On December 8, 1997, the
United States Environmental
Protection Agency (USEPA)
promulgated amendments to 40
CFR 264, 265, and 270. 62 Fed.
Reg. 64635 (December 8, 1997).
The standards were originally
promulgated under the authority of
the Resource Conservation and
Recovery Act (RCRA) (59 Fed.
Reg. 62896 (December 6, 1994)),
to reduce organic air emissions
from certain hazardous waste
management activities,
i.e.,
certain
tanks, containers, and surface
impoundments, to levels that are
protective of human health and the
environment. Since publication of
the final standards on December 6,
1994, the USEPA has given public
notice and taken comments on
several proposed revisions to the
final rule. In response to such
comments, the USEPA has made
clarifying amendments to the
preamble and text of the regula-
tions.

Board Adopts Final Amended
Rules in the Matter of Tiered
Approach to Corrective Action
Objectives: Amendments to 35
Ill. Adm. Code 742, R97-12(B)
On December 4, 1997, the
Board adopted final amendments
to 35 Ill. Adm. Code 742, Tiered
Approach to Corrective Action
Objectives (TACO). The TACO
program establishes a three-tiered
approach for establishing
corrective action objectives,
i.e.,
remediation objectives based on
risks to human health and the environment, allowing for consideration of the
proposed land use at a subject site. The amendments adopted on December 4,
1997, (also known as the mixture rule) addresses the effect of similar-acting
chemicals on the same target organ when determining remediation objectives
under TACO. Specifically, the amendments consider the effects of similar-
acting chemicals,
i.e.,
noncarcinogens and carcinogens, under Tiers 1, 2, and 3
of the TACO process.
The mixture rule, as amended, under Tier 1 still applies to similar-acting
noncarcinogens detected in Class I groundwater, but now also applies to certain
similar-acting carcinogens in groundwater whose Tier 1 Class I groundwater
remediation objectives exceed the 1 in 1,000,000 cancer risk concentrations.
There is still no mixture rule applicable to either noncarcinogens or carcinogens
in soil under Tier 1. The mixture rule under Tier 2 likewise now applies to both
similar-acting noncarcinogens and carcinogens in groundwater. As for soil, the
mixture rule under Tier 2 is not amended; it still only applies

oard Adopts First Notice Proposal in the Matter
of Tiered Approach to Corrective Action Objec-
tives: Amendments to 35 Ill. Adm. Code 742, R97-
12(C)
On December 4, 1997, the Board adopted for first-
notice publication in the
Illinois Register
amendments to
35 Ill. Adm. Code 742. The Board opened this docket as
a result of a joint motion filed on December 3, 1997, on
behalf of the Site Remediation Advisory Committee
(SRAC) and the Illinois Environmental Protection Agency
(IEPA). In their joint motion, the SRAC and the Agency
request that the Board make corrections to Appendix
A.Table H, entitled “Chemicals Whose Tier I Class I
Groundwater Remediation Objective Exceed the 1 in
1,000,000 Cancer Risk Concentration” (Table H). The
Board found that at this point in the R97-12 rulemaking
process, the Illinois Administrative Procedure Act (which
governs rulemakings) does not provide for the expeditious
correction of Table H. Accordingly, the Board opened
this Subdocket C to consider the merits of the joint motion
and evidence in support thereof. The Board also on its
own motion proposes to amend additional sections in Part
742 in order to make some non-substantive grammatical,
typographical, and mechanical changes that were identi-
fied after the adoption of Docket A in this rulemaking.
This proposal will be submitted to the Secretary of
State for publication in the
Illinois Register,
whereupon a
45-day comment period shall commence. Anyone
interested in submitting written comments should address
such comments to the Clerk of the Board. The Board also

