NEW LEGISLATIVE LIAISON JOINS THE BOARD STAFF
The Board proudly welcomes John A. Cross to the staff as our new legislative liaison. John comes to the Board with
over eight years of experience as a legislative analyst for the House of Representatives Research and Appropriations
Staff. He will be responsible for tracking environmental legislation and drafting proposed bills and legislative
amendments. As the legislative liaison, he will also be the Board's point person for constituent and Board member
inquiries. Most importantly, John will interface with the Board's sister environmental agencies, the various industry
associations, and public interest groups on legislative matters and in the context of advisory committees for proposed
rulemaking.

RULEMAKING UPDATE
CORRECTIONS TO THE NEW SOURCE REVIEW
RULES PROPOSED FOR FIRST NOTICE, R93-26
On October 7, 1993, the Board opened a docket to
amend the new source review rules, a segment of the
Illinois air pollution control permit regulations. The
proposed amendments would correct a typographical
error made in an earlier proceeding.
The Board adopted the new source review rules on
April 22, 1993, in docket R92-21. (

) The Agency filed a motion, on October 1,
1993, praying that the Board request a Certification of
Correction to the adopted rules from the Joint Committee
on Administrative Rules. The Agency stated that the
failure to properly underline and strikeout text in its
original proposal resulted in an error in Section
203.209(a)(4): emissions of particulate matter are
significant if they exceed 25 tons per year (tpy), rather

While with the House Staff, John garnered significant experience in the environmental issues facing Illinois. For the
last four years he staffed the House Energy and Environment committee, serving as the staff person for several major
environmental initiatives: HB 300, the comprehensive rewrite of Illinois' underground storage tank program and RCRA
Subtitle D amendments; Employee Commute Options; the 1992 Clean Air Act Permit Program; the 1990 hazardous
waste cleanup/chemical storage tax proposal; the Lake Calumet Airport proposal; and the Kerr-McGee West Chicago
Thorium Disposal Site bill. He also staffed the Transportation and Motor Vehicles Committee from 1985 to 1989 where
he worked on the 1987 and 1989 gas tax proposals, and all Regional Transit Authority matters.
John has completed graduate work in Public Administration at the University of Illinois, Champaign-Urbana and has a
B.S. in Political Science and Business Administration from Illinois College (1982). While in school, John also was a
research assistant with the Institute of Government and Public Affairs for the University of Illinois, and he served as a
Michael Curry Intern for the Illinois Department of Transportation.

Chief of Planning of the St. Louis District Army Corps of Engineers; and Michael Platt, Executive Director Heartland
Water Resources Council. The panelists gave brief speeches on their experience coordinating the flood relief efforts for
our state and fielded questions from the audience. Some of the issues covered were whether there is need to rebuild the
levees along the Mississippi River, in the short term and the long term; the amount of rainfall versus the flow rates of the
Mississippi River; the Governor's proposed land credit program for exchanging federal set-aside land for flood plain farm
land; and the merits of allocating federal and state dollars to Illinois' outright purchasing of homes, businesses, and
farmland in the flood plains.
In the afternoon, the conference offered break-out sessions on a variety of topics. One was entitled "Conservation
Congress & Land and Water Task Force: What Action?" The panelists were Brent Manning, Director, Illinois
Department of Conservation; Rebecca Doyle, Director, Illinois Department of Agriculture; Mitch Beaver, Director,
Department of Energy and Natural Resources; and Don Vonnahme, Director, Division of Water Resources, Illinois
Department of Transportation. Other workshops were on environmental streetfighting, biodiversity in Illinois, and
pesticides in Illinois.
In addition to the IEC Conference, Board members and staff attended the Business and Professional Institute's (BPI's)
October 21st seminar at the College of DuPage entitled "Surviving Regulations: An Employer's Guide to OSHA and
EPA Compliance". Chairman Manning delivered the opening remarks. Board attorney Charles Feinen attended the
seminar.
On October 28, the Illinois Petroleum Marketer's Association (IPMA) and the Illinois Petroleum Council (IPC) co-
sponsored a program on implementation of Illinois' new underground storage tank legislation, P.A. 88-496 (
see issue
475, Oct. 6 1993
) by the Environmental Protection Agency and Office of State Fire Marshal. Chairman Manning gave
the welcoming remarks to over 700 people at the all-day event held in the Rosemont Convention Center. The seminar
was a unique opportunity for engineers, attorneys, and businesses in the petroleum industry to ask the Office of the State
Fire Marshall (OSFM) and the Illinois EPA (Agency) direct questions about how they intend to implement and administer
the comprehensive new provisions on corrective action at leaking UST sites and accessing the UST Fund. Speakers from
the Agency included Harry Chappel, Todd Rao, Angela Tin, John Steller, and Ken Page. From the OSFM, Office of
Chemical Safety, Jim McCaslin, his administrative assistant, Jim Boone, and various field staff spoke. In addition to
Chairman Manning's participation as a speaker, Board attorneys, Chuck Feinen and Musette Vogel, and technical staff
member, Anand Rao, also attended.
Two additional IPMA-IPC UST implementation seminars are planned for November. The first is scheduled for
November 4th, in Springfield, at Sangamon State University, and the second is scheduled for November 16th, in Mt.
Vernon. Chairman Manning has been invited to give the welcoming remarks at both of these seminars and will do so at
the Mt.Vernon date. Ms. Vogel will speak on her behalf in Springfield due to the Board's previously-scheduled

