September 18, 1998, or the date when a
new northern unit of the landfill under construction is
completed, whichever is sooner. The Board found that
Salem did not satisfy the statutory requirements set forth
at Section 28.1(a) of the Environmental Protection Act
(415 ILCS 5/28.1(a) (1996)) necessary for the Board to
grant the adjusted standard it seeks. Specifically, the
Board found that Salem did not establish that factors
relating to it are substantially and significantly different
from those factors considered by the Board in R88-7 (see
In the Matter of: Development, Operation and Reporting
Requirements for Non-Hazardous Waste Landfills
(August 17, 1990), R88-7.)
The Board also denied a related variance in City of
Salem v. Illinois Environmental Protection Agency (July
8, 1998), PCB 98-1. Similar to the adjusted standard,
Salem petitioned for the variance so that it may continue
to operate the southern unit of its landfill, Existing
Landfill #2, until either September 18, 1998, or the date
when a new northern unit of the landfill under construc-
tion is completed. The Board found that Salem failed to
provide a compliance plan and failed to demonstrate that
it would suffer an arbitrary or unreasonable hardship if the
variance is denied, as required by 35 Ill. Adm. Code
104.121(f).

originally promulgated by USEPA on December 7, 1995
(60 Fed. Reg. 62930 (December 7, 1995)). These 1995
standards established emissions limits for, among other
things, coating and gluing of wood furniture and wood
furniture components. Section 9.1(b) of the Environ-
mental Protection Act (415 ILCS 5/9.1(b) (1996))
provides that NESHAPs are automatically applicable in
Illinois.
USEPA’s current proposal offers amendments to the
rule pursuant to three agreements USEPA reached in
settlement of the following petitions for review: Chemical
Manufacturers Association v. USEPA, No. 96-1031 (D.C.
Cir.); Halogenated Solvents Industry Alliance, Inc. v.
USEPA, No. 96-1 (D.C. Cir.); and Society of the Plastic
Industry, Inc. v. Browner, No. 96-1038 (D.C. Cir.).
USEPA executed settlement agreements with each of
these petitioners on December 18, 1997 (see 62 Fed. Reg.
67360 (December 18, 1997)).
The settlement agreement with the Chemical Manu-
facturers Association requires USEPA to conduct notice
and comment rulemaking proposing that certain glycol
ethers be removed from the list of volatile hazardous air
pollutants of potential concern in table 6 of the wood
furniture NESHAP. The settlement with the Halogenated
Solvents Industry Alliance requires USEPA: (1) to
conduct notice and comment rulemaking in accordance
with Section 307(d) of the Clean Air Act (42 U.S.C. §
7607(d) (1990)) proposing that perchloroethylene and
trichloroethylene be deleted from the list of pollutants
prohibited from use in cleaning and washoff solvents; and
(2) to give great weight to the recommendations of the
Science Panel of the Joint Methylene Chloride Characteri-
zation Task Force regarding whether a reassessment of the
cancer risk hazard for methylene chloride should be
undertaken based on current scientific information. The
settlement agreement with the Society of the Plastic
Industry, Inc. requires USEPA to propose several
technical amendments to the wood furniture NESHAP.

Proposes Pretreatment Standards for Transporta-
tion Equipment Cleaning Operations
On June 25, 1998, the United States Environmental
Protection Agency proposed technology-based effluent
limitation guidelines for the discharge of pollutants into
waters of the United States and into publicly owned
treatment works by existing and new facilities that
perform transportation equipment cleaning (TEC)
operations. 63 Fed. Reg. 34685 (June 25, 1998). TEC
facilities are defined as those facilities that generate
wastewater from cleaning the interior of tank trucks,
closed-top hopper trucks, rail tank car closed-top hopper
rail cars, intermodal tank containers, inland tank barges,
closed-top barges, ocean/sea tankers, and other similar
tanks (excluding drums and intermediate bulk containers)
used to transport materials or cargos that come into direct
contact with the tank or container interior. Facilities
which do not engage in cleaning the interior of tanks are
not considered within the scope of this proposal.

ndian Refinery-Texaco in Lawrenceville, Lawrence
County, Illinois, and Evergreen Manor in Roscoe,
Winnebego County, Illinois Proposed As Additions
to the Superfund National Priority List of Hazardous
Waste Sites
On July 29,1998, the United States Environmental
Protection Agency (USEPA) announced that two Illinois
sites, Indian Refinery-Texaco, located in Lawrenceville,
and Evergreen Manor, located in Roscoe, have been
proposed for the Superfund National Priority List of
hazardous waste sites. The sites on the list are eligible for
long-term cleanup under the Superfund program. The
Indian Refinery-Texaco site is an oil refining facility that
ceased operations in November 1995. The Evergreen
Manor site consists of a 2 ¼ mile long plume of ground-
water contaminated with as many as 17 organic com-
pounds. More than 85 residential wells are affected by the
plume.
If adopted by USEPA, the Board anticipates that it
will adopt these regulations in an identical-in-substance
rulemaking.