oard Proposes for First Notice Amendments in the
Matter of Safe Drinking Water Update: United
States Environmental Protection Agency Update,
January 1, 1997, through June 30, 1997, R98-2
On December 4, 1997, the Board adopted for first-
notice publication in the
Illinois Register
, amendments to
update 35 Ill. Adm. Code 611 of the Board’s regulations
that are identical in substance to the United States
Environmental Protection Agency’s (USEPA) regulations
implementing the Safe Drinking Water Act. It includes
corrections to the federal rules, as adopted by USEPA on
March 5, 1997 (see 62 Fed. Reg. 10168 (March 5, 1997)).
This rulemaking concerns revisions to Part 611 regarding
radiological monitoring and analytical requirements.
More specifically, it proposes to approve the use of 66
additional analytical methods for compliance with current
radionuclide drinking water standards and monitoring
requirements. Pursuant to Section 17.5 of the Illinois
Environmental Protection Act (Act) (415 ILCS 5/17.5
(1996)), the Board must expeditiously adopt regulations
that are identical in substance to federal regulations.
Section 17.5 of the Act also provides that Title VII of
the Act and Section 5 of the Illinois Administrative
Procedure Act (APA) (5 ILCS 100/5-35, 5-45 (1996)) do
not apply. Because this rulemaking is not subject to
Section 5 of the APA, it is not subject to first-notice
requirements or second-notice review by the Joint
Committee on Administrative Rules.
This proposal will be submitted to the Secretary of
State for publication in the
Illinois Register,
whereupon a
45-day comment period shall commence. Anyone
interested in submitting written comments should address

oard Adopts Second Notice Proposal in Site-
Specific Petition of Mobil Oil Corporation for
Relief from 35 Ill. Adm. Code 304.122, Ammonia
Nitrogen Effluent Standards, R97-28
On December 4, 1997, the Board adopted for second
notice a site-specific petition of Mobil Oil Corporation
(Mobil) for relief from 35 Ill. Adm. Code 304.122,
relating to the Board’s ammonia nitrogen effluent
standards. Mobil requests that ammonia nitrogen
effluents limits applicable to the Joliet Refinery be
permanently set at 9.0 mg/L measured as a monthly
average and 23.0 mg/L measured as a daily maximum.
Mobil further requests that this proposal be effectuated by
reactivation of Section 304.214, with new effluent limits
replacing the old, and with the old expiration date deleted.
One public hearing was held in this matter on July 2,

. At first notice, the Board, on September 18,
1997, adopted Mobil’s proposal for first notice. See 21
Ill. Reg. 13500 (October 10, 1997). The first-notice
proposal as adopted by the Board was essentially identical
to that proposed by Mobil, with the exception of proposed
termination (sunsetting) of the rule on December 21,
2007.
The Board adopted the proposed amendments for
second notice, pursuant to the Illinois Administrative
Procedure Act (5 ILCS 100/1-1
et seq.
(1996)). The
amendments as proposed are identical to those proposed
for first notice, with the exception of several, small, non-
substantive items suggested by the Joint Committee on
Administrative Rules.

oard Adopts First Notice Order in the Matter of:
Petition of W.R. Grace & Company - Connecticut,
and the Illinois Environmental Protection Agency
for Site-Specific Air Regulation, R98-16
On December 4, 1997, the Board accepted for hear-
ing the petition of W.R. Grace & Company - Connecticut
(W.R. Grace) and the Illinois Environmental Protection
Agency (IEPA) for a site-specific air regulation. On
November 19, 1997, W.R. Grace and the IEPA filed a
joint proposal for a site-specific rulemaking. W.R. Grace
operates a factory located at 6050 West 51st Street,
Chicago, Cook County, Illinois (the facility). The facility
manufacturers sealants, lubricant fluids, and concrete
additives. The instant petition proposes that a site-
specific air regulation for the facility be added to Subpart
QQ of 35 Ill. Adm. Code 218 at Section 218.940(h). The
Board found that the petition met the information
requirements of 35 Ill. Adm. Code 102.121 and 102.141
and accepted the matter for hearing.
The proponents also filed a motion for expedited re-
view of the petition, requesting that the Board proceed to
hearing during the week of January 5, 1998, and that it
adopt the rules for first notice at its December 4, 1997,
meeting. The Board granted this motion in part. While
the Board anticipated that a hearing would be scheduled
for the week of January 5, 1998, it ordered that it would
not proceed to first notice at the December 4, 1997,
meeting.
On December 18, 1997, the Board adopted a first
notice order under the Illinois Administrative Procedure
Act (5 ILCS 100/5-5
et seq.
(1996)) without commenting
on the merits of the proposal. The proposal will be
published in the
Illinois Register
whereupon a 45-day
comment period will begin.

