GOVERNOR EDGAR SIGNS AMENDMENTS TO OMNIBUS BILL,
INCLUDING AMENDMENTS TO LOCAL SITING APPROVAL PROVISIONS, P.A.

On December 22, 1994, Governor Jim Edgar signed P.A. 88-681 (formerly H.B. 1594) into law. The amendments included
a set of amendments to the Environmental Protection Act (Act) and various other statutes. These removed the words
"regional" and "nonregional" from all references to the statutorily-defined "regional pollution control facility". The revised
usage is simply "pollution control facility". The primary substantive impact of these amendments is that all pollution control
facilities will be subject to local siting approval under Section 39.2 of the Act, without regard to whether or not their intended
service area is purely local. The pertinent protions of this omnibus bill became effective upon signature.
BOARD TO CONDUCT INQUIRY HEARINGS ON THE
LOCATION OF WASTE MANAGEMENT FACILITIES IN 100-YEAR FLOODPLAINS
The Illinois Environmental Protection Agency recently filed a motion in docket R94-34, requesting that the
Board conduct inquiry hearings on the location of hazardous and non-hazardous waste managment facilities in 100-year
floodplains in Illinois. The Board has accepted the motion and has committed to holding at least one public hearing on
the petition.

BOARD TO SCHEDULE WEEKLY SPECIAL BOARD MEETINGS ON TRIAL BASIS
Beginning January 19 and through March 30, the Board will hold weekly "process" meetings on a trial basis.
These meetings are intended to be limited so that the Board may expeditiously address routine matters, for instance, the
scheduling of hearings in new cases brought before it, adoption of provisional variances, and acceptance of stipulated
settlements. The Board still intends to reserve disposition of its non-routine, final decisions and motions for the meetings
already scheduled on the third Thursday of the month,
i.e.
, January 12, February 16 and March 16, l995. The newly
scheduled Board meetings are set for January 26; February 2, 9, and 23; and March 2, 9, 23, and 30, l995.

MAKING UPDATE
VEHICLE INSPECTION AND MAINTENANCE AMENDMENTS
ADOPTED, R94-19 & R94-20
On December 1, 1994, the Board adopted amendments to the
Illinois vehicle inspection and maintenance regulations under two
different docket numbers R94-19 and R94-20. The amendments
are intended to help implement an enhanced vehicle inspection and
maintenance (I/M) program in certain areas in Illinois. The
amendments establish the federal dynamic-load "IM 240" engine
exhaust emissions test for 1991 and later light duty vehicles and
light duty trucks. The existing static "idle" test would remain the test
used for older vehicles and for those newer vehicles for which the
"IM 240" test is unsuitable.
Section 182(b) and (c) of the CAA, as amended in 1990, requires
the use of "inspection and maintenance" (I/M) programs in areas not
meeting the national ambient air quality standards (NAAQS) for
ozone and/or carbon monoxide. The CAA specifies the use of
"basic" I/M programs in "moderate" nonattainment areas and
"marginal" nonattainment areas with existing I/M programs. It
requires the use of "enhanced" I/M programs in "serious", "severe",
and "extreme" ozone nonattainment areas with urbanized
populations of 200,000 or more. In Illinois, the Chicago and Metro-
East St. Louis (Metro-East) areas are classified as "severe" and
"moderate" nonattainment for ozone, respectively, and as such are
subject to the I/M requirement.
The General Assembly enacted the Vehicle Emissions Inspection
Law of 1995 (VEIL; 625 ILCS 5/13B) effective January 18, 1994.
(P.A. 88-533.) That statute provides authority for the Agency to
implement an enhanced I/M program and meet the United States
Environmental Protection Agency's (U.S. EPA's) requirements for
such a program. P.A. 88-533 mandates enhanced I/M testing for
the Metro-East area and certain portions of the Chicago
nonattainment area. Section 13B-20 mandates that the Agency
propose and the Board adopt implementing regulations using
identical-in-substance procedures.
On July 20, 1994, the Illinois Environmental Protection Agency
(Agency) filed two proposals for Clean Air Act (CAA) rulemaking to
implement the Vehicle Inspection Law. The first, docketed as R94-
19 and dealing with vehicle tailpipe emissions testing, was based on
federal guidelines; it proceeded under the "fast-track" rulemaking
provisions of Section 28.5 of the Environmental Protection Act (Act)
and Section 13B-20 of VEIL. The second petition, docketed as
R94-20 and dealing with fuel system evaporative emissions, was
based directly on federal regulations; it proceeded under the
identical-in-substance provisions of Section 28.4 of the Act and
Section 13B-20 of VEIL.
The Board proposed amendments in both dockets for First Notice
publication in the
Illinois Register
on July 21, 1994 and conducted a
public hearing in Chicago on September 8, 1994. Later scheduled
hearings in R94-19 were cancelled on request of the Agency
because the Board had not received an objection to the
amendments from U.S. EPA or a request to hold the hearings
pursuant to Section 28.5 of the Environmental Protection Act.
On October 20, 1994, the Board proposed the R94-19 "fast-track"
amendments for Second Notice review by the Joint Committee on
Administrative Rules (JCAR). The Board lacked any discretion
under law to adjust the statutory time-frames under any
circumstances. Section 28.5(o) required the Board to propose the
Amendments for Second Notice review by JCAR within 130 days
after receiving the proposal, by November 27, 1994.
At its meeting of November 15, JCAR voted an objection to the
proposed rules. JCAR stated in the objection:
At its meeting on November 15, 1994, the Joint Committee on
Administrative Rules objected to the above cited rulemaking
because the stringent standards will cause economic hardship
on the affected public and because [the Board]'s action to
adopt these standards is premature. The federal Vehicle
Emissions Standards program may be altered before its
anticipated full implementation in late 1995.
The identical-in-substance procedure did not require that the Board
similarly submit the companion rulemaking, R94-20, for JCAR
review.
In adopting the R94-19 amendments, in the December 1, 1994
opinion and order, the Board responded to the JCAR objection. The
Board cited three reasons for its refusal to modify the amendments
in response to the JCAR objection. First, the Board cited the
legislative mandates that required it to adopt the amendments within
short time frames. Second, the Board noted that it is the
implementation of the legislation, and not the amendments that
affects the costs of compliance with the enhanced vehicle I/M
program. Finally, the Board noted that there was no federal action
to limit the scope of the mandate that would justify deviation from
the IM 240 test.
R94-20 was filed with the Secretary of State and became
effective on December 12, 1994. R94-19 was filed and became

