CLEANUP AMEND-
MENTS PROPOSED FOR
SECOND NOTICE, R96-2
The Board proposed Part I
cleanup amendments to the 15%
reduction of pollution (ROP) plan
regulations for Second Notice re-
view for Second Notice review by
the Joint Committee on Adminis-
trative Rules (JCAR) on December
7, 1995. The amendments would
change the 15% ROP plan to revise
the annual deadline for compliance
with the 7.2 pounds per square
inch (psi) Reid vapor pressure
(RVP) requirement for certain
gasoline suppliers from May 1 to
June 1. The Board adopted the 7.2
psi RVP requirements as a portion
of the Part I 15% ROP rules on
September 15, 1994.

would make an emergency rule
that delayed the annual effective
date, of February 23, 1995, in R95-
10, into a permanent rule. The

The Board initially accepted and proposed the Part I
15% ROP cleanup proposal pursuant to the "fast-track"
rulemaking provisions of Section 28.5 of the Environ-
mental Protection Act (Act) on September 7, 1995.
However, after closer scrutiny of the proposal, on Sep-
tember 21, 1995, the Board corrected this and accepted
and proposed the amendments as a Section 27 general
rulemaking.

A First Notice
Notice of Proposed Amendments appeared in the October
31, 1995 issue of the
Illinois Register
. The Second No-
tice review period began on December 12, when JCAR
received the Second Notice package, and it will end when
JCAR submits its Certificate of No Objection or after 45
days, whichever comes first. After the Second Notice
period expires, the Board will be free to adopt the
amendments. The Board held two hearings on the Part I
cleanup proposal on October 25, 1995, in Springfield,
and October 26, 1995, in Edwardsville.
The Board adopted the 15% ROP regulations in seven
parts, as submitted by the Agency, between September
15, 1994 and May 4, 1995. The aggregate of the seven
parts are intended to reduce emissions of ozone-forming
volatile organic compounds in the Chicago and metro-
politan East St. Louis areas, as required by federal law.
The federal Clean Air Act Amendments of 1990 (CAAA)
require a reduction in ozone precursor emissions in areas
that are nonattainment for ozone.

ART II 15% ROP CLEANUP PROPOSAL
FILED, SET FOR HEARING, AND PRO-
POSED FOR FIRST NOTICE, R96-13
The Illinois EPA (Agency) filed its Part II 15
percent ROP cleanup proposal on December 13, 1995
pursuant to the "fast-track" procedure of Section 28.5 of
the Act. The Board accepted the proposal and proposed
the amendments without substantive review for First No-
tice publication in the
Illinois Register
on December 20,
1995. The Board has scheduled public hearings on the
proposal in February and March, as required by Section
28.5.
The Part II 15% ROP cleanup proposal would make
seven minor corrections to the 15% ROP Plan as sub-
mitted by the Agency and adopted by the Board between
September 15, 1994 and May 4, 1995 in seven parts.

The seven corrections are listed as follows:
1. Add language to Part 219 relating to "equivalent alter-
native control plans" that appears in Part 218;
2. Revise certain vapor pressure equations in Subpart A;
3. Clarify the record keeping and reporting requirements
for coating operations in Subpart F;
4. Correct a
Federal Register
citation and typographic
errors in Subpart Q;
5. Incorporate the legislative repeal of P.L. 89-79 of the
bakery oven rules;
6. Amend the exemption for polyethylene manufacturing
facilities in Subpart TT; and
7. Correct a typographic error in Appendix G.
The statute requires the Board to schedule three hear-
ing dates, each for a prescribed purpose. The first day of
hearing is reserved for presentations by the Agency and
questions of Agency witnesses. The second scheduled
day of hearing, if it occurs, is reserved for presentations
by affected entities and all other interested persons. The
third scheduled day of hearing, if it occurs, is reserved for
any Agency response and responses of other parties. The
hearings will be continued from day to day, as necessary,
until all business is completed. However, the second and
third hearing dates are subject to cancellation if the level
of public interest and participation so warrant. The pub-
lic hearings are scheduled to occur at the James R.
Thompson Center, 100 West Randolph Street, in Chicago
as follows:

The hearing officer has ordered the submission of pre-

OARD GRANTS EXPEDITED CONSIDERA-
TION OF HAZARDOUS WASTE AMEND-
MENTS, R95-20
On December 7, 1995, the Board granted expe-
dited consideration to certain federal hazardous waste
amendments in the latest RCRA Subtitle C update
docket, R95-20, which nominally includes federal
amendments during the period January 1 through June
30, 1995. The federal amendments for which the Board
granted expedited consideration were the November 13,
1995 stay of the Subpart CC organic material emissions
rules applicable to hazardous waste tanks, containers,
and surface impoundments. U.S. EPA delayed the effec-
tive date of those rules from December 6, 1995 to June 6,
1996. The Chemical Industry Council of Illinois (CICI)
filed a request for expedited consideration of the federal
stay on November 29, 1995. Although the November 13
federal stay was outside the six-month time-frame of
docket R95-20, the Board granted consideration in this
docket, stating as follows: "[T]he Board does not desire
to prolong the time between federal promulgation and
our adoption of corresponding identical-in-substance
amendments. This is especially true during a time when
Illinois regulations are temporarily more stringent on
their face than the corresponding federal rules."
The Board once before granted expedited considera-
tion of federal amendments in docket R95-20, on October
19, 1995.

On October 13,
1995, TDI Batteries, an Illinois manufacturer of nickel-
cadmium cells submitted a request for expedited Board
consideration of the federal universal waste rules, a seg-
ment of the amendments that occurred during the time-
frame of the docket. TDI stated that it wants to begin a
program for recycling or recovery of waste nickel-
cadmium batteries, and the current general RCRA Subti-
tle C standards stand as an impediment to such a pro-
gram. It was on this basis that the Board granted the
request for expedited consideration. At the same time,
the Board published a reason for delay in completing the
amendments because the present work-load did not allow
immediate attention to this docket.
During the R95-20 update period of the first half of
1995, U.S. EPA amended and corrected its RCRA Subti-
tle C regulations 13 times. The Board included the fed-
eral amendments of January 3 and May 19, 1995 in the
prior consolidated update docket R95-4/R95-6, on June 1
and 15, 1995. The January 3 federal amendments dealt
with corrections to the Phase II land disposal restrictions,
and the May 19 amendments dealt with postponement of
the effective date of the Subpart CC organic material
emissions requirements for tanks, containers, and surface
impoundments. The base subject matter of both sets of
amendments was the primary subject matter of the R95-
4/R95-6 docket. The other 11 first-half, 1995 federal
actions will be dealt with in docket R95-20. These 11
actions included the following: updated testing and
monitoring methods (January 13 and two April 4 ac-
tions); a response to the judicial decision in
City of Chi-
cago v. Environmental Defense Fund
, -- U.S. --, 114 S.
Ct. 1588, 128 L. Ed. 2d 302 (1994) (February 3); an ad-
ministrative determination that additional regulation will
be necessary for cement kiln dust (February 7); new haz-
ardous waste listings for six carbamate production wastes
(February 9, April 17, and May 12); the new universal
waste rules (May 11); the delisting of a hazardous waste
generated in Illinois by a Pennsylvania company (June
13); and the deletion of obsolete, redundant, and outdated
rules (June 29).
Of the amendments involved in the nominal R95-20
time-frame, the single most significant set is the new
"universal waste" rule. The universal waste rule estab-
lishes an alternative set of regulations for persons recy-
cling, recovering, or seeking alternative disposal of cer-
tain wastes from municipal solid waste streams. Under
the general RCRA Subtitle C regulations, certain wastes,
called "universal wastes" would become hazardous
wastes when removed from municipal solid waste and
accumulated for recycling, recovery, or alternative dis-
posal. U.S. EPA established the alternative universal
waste regulations to avoid this disincentive to the recy-
cling, recovery, and alternative disposal activities, which
essentially remove these environmentally deleterious
materials from waste bound for landfills. In this initial
installment of alternative universal waste regulations,
U.S. EPA included batteries, thermostats, and waste pes-
ticides. U.S. EPA stated that it will later establish more
universal waste management standards for other materi-
als, such as waste fluorescent light bulbs. By granting
expedited consideration of the further federal stay of the

The Board proposed amendments on De

20, 1995 to the Illinois special waste hauling regulations
for Second Notice review by the Joint Committee on A

ministrative Rules (JCAR). The amendments would r
e-
place the existing requirement for marking transport v
e-
hicles with a special waste hauler permit number with a
requirement that documentation indicating the permit
number accompany the vehicle.
A letter from the
American Trucking Association (ATA) prompted this
proceeding. The letter raised the issue of whether Se
c-
tion 809.401 of the special waste hauling regulations may
have been preempted by the federal law, as interpreted by
the U.S. Department of Transportation. The ATA su
g-
gested an amendment to Section 809.401 that was jointly
drafted with the Agency.
On March 16, 1995, the Board opened a docket to
consider amendment of the special waste hauler require-
ments of the land pollution control regulations and
authorized two hearings in the matter.