oard Adopts Final Order in Conforming Amend-
ments for the Great Lakes Initiative: 35 Ill. Adm.
Code 302.101, 302.105, 302.Subpart E, 303.443,
and 304.222, R 97-25
On December 18, 1997, the Board adopted a final-
order in the Great Lakes Initiative (GLI), docketed by the
Board as R97-25. The GLI is a federally-required rule
that has been proposed in accordance with Section 28.2 of
the Environmental Protection Act (415 ILCS 5/28.2
(1996)). The United States Environmental Protection
Agency published the GLI as a final rule on March 23,
1995, at 60 Fed. Reg. 15366.
The first hearing was held in this matter prior to first
notice on May 19, 1997, in Chicago. On June 19, 1997,
the Board adopted a first-notice opinion and order. The
second hearing was held during the first-notice period on
July 28, 1997, in Waukegan. On October 16, 1997, the
Board adopted an order for second-notice review by the
Joint Committee on Administrative Rules (JCAR).
At second notice, the Board added a new section
302.520 which delineates procedures for amending the list
of bioaccumulative chemicals of concern (BCC). The
Board also modified Section 302.575 to clarify that the
methods set forth in that section are to be used to develop
Tier I wildlife criteria for non-BCCs. Finally, the Board
denied the Illinois Environmental Regulatory Group’s
motion to create a subdocket regarding whether it is
economically and technically justifiable to adopt a phase
out of mixing zones for BCCs. The Board found that the
phasing out of mixing zones will help to insure the water
quality of the Lake Michigan Basin and thereby protect
human health and the environment at minimal economic
costs to dischargers to the Lake Michigan Basin. The
Board further found that although the Board must
consider the economic reasonableness of a rule, the Board
is not limited to adopting only rules which the Board has
determined to be technically feasible and economically
reasonable.
On December 16, 1997, JCAR issued a certificate of
no objection. At that time, the Board agreed to make two
changes requested by JCAR, namely to amend Section
302.504 to allow for four samples to be averaged when
determining whether the human health standard for nine
chemicals set out in the federal GLI have been exceeded.
The Board also agreed to amend Section 302.550 to
specify what methods of sample collection, preservation,
and analysis shall be used in applying any of the require-
ments of Subpart 302. Despite JCAR’s request, however,
the Board declined to review its decision to retain a phase
out of mixing zones for BCCs in Lake Michigan. The
Board remained convinced that the phase out of mixing
zones was economically reasonable and was consistent
with the intent of the federal GLI. Aside from the changes
made at the request of JCAR, the Board’s final order is
similar to that order adopted by the Board at second
notice.

On December 18, 1997, the Board adopted for
second-notice review by the Joint Committee on Admin-
istrative Rules (JCAR)
 
amendments to 35 Ill. Adm. Code
211, 218, and 219 regarding wood furniture coating
operations. The Illinois Environmental Protection Agency
proposed the amendments, docketed by the Board as R97-
31, requesting that the Board amend its ozone air quality
control regulations in response to the issuance by the
United States Environmental Protection Agency of a
Control Technique Guideline governing wood furniture
coating operations. The principal proposed amendments
consist of changes in the values and units of measurements
for volatile organic material content of top coats and
sealers and the establishment of new work practice
standards. Most of the Board’s existing regulations
governing wood furniture coating operations would not be
affected by the adoption of this proposal. The proposed
effective date of the amendments is March 15, 1998.
Hearings were held in Edwardsville on August 5, 1997,
and in Chicago on August 13, 1997.

otice of Availability of Emergency Planning and
Right-to-Know Guidance Documents
On December 1, 1997, the United States Environ-
mental Protection Agency (USEPA) issued a notice of
availability of several documents to assist industries to
understand their compliance requirements in association
with Section 313 of the Emergency Planning and Com-
munity Right-to-Know Act of 1986 (EPCRA). 62 Fed.
Reg. 63548 (December 1, 1997). One of the documents
being made available is a revision to the EPCRA Section
313 “Questions and Answers” document, that provides
guidance to commonly asked interpretive questions. In
addition, several industry-specific guidance documents
have been developed for facilities in industry groups
recently added to the list of industries covered under
EPCRA Section 313. These documents are intended to
assist these recently added industries to understand
requirements under EPCRA Section 313 and more easily
determine if their facility is likely to have any reporting
responsibilities. The industry-specific guidance docu-
ments for the recently added industry groups are intended
for use for activities beginning on January 1, 1998, with
reports due on or before July 1, 1999.