BOARD ACCEPTS MOTION FOR INQUIRY HEARINGS ON
LOCATION OF SOLID WASTE MANAGEMENT FACILITIES IN
100-YEAR FLOODPLAINS, R94-34
On December 14, 1994, the Board granted a December 2 motion
of the Illinois Environmental Protection Agency (Agency) that the
Board conduct inquiry hearings relating to the location of solid waste
management facilities in 100-year floodplains. The Board has
assigned the matter to a hearing officer to hold at least one hearing
as requested by the Agency.
According to the motion, hazardous and non-hazardous waste
landfills, incinerators, surface impoundments, treatment plants,
transfer stations, and other facilities are permissibly located in 100-
year floodplains in Illinois. The However, 7,400 square miles, or 14
percent, of the land area in Illinois is subject to flooding, with
250,000 buildings located in floodplains. The Agency also said that
floods account for 90 percent of declared disasters in Illinois.

According to the Illinois Department of Transportation's "Floodplain
Management: Local Floodplain Administrator's Manual", a higher
risk of damage to facilities and environmental contamination occurs
when the facility is located in the floodway portion of the floodplain,
as opposed to when it is located in the flood fringe. The floodway is
that portion of the channel and overbank areas that carries the bulk
of the flood waters during a flood, and this is the area where water
flow velocities and forces are greatest and most destructive.
The Board has been asked to conduct hearings to address three
points: whether the location of facilities in floodplains warrants
regulation or prohibition; whether the entire floodplain or just the
floodway needs regulation; and whether the 500-year floodplain
needs regulation or just the 100-year floodplain. Finally, the Agency
has asked the Board to consider whether any regulation or
prohibition of facility location should apply to existing facilities as well

BOARD RESCHEDULES LUST HEARINGS, R94-2(B)
The Board has rescheduled hearings previously scheduled for
the petroleum leaking storage tank (LUST) rulemaking, R94-2(B).
The hearings, originally scheduled to occur in Chicago and
Springfield in January and February, are presently scheduled as
follows:

The hearing officer order rescheduling the hearings sets forth a
deadline of February 9, 1995 for interested persons to file a
regulatory proposal to address issues outstanding from the parent
proceeding, now designated as R94-2(A). The Board severed the
docket simultaneous to proposing the parent rules for Second
Notice on August 11, 1994. That was done in response to the
requests of several participants and a formal motion by IERG. The
separate sub-docket B is intended to consider generic clean-up
objectives and alternative methodologies for determining objectives.