ITE-SPECIFIC CYANIDE RULE PROPOSED

On December 7, 1995, the Board proposed a
site-specific rule for Second Notice review by the Joint
Committee on Administrative Rules (JCAR) that would
regulate the maximum allowable cyanide content of the
Metropolitan Water Reclamation District of Greater Ch
i-
cago (MWRDGC) John E. Egan and James C. Kirie
treatment plant effluents. Associated proposed amen
d-
ments include changes to reflect the change in the Di
s-
trict's name to MWRDGC, which still appears in the
water pollution control regulations as the Metropolitan
Sanitary District of Greater Chicago. The proposed new
weak acid dissociable (WAD) cyanide standard of 10
micrograms per liter (
μ
g/l) would apply to both plants
instead of their respective existing permitted limitations
of 5.2 and 5.0
μ
g/l, which were based on the existing
state-wide general use water quality standards. The
MWRDGC posited four basic justifications for the site-
specific rule in its April 28, 1995 petition. It first a
s-
serted that the indigenous species used to calculate the
state-wide water quality standards are not relevant to the
streams receiving its effluents. MWRDGC stated second
that the use of WAD cyanide is not directly associated
with water toxicity. Third, the MWRDGC maintained
that chlorine interferes with the WAD cyanide test. F
i-
nally, MWRDGC contended that the present regulatory
limits are at or below the limit of detection for WAD
cyanide.

RETREATMENT UPDATE AMENDMENTS
PROPOSED, R95-22
On December 20, 1995, the Board proposed
update amendments to the wastewater pretreatment
regulations for public comment. The amendments, pro-
posed under docket R95-22, are based on revisions to the
federal regulations that occurred in the period January 1
through June 30, 1995. During this time, U.S. EPA un-
dertook two actions, on April 4 and June 29, 1995. The
April 4 federal amendments updated the analytical pro-
cedures of 40 CFR 136, which apply to Clean Water Act
programs. The Illi

nois wastewater pretreatment regulations incorporate 40
CFR 136 by reference. The June 29, 1995 federal
amendments were the deletion of obsolete, redundant,
and outdated rules by U.S. EPA. The Board based

EARING SCHEDULED ON TRIENNIAL
WATER QUALITY REVIEW, R94-1(B)
The Board has scheduled a public hearing on
the subdocket in the triennial water quality review pro-
ceeding relating to ammonia nitrogen, R94-1(B). The
hearing will occur as follows:

The hearing officer order scheduling the hearing re-
quired the filing of pre-filed testimony by January 26,
1996 and the filing of pre-filed questions by February 9,
1996. That order outlines 14 specific questions in four
informational categories that the Board wants addressed
at the hearing. The informational categories relate to the
current position of U.S. EPA on ammonia nitrogen, sister
states' standards, regulatory impact, and technical aspects
of the proposal.
The larger Illinois EPA (Agency) water quality pro-
posal, docketed by the Board as R94-1, proceeded from a
mandatory triennial review of the Illinois stream water
quality regulations required under the federal Clean Wa-
ter Act (33 U.S.C. §§ 1251
et seq.
). The Agency filed
the proposal on February 24, 1994, and the Board ac-
cepted it on March 17, 1994. The Board decided to pro-
ceed on the proposal as a Section 28.2 federally required
rule on May 5, 1994. The larger proposal would amend
Parts 302 and 304 of the Water Pollution Control regula-
tions to revise the standards for ammonia nitrogen, mer-
cury, and lead general water quality standards; secondary
contact and indigenous aquatic life standards; and other
regulations.
The Board proposed amendments based on the R94-1
proposal for First Notice publication in the
Illinois Reg-
ister
on September 15, 1994, and Notices of Proposed
Amendments appeared in the
Register
on September 30,
1994. The Board held a pre-hearing conference on the
proposal in Chicago on November 8, 1995. As observed
in the hearing officer order scheduling the pre-hearing
conference, those Notices have since expired, and the
Board will have to consider the proposal again for First
Notice publication. The Board has already conducted
three public hearings on the proposal, on November 10,
1994 and January 26, 1995, in Chicago, and on Novem-
ber 22, 1994, in Springfield.