Board Members or staff will be speaking at other upcoming environmental seminars. The first is the Northern Illinois
University College of Law environmental workshop, entitled "Environmental Law in the 90s: A Practice Workshop", at

environmental insurance claims and coverage, and the new UST provisions of P.A. 88-496, the seminar features
technical overviews for the environmental practitioner on human toxicology and geology and hazardous substances.
Attorney-assistant to Board Member Flemal, Michelle Dresdow, will speak on rule-making, variances, adjusted

The second upcoming seminar is an Executive Enterprises environmental regulation course, at the KPMG Quality
Institute on 205 North Michigan in Chicago, on December 1st through the 3rd. Board Member Flemal will be one of the

regulatory scheme, in addition to overviews on the federal Clean Air Act Amendments (CAAA), the Clean Water Act
(CWA), the Resources Conservation and Recovery Act (RCRA), reporting under the Comprehensive Environmental
Recovery, Compensation and Liability Act (CERCLA), the Employee Protection and Community Right-to-Know Act
(EPCRA), the Toxic Substances Control Act (TSCA), UST liability, compliance audits, regulation of PCBs under TSCA,

error must be corrected as soon as possible, it did not
want to appear to make a substantive amendment using
the expedited correction process of Section 5-85 of the
Administrative Procedure Act. For this reason, the
Board chose to open a new docket under Section 28.2 of

SMALLER SOURCE REVIEW RULEMAKING
PROPOSED FOR SECOND NOTICE, R93-11
On October 7, 1993, the Board proposed for Second
Notice certain amendments to Parts 201 and 211 of the
air pollution control regulations. The proposed
amendments would extend the applicability of the air
rules to include smaller sources emitting as little as 25
tons per year of pollutants. The proposed amendments
would add new Subpart E to Part 201 and Section
211.5500 to Part 211 of the Illinois air pollution control
regulations.
The Agency filed the proposal on April 2, 1993. In
accepting the proposal by an order dated April 6, 1993,
the Board noted that it would not be able meet the March
31, 1993 statutory deadline for adoption of these
amendments. (

proposed these amendments for First Notice on July 22,
1993 (

FIRST NOTICE AMENDMENTS PROPOSED FOR
MARATHON OIL COMPANY SITE-SPECIFIC
RULE, R91-23
On October 7, 1993, the Board proposed site-specific
amendments to the water pollution control regulations for
First Notice. Those proposed amendments would change
the existing site-specific limitations on Marathon Oil
Company's discharges to an unnamed tributary to Sugar
Creek (in the Wabash River basin). The effluent
limitation for chlorides would increase from 700 mg/l to
1000 mg/l, and the stream water quality standard for
chlorides would increase from 550 mg/l to 750 mg/l.
The effluent limitation and the stream water quality
standard for total dissolved solids would remain
unchanged by the proposed amendments. Direct

PETITION TO AMEND GROUNDWATER
QUALITY STANDARDS RECEIVED, R93-27
The Agency filed a petition to amend the Illinois
groundwater quality standards on October 18, 1993. The
petition would amend Part 620 of the Illinois public water
supply regulations to add groundwater quality standards
for several contaminants and amend those for several
others, so that the Illinois groundwater quality standards
would incorporate those constituents from the federal
Safe Drinking Water Act regulations that are found in
Illinois drinking water. The Board held the petition at its
October 21, 1993 meeting before taking further action.