The hearing officer order also imposes deadlines of February 24
and March 10, 1955 as deadlines for submission of pre-filed
testimony and exhibits for each respective hearing. It further states
that the hearings of March 28 and April 26 are subject to
cancellation if business is completed on the day preceding each.

THIRD HEARING SET FOR WATER QUALITY AMENDMENTS,
R94-1
The Board has set a third day of public hearings in the docket,
R94-1, relating to amendments to the Illinois water quality
regulations. The third day of hearing is scheduled as follows:

The hearing officer scheduling the third hearing provided for the
pre-submission of testimony, exhibits, questions, and responses. It
set forth a deadline of January 13, 1995 for pre-submission of
testimony and exhibits, and January 20, 1995 for pre-submission of
questions and responses based on the pre-filed testimony.
The Illinois EPA (Agency) proposal proceeded from a mandatory
review of the Illinois stream water quality regulations required under
the federal Clean Water Act (33 U.S.C. ยงยง 1251
et seq.
). The
proposal would amend Parts 302 and 304 of the Water Pollution
Control regulations to revise the standards for ammonia nitrogen,
mercury, and lead general water quality standards; secondary
contact and indigenous aquatic life standards; and other
regulations. The Agency filed the proposal February 24, 1994. The
Board accepted the proposal on March 17, 1994 and decided to
proceed on the proposal as a federally required rule on May 5,
1994. (

Section 28.2 of the Act allows the Agency to certify that certain
regulatory amendments are federally required rules. It allows the
Board 45 days to either accept or reject the Agency's certification.
Pursuant to the Board's order of May 5 construing Section 28.2, the
Board was to have proposed a First Notice rule for publication in the
Illinois Register
within six months,
i.e.
, by November 5, 1994.
The Board proposed amendments based on the Agency's
proposal for First Notice publication in the

September 15, 1994, which appeared on September 30, 1994. The
Board subsequently scheduled two public hearings on the proposal,
which occurred on November 10 and 22, 1994, in Springfield and
Chicago.

The First Notice period technically ended on November 14, 1994,
but the Board has delayed proceeding to propose the amendments
for Second Notice review by the joint Committee on Administrative

BOARD ACCEPTS PETITION FOR SITE-SPECIFIC LANDFILL
FINANCIAL ASSURANCE REGULATION FROM
COMMONWEALTH EDISON, R94-30
On December 1, 1994, the Board accepted a petition filed
October 17 by Commonwealth Edison Company (Com-Ed) for
hearing. The petition seeks a declaration that the Commonwealth
Edison Joliet/Lincoln Quarry facility, in Will County, is a surface
impoundment, and not a landfill subject to the land pollution control
(landfill) regulations. In the alternative, Com-Ed seeks site-specific
regulations relating to leachate management, groundwater
monitoring, and final cover requirements at this facility.
Com-Ed has placed over 11,000 tons of bottom ash and slag

from two coal-fired generating stations each year in the facility, and
has held a landfill permit for the facility for several years. Under the
landfill amendments of 1990, Com-Ed notified the Agency that it
intended to close the facility by September 18, 1997 (within seven
years of the effective date of the amendments). Com-Ed has since
reconsidered this decision due to the remaining capacity of the
facility. Com-Ed seeks the declaration that the facility is a surface
impoundment to avoid compliance with the 1990 landfill
amendments. Com-Ed conceded in its petition that the facility
cannot meet those standards. Direct questions to Kevin

FOURTH DISTRICT DETERMINES THAT BOARD REMAND
WAS APPROPRIATE, REMANDS DECISION TO BOARD FOR
REMAND TO LOCAL SITING AUTHORITY
In a decision dated December 14, 1994, in
Illinois Landfills, Inc. v.
PCB
, No. 4-94-41, the Fourth district held that the Board should
have remanded the decision to the City of Hoopeston for further
elaboration of its decision. The court denied a motion for rehearing
on January 11, 1995. The court remanded the matter to the Board
for remand to the City.
Illinois Landfills filed an application with the City of Hoopeston for
siting approval, pursuant to Section 39.2 of the Environmental
Protection Act (Act), for expansion of an existing pollution control
facility (landfill). The City held public hearings and granted siting
approval on April 27, 1993. A number of third party challengers
appealed the decision to the Board on numerous grounds. In a
decision dated September 23, 1993, in
Slates v. City of Hoopeston
,
PCB 93-106, the Board reversed the City's decision. The Board
found that the City had properly considered the required factors of
Section 39.2(a) of the Act, but that the finding on the need criterion
(criterion 1) was improper. The applicant's stated intended service
area for the facility included 31 counties. The City's approval had
stated that the facility was "necessary to accommodate the waste
needs of the City of Hoopeston and the Vermilion County area."
Since the finding did not extend to the entire intended service area,
the Board held that the approval was defective and reversed the
City's siting approval. In the September 23 opinion and order and in
denying reconsideration on December 16, 1993, the Board
specifically held that remand was not appropriate in this case.
On appeal, the Fourth District held that the Board should have
remanded the matter to the City for correction of its criterion 1
determination to consider the entire intended service area. The
court observed that it must review Board decisions under the same
standard as the Board in reviewing local siting approval
determinations: the manifest weight of the evidence standard. The
court found that it could not review a Board decision on criterion 1
because the City did not render its determination on the proper
basis, which would have been the entire intended service area.
Under such circumstances, and where the City rendered its
determination in good faith, the court felt that remand for a decision
based on the proper consideration was the appropriate course.