Approves Revisions to the Illinois Ozone State
Implementation Plan for Reducing Volatile
Organic Material
On December 18, 1997, the United States Environ-
mental Protection Agency (USEPA) issued a final rule
approving revisions to the Illinois ozone State Implemen-
tation Plan (SIP) effective January 20, 1998. These SIP
revisions encompass Rate of Progress (ROP) plans for
reducing volatile organic material (VOM) emissions in the
Chicago ozone nonattainment area (Cook, DuPage, Kane,
Lake, McHenry, and Will Counties, Oswego Township in
Kendall County, and Aux Sable and Goose Lake Town-
ships in Grundy County) and in the Metro-East St. Louis
ozone nonattainment area (Madison, Monroe, and St.
Clair Counties) by 15% by November 15, 1996, relative
to 1990 baseline emissions; contingency plans for the
same ozone nonattainment areas for the purpose of
achieving additional 3% VOM emission reductions
beyond the 15% ROP plans; and transportation control
measures (TCM) for the Metro-East St. Louis area. 62
Fed. Reg. 66279 (December 18, 1997).
Previously, on July 14, 1997, USEPA issued a direct
final rule approval of these SIP revisions. On the same
day, USEPA proposed approval and solicited public
comment on the SIP revisions. This proposed rule
established a 30-day comment period noting that if
adverse comments were received regarding the direct final
rule USEPA would withdraw the direct final rule and
publish an additional final rule to address the public
comments. Adverse comments were received during the
public comment period, and USEPA withdrew the direct
final rule on September 3, 1997. 62 Fed. Reg. 46446
(September 3, 1997). This final rule addresses these
comments and finalizes the approval of the Chicago and
Metro-East St. Louis Area 15% and contingency plans,
and the Metro-East St. Louis area TCMs.

Approves Illinois State Implementation Plan for
General Conformity Rules
On December 23, 1997, the United States Environ-
mental Protection Agency (USEPA) approved an Illinois
State Implementation Plan (SIP) submitted by Illinois on
April 25, 1997, for the “general conformity” rules. See 62
Fed. Reg. 67000 (December 23, 1997). The general
conformity SIP revision enables Illinois to implement the
federal general conformity requirements in the nonattain-
ment and maintenance areas at the State level. General
conformity assures that federal actions conform to the
State plan to attain and maintain the public health-based
air quality standards. In this action, USEPA approved the
Illinois general conformity rules through a direct final
rulemaking. Consequently, this action is effective
February 23, 1998.

Withdraws Direct Final Rule for Ambient Air
Quality Surveillance for Lead
On December 23, 1997, the United States Environ-
mental Protection Agency (USEPA) withdrew the direct
final rule for ambient air quality surveillance for lead as
adverse comments were received by December 5, 1997.

address the comments received in a subsequent final
action in the near future. USEPA will not institute a
second-comment period in this rulemaking. The direct

In order to comply with 35 Illinois Administrative Code Section 306.401, Illinois Pollution Control Board
Regulations, the Illinois EPA has prepared the following list of facilities which are on Restricted
Status. Restricted Status is defined as the Agency determination that a sewer or lift station has

Restricted Status List -- Public Water Supplies
January 1998
The Restricted Status List was developed to give additional notification to officials of public water
supplies which are in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or
the Illinois Environmental Protection Act.
The Restricted Status List will include all Public Water Supplies for which the Agency has information
indicating a violation of any of the following requirements: Finished water quality requirements of 35
Ill. Adm. Code, Part 604, Subparts B and C; maintenance of adequate pressure on all parts of the distri-
bution system under all conditions of demand; meeting raw water quantity requirements of 35 Ill. Adm.
Code 604.502; or maintenance of treatment facilities capable of providing water "assuredly adequate in
quantity" as required by Section 18 of the Illinois Environmental Protection Act.
A public water supply on the Restricted Status List will not be issued permits for water main extensions,
except for certain limited situations, or unless the supply has been granted a variance from the Illinois
Pollution Control Board for the violation, or from permit issuance requirements of Section 39 of the Act.
This list is continually being revised as new information becomes available, and therefore, specific
inquiries as to the status of any public water supply should be directed to the Division of Public Water
Supplies for final determination. This list reflects the status as of January 1, 1998.

Critical Review List -- Public Water Supplies
The Critical Review List was developed to give additional notification to officials of public water
supplies which may be close to being in violation of 35 Ill. Adm. Code, Subtitle F: Public Water
Supplies, Chapter I or the Illinois Environmental Protection Act.
A supply will be placed on the Critical Review List when Agency records indicate that it is approaching
any of the violations which would place it on the Restricted Status List.
This list is continually being revised as new information becomes available, and therefore, specific
inquiries as to the status of any public water supply should be directed to the Division of Public Water
Supplies for final determination. This list reflects the status as of January 1, 1998.