Proposes Revisions to the Underground Injection
Control Regulations for Class V Injection Wells
On July 29, 1998, the United States Environmental
Protection Agency (USEPA) proposed changes to the
Class V Underground Injection Control (UIC) regulations
that would add new requirements for the three categories
of Class V wells that pose a high risk when located in
groundwater-based source water protection areas being
delineated by states under the 1996 Amendments to the
Safe Drinking Water Act (42 U.S.C. § 300f
et seq.
(1996)). 63 Fed. Reg. 40585 (July 29, 1998).
Under the proposed rules, Class V motor vehicles
waste disposal wells in such areas would either be banned
or would have to get a permit that requires fluids released
in those wells to meet the drinking water maximum
contaminant levels (MCLs) at the point of injection. Class
V industrial waste disposal wells in groundwater-based
source water protection areas also would be required to
meet the MCLs at the point of injection, and large-
capacity cesspools in such areas would be banned.
USEPA also proposes these new requirements to address
three categories of wells that it has identified as posing a
high risk of groundwater contamination based on available
information. These are motor vehicle waste disposal
wells, industrial waste disposal wells, and cesspools in
groundwater-based source water protection areas.
USEPA anticipates that targeting the requirements to
those wells will achieve substantial protection of under-
ground sources of drinking water.

Proposes Revisions to Compliance Program for
New Light-Duty Vehicles and Light-Duty Trucks
On July 23, 1998, the United States Environmental
Protection Agency (USEPA) proposed revisions to the
compliance procedures for light-duty vehicles and light-
duty trucks. 63 Fed. Reg. 39653 (July 23, 1998). USEPA
is proposing a new compliance assurance program,
referred to as “CAP 2000.” CAP 2000 is intended to
simplify and streamline the current procedures for pre-
production certification of new motor vehicles. Under
this proposal, the certification program would provide the
same environmental benefits as the current procedures
while significantly reducing the certification cost for
manufacturers, and would give manufacturers more
control of production timing .

USEPA is proposing that manufacturers test in-use
motor vehicles to monitor compliance with emission
standards. Manufacturers would test samples of in-use
vehicles when they are approximately one and four years
old. This test data would be used to improve certification
processing, predict in-use compliance, and determine the
need for further activity by USEPA or the manufacturer to
address any in-use compliance problems. USEPA
proposes that the CAP 2000 program be implemented
beginning with model year 2001 vehicles. Manufacturers
would be allowed to voluntarily opt-in to the CAP 2000
procedures beginning with the 2000 model year. USEPA
estimates that overall, manufacturers would save about
$55 million dollars a year as a result of this proposal.

epartment of Energy Proposes Amendments to
Definition of “Alternative Fuel”
On July 28, 1998, the Department of Energy proposed
to amend the rules for statutory program requiring certain
alternative fuel providers and State government fleets to
acquire an annually increasing percentage of alternative
fueled vehicles from among their purchases of new light
duty vehicles. 63 Fed. Reg. 40202 (July 28, 1998). The
proposed regulatory amendments would add certain
blends of methyltetrahydrofuran, ethanol, and hydrocar-
bons known as the “P-series fuels” to the definition of
“alternative fuel.”

nited States and Canada to Monitor Toxic Air
Pollutants Around the Great Lakes
On July 30, 1998, the United States Environmental
Protection Agency (USEPA) and Environment Canada
agreed to continue monitoring toxic substances in the air
around the Great Lakes. They will do so through the
Integrated Atmospheric Deposition Network (IADN), a
leading international effort that has helped establish the
significance of long-range atmospheric transport of toxic
substances. IADN, required by the Great Lakes Water
Quality Agreement between the United States and Canada,
is a joint USEPA and Environment Canada program.
The network assesses the input to aquatic systems of
airborne, persistent, organic pollutants. Moreover, the
network is designed to assess the magnitude and trends of
atmospheric deposition of target chemicals including
polychlorinated biphenyls (PCBs), chlorinated pesticides,
and trace metals such as lead and mercury. Stations on
remote shores of each Great Lake collect regional
contaminant data that is representative of the air over each
lake and that is not affected by local sources. Concentra-
tions of target chemicals are measured in rain and snow,
airborne particles, and airborne organic vapors. USEPA
signed a seven-year plan with Environment Canada to
continue the work of IADN.

Restricted Status List -- Public Water Supplies
The Restricted Status List was developed to give additional notification to officials of public water
supplies which are in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or
the Illinois Environmental Protection Act.
The Restricted Status List will include all Public Water Supplies for which the Agency has information
indicating a violation of any of the following requirements: Finished water quality requirements of 35
Ill. Adm. Code, Part 604, Subparts B and C; maintenance of adequate pressure on all parts of the distri-
bution system under all conditions of demand; meeting raw water quantity requirements of 35 Ill. Adm.
Code 604.502; or maintenance of treatment facilities capable of providing water "assuredly adequate in
quantity" as required by Section 18 of the Illinois Environmental Protection Act.
A public water supply on the Restricted Status List will not be issued permits for water main extensions,
except for certain limited situations, or unless the supply has been granted a variance from the Illinois
Pollution Control Board for the violation, or from permit issuance requirements of Section 39 of the Act.
This list is continually being revised as new information becomes available, and therefore, specific
inquiries as to the status of any public water supply should be directed to the Division of Public Water
Supplies for final determination. This list reflects the status as of July 1, 1998.

Critical Review List -- Public Water Supplies
The Critical Review List was developed to give additional notification to officials of public water
supplies which may be close to being in violation of 35 Ill. Adm. Code, Subtitle F: Public Water
Supplies, Chapter I or the Illinois Environmental Protection Act.
A supply will be placed on the Critical Review List when Agency records indicate that it is approaching
any of the violations which would place it on the Restricted Status List.
This list is continually being revised as new information becomes available, and therefore, specific
inquiries as to the status of any public water supply should be directed to the Division of Public Water
Supplies for final determination. This list reflects the status as of July 1, 1998.