BOARD HOLDS THAT LANDSCAPE WASTE IS
WASTE, INVALIDATES OPEN BURNING PERMIT
BECAUSE LOCAL SITING APPROVAL WAS NOT
OBTAINED
The Board recently invalidated an Agency-granted open
burning permit because the applicant had not obtained local
siting approval before applying to the Agency for a permit.
In
American Tree Service v. PCB
(Dec. 14, 1994), no. PCB
94-43, the Agency had granted the applicant an open
burning permit, with conditions. The applicant challenged
one of the conditions, which would have limited the appli-
cant's burning to landscape waste generated by the appli-
cant's employees' landscaping activities.
The applicant appealed the condition to the Board,
essentially arguing that landscape waste is not "waste", as
defined by Section 3.53 of the Act, so no restriction on the
sources of the waste was necessary. The Agency argued
that the restriction of the condition was necessary because
otherwise the applicant's facility would be a "regional
pollution control facility", as defined by Section 3.20 of the
Act, and the applicant had not obtained local siting approval
of its facility pursuant to Section 39.2 of the Act.
The Board examined the parties' arguments and the Act
and determined that landscape waste is "waste", so local
siting approval was required. Whereas the Agency
attempted in the challenged condition to limit the wastes to
those generated by the applicant's employees' activities, the
Board concluded that the exception from the requirement for
local citing authority was limited to wastes generated at the
cite where they were disposed of. The Board held that since
the applicant's activities were not restricted to landscape
waste generated at its own site, local siting approval was
required before the permit issued. The Board invalidated
the permit because the applicant had not first obtained such
approval.
BOARD DETERMINES THAT A PROPOSED WASTE

and order followed the interim opinion and order issued
October 6, 1994 and determined that a proposed wood-to-
energy facility would be a solid waste management facility.
Thus, the proposed facility would be subject to the permit
requirements of Section 21(d) of the Environmental
Protection Act. Although the Board found that the issue of
adjusted standard relief was still relevant, it dismissed the
petition because Illinois Wood Energy Partners had not filed
an amended petition to cure the deficiencies noted in the
October 6, 1994 Board order.

Restricted Status List -- Public Water Supplies
The Restricted Status List was developed to give additional notification to officials of public water
supplies which are in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the
Illinois Environmental Protection Act.
The Restricted Status List will include all Public Water Supplies for which the Agency has information
indicating a violation of any of the following requirements: Finished water quality requirements of 35
Ill. Adm. Code, Part 604, Subparts B and C; maintenance of adequate pressure on all parts of the
distribution system under all conditions of demand; meeting raw water quantity requirements of 35 Ill. Adm.
Code 604.502; or maintenance of treatment facilities capable of providing water "assuredly adequate in
quantity" as required by Section 18 of the Illinois Environmental Protection Act.
A public water supply on the Restricted Status List will not be issued permits for water main extensions,
except for certain limited situations, or unless the supply has been granted a variance from the Illinois
Pollution Control Board for the violation, or from permit issuance requirements of Section 39 of the Act.
This list is continually being revised as new information becomes available, and therefore, specific
inquiries as to the status of any public water supply should be directed to the Division of Public Water
Supplies for final determination. This list reflects the status as of January 1, 1995.

Critical Review List -- Public Water Supplies
The Critical Review List was developed to give additional notification to officials of public water
supplies which may be close to being in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies,
Chapter I or the Illinois Environmental Protection Act.
A supply will be placed on the Critical Review List when Agency records indicate that it is approaching any
of the violations which would place it on the Restricted Status List.