MAKING FOR FAILURE TO FILE AN
AMENDED PETITION, R94-29
On December 20, 1995, the Board dismissed a
site-specific rulemaking petition filed on behalf of the
Indian Refining Limited Partnership. Indian Refining
filed the petition, relating to the opacity and rate of emis-
sions from the fluidized catalytic cracking unit at this
Lawrence County facility, on October 6, 1994, and the
Board issued an order on October 20, 1994 directing In-
dian Refining to cure certain defects in the petition
within 45 days. The Board dismissed the petition be-
cause Indian Refining had failed to submit the required
documents in response to the Board order.

General Assembly had failed to provide an alternative
mechanism for funding site cleanups. P.A. 89-443
P.A. 89-443 gives the Board 18 months after its effec-
tive date--i.e., until January 1, 1998--to adopt proportion-
ate share liability regulations. Although the bill requires
the Board to consider the recommendations of the Illinois
EPA and the Site Remediation Advisory Committee, it
does not require the submission of a rulemaking proposal
from outside the Board.

and Community Affairs (DCCA) recently expanded a
joint statewide voluntary amnesty program to help certain
small businesses achieve environmental compliance. The
Agency and DCCA conceived the program as a way to
assist Illinois small businesses, which may otherwise lack
the means to obtain technical assistance in achieving
environmental compliance. Under the program, entitled
"Clean Break", a participant can use Agency technical
assistance to correct present vio
lations and explore co
m-
pliance and pollution prevention alterna
tives, including
waste minimization options. The program applies to e
n-
vironmental compliance under all media: air, water, and
land.
The small businesses to which the program applies--
i.e., presently those in the printing and automobile
maintenance business sector employing 200 or fewer per-
sons--can contact the Agency or DCCA to discuss their
environmental compliance problems and explore compli-
ance alternatives. If desired, the business can make the
contact with the Agency and negotiate a compliance
agreement anonymously. Persons uneasy with contacting
the Agency directly may contact DCCA, who will not
disclose the identity of the caller.
The program, as presently implemented, includes four
basic steps:
Step 1
: Initial contact, by the business calling either the
Agency or DCCA;
Step 2
: Either a preliminary assessment meeting with
Agency personnel or a compliance assessment visit to
the facility by Agency personnel;
Step 3
: Development of an amnesty/compliance agree-
ment, wherein the business agrees to follow certain
steps to achieve compliance and the Agency agrees to
not refer the business to the Illinois Attorney General,
the State's Attorney, or U.S. EPA for enforcement; and
Step 4
: The business works with the continued assis-
tance of the Agency under the agreement to achieve
compliance.

The Clean Break program was a pilot study in the
Rockford area in April through July, 1995. The Agency
and DCCA have now modified and expanded program
state-wide based on the success of the pilot program. The
Agency stated that as the program develops, it will fur-
ther modify it and expand it in 1996 to include additional
business sectors.
A recent article that appeared in
Environmental Com-
pliance
publicized the Clean Break program, listing the
Board as the source of further information. The Board is
not involved in Clean Break. Rather, interested persons
should contact either of the following for more informa-

sions on the program, and have invited interested persons
to contact them at either of the above numbers for further

SECOND DISTRICT HOLDS THAT UST RE-
MOVED IN 1982 WAS NOT REGISTERABLE
IN 1986
In an unpublished order pursuant to Supreme
Court Rule 23, the First District held that an under-
ground storage tank removed in 1982 was not regis-
terable in 1986. In
City of Wheaton v. PCB
(1st
Dist. Dec. 8, 1995), No. 2-95-0338, the court held
that the appellant could not register the tank because
no part of it was beneath the surface of the ground
when it attempted to register it.
The appellant owned and operated two under-
ground storage tanks at its police headquarters. It
removed its tank number 1, a 2,000-gasoline storage
tank, from the ground in 1982. Tank number 2, a
3,000-gallon diesel fuel tank, remained in the ground.
In 1986, the appellant registered a single 2,000-
gallon gasoline storage tank with the Office of the
State Fire Marshal (OSFM). In 1991, in the course
of seeking a permit to remove tank number 2, the ap-
pellant amended its registration to indicate that its
tank was a 1,000-gallon diesel fuel tank. It further
indicated that tank number 1 had been removed from
the ground in 1982. It later corrected the declared
volume of tank number 2. In the course of removing
tank number 2, soil contamination was found, and the
appellant engaged remedial action.
The appellant sought reimbursement from the Un-
derground Storage Tank Fund. On November 22,
1993, the OSFM disallowed registration of tank
number 1 because it was removed from the ground
prior to 1987. The OSFM letter indicated that the
appellant had 10 days to challenge that determination,
but the appellant did not do so. On December 6,
1993, the OSFM disallowed reimbursement of cor-
rective action costs as to tank number 1 because it
was unregistered and, thus, ineligible for reimburse-
ment. The OSFM imposed a $100,000 deductible as
to tank number 2.
The appellant appealed the OSFM decision to the
Board. The appellant argued that a $15,000 deducti-
ble should apply. It asserted that it had attempted in
good faith to comply with the regulations; it had in-
tended to register tank number 2 in 1986 but erred in
indicating tank number 1. Alternatively, the appel-
lant argued that the registration of tank number 1 was
valid. In
City of Wheaton v. OSFM
(Dec. 1, 1994),
PCB 94-18, the Board granted summary judgment in
favor of the OSFM. Noting that the appellant had
not challenged the November 22, 1993 order in which
the OSFM had determined that tank number 1 was
not registerable, the Board held that the $100,000
deductible applied because there was not registered
tank on the site. The Board denied reconsideration,
and the appellant appealed the Board's decision.
The First District stated that under the plain lan-
guage of Section 57.9(b) of the Act, a $100,000 de-
ductible applies where the tank owner or operator did
not register its tanks prior to 1989, and a $15,000
deductible applies where the owner or operator had
registered at least one but fewer than all of its tanks
prior to that date. The appellant argued that lan-
guage added in 1992 to Section 4(b)(1)(A) of the
Gasoline Storage Act
(420 ILCS 15/4(b)(1)(A))
,
which prohibits the registration of tanks removed
from the ground prior to 1987 could not be applied to
block registration of its tank number 1. It argued that
this would constitute retroactive application of the
statute. Relying on
OK Trucking v. Armstead
(1st
Dist. 1995), 274 Ill. App. 3d 376, 653 N.E.2d 863,
in which a tank owner had removed tanks in 1986
and sought registration in 1992, the court held that
tank number 1 was not registerable because it had
been removed from the ground before the appellant
sought to register it. The First district held that the

OSFM therefore had the authority to revoke the reg-
istration of tank number 1, and the appellant had not
properly registered either of its tanks. The First Dis-
trict affirmed the Board's grant of summary judge-
ment in favor of the OSFM.

Restricted Status List -- Public Water Supplies
The Restricted Status List was developed to give additional notification to officials of public water supplies which are in
violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental Protection Act.
The Restricted Status List will include all Public Water Supplies for which the Agency has information indicating a viola-
tion of any of the following requirements: Finished water quality requirements of 35 Ill. Adm. Code, Part 604, Subparts B
and C; maintenance of adequate pressure on all parts of the distribution system under all conditions of demand; meeting raw
water quantity requirements of 35 Ill. Adm. Code 604.502; or maintenance of treatment facilities capable of providing water
"assuredly adequate in quantity" as required by Section 18 of the Illinois Environmental Protection Act.
A public water supply on the Restricted Status List will not be issued permits for water main extensions, except for cer-
tain limited situations, or unless the supply has been granted a variance from the Illinois Pollution Control Board for the
violation, or from permit issuance requirements of Section 39 of the Act.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the
status of any public water supply should be directed to the Division of Public Water Supplies for final determination.
This list reflects the status as of January 1, 1996.

Critical Review List -- Public Water Supplies
The Critical Review List was developed to give additional notification to officials of public water supplies which may be
close to being in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environ-
mental Protection Act.
A supply will be placed on the Critical Review List when Agency records indicate that it is approaching any of the viola-
tions which would place it on the Restricted Status List.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the
status of any public water supply should be directed to the Division of Public Water Supplies for final determination.
This list reflects the status as of January 1, 1996.

Indicates actions are being taken by officials to bring the public water supply into compliance.