NEW PROCEEDING OPENED TO REPEAL STAGE
II VAPOR RECOVERY RULES FOR THE METRO-
EAST AREA, R93-28
The Agency filed a rulemaking petition on October 21,
1993 to repeal the Stage II gasoline vapor recovery
regulations that apply to the metropolitan East St. Louis
area. The proposal would repeal Section 219.586 of the
Illinois air pollution control regulations, which would
have required certain gasoline dispensing facilities
(service stations) in the Metro-East area (Madison,
Monroe, and St. Clair Counties) to install and operate
equipment for the recovery of gasoline vapors during fuel
dispensing starting May 1, 1993, others service stations
were to have complied by November 1, 1993. An
emergency rule adopted in R93-12, on May 20, 1993,
effective May 23, 1993, delayed the May 1 effective date
until October 15, 1993. (

THE BOARD WISHES MEMBER FORCADE WELL AS HE
ACCEPTS A POSITION IN THE PRIVATE SECTOR
Board Member Bill S. Forcade announced his resignation from
the Board effective November 1, 1993. Mr. Forcade has joined
the law firm of Jenner & Block as a partner in its Chicago office.
He will practice in the area of environmental law.
Mr. Forcade had been a Member of the Board since 1983.
Aside from authoring several important Board opinions, Mr.
Forcade contributed significantly to the Board. He furthered the
Board's interests by his frequent participation in environmental
seminars and conferences as a speaker and proponent. Bill
recently initiated an electronic bulletin board system (BBS) for
more rapid and widespread dissemination of information about
the Board. He was also recently instrumental in the assembly of
a set of public information leaflets on various aspects of Board
operations.
Prior to his appointment to the Board, Mr. Forcade was
General Counsel to Citizens for a Better Environment, a non-
profit public interest group concerned with environmental
matters. He was also Chairman of the Chicago Bar Association
Committee on Science, Technology and the Law and was a part-
time instructor at Northeastern Illinois University, teaching
courses on environmental impact statements and environmental
legislation and lobbying in the graduate school. Before his
appointment, Mr. Forcade worked as an attorney for the Board.
Mr. Forcade received his Bachelor of Science degree in
chemistry and biology from the University of Illinois at Chicago in
1971. He received his Juris Doctor from the John Marshall Law
School, also in Chicago, in 1976.
The Board and its staff will surely miss Member Bill Forcade.
The Board wishes him well in his new endeavors.

Water Pollution Control, is publishing copies of the Division's

of the Environmental Register. These lists reflect the status as
of September 30, 1993.
BOARD DENIES ILLINOIS POWER COMPANY AN
ADJUSTED STANDARD FROM CERTAIN WATER QUALITY
STANDARDS IN THE MIDDLE FORK OF THE VERMILION
RIVER
On October 7, 1993, in
In re Petition of Illinois Power Co.
(Vermilion Power Station) for an Adjusted Standard from 35 Ill.
Adm. Code 302.208(e)
, AS 92-7, the Board denied an adjusted
standard from the in-stream water quality standards for boron,
sulfates, and total dissolved solids. The Board held that the
petitioner had failed to present adequate proof to justify its
request for the adjusted standard. Essentially, the Board
rejected assertions that the continued high quality of the
receiving stream after several years of discharge at the desired
levels of pollutants was sufficient justification for the requested
relief. Rather, the Board looked to whether the petitioner had
proven that "substantially and significantly different factors"
applied to its discharge than those considered in the rulemaking
proceeding that established the standards involved.
The Illinois Power Company has operated a coal-fired steam
electric generating station north of Oakwood, Illinois, adjacent to
the Middle Fork of the Vermilion River, since 1955. The facility
has an ash pond system, the outfalls of which have discharged to
the Middle Fork. In periods of low stream-flows, the discharges
cause or contribute to violation of the general use water quality
standards for boron, sulfate, and total dissolved solids. The
Middle Fork is a Class A stream, a State Protected River, and a
federal "scenic river". The river and its adjoining lands are the
habitats for various aquatic and terrestrial species, including
some rare and endangered species.
The Illinois Power Company investigated several alternatives
for compliance, and finally opted to seek an adjusted standard,
filing its petition on July 1, 1992. The Sierra Club and the
Committee on the Middle Fork of the Vermilion River filed
objections and requests for hearing in July, 1992. The Agency
submitted its recommendation on August 7, 1992 and November
20, 1992, recommending a modified adjusted standard from that
sought. The Illinois Power Company ultimately concurred in the
Agency's modifications. The proposed adjusted standard, as
modified, would have imposed water quality standards of 9.2
mg/l for boron, 800 mg/l for sulfate, and 1,400 mg/l for total
dissolved solids. The existing applicable water quality standards
are 1.0 mg/l, 500 mg/l, and 1,000 mg/l, respectively. The Illinois
Department of Conservation submitted a letter in support of the
proposed adjusted standard in August, 1992.
The Illinois Power Company presented a record that indicated
the adjusted standard sought would make no change in the
discharges as they have occurred, and hence, the stream water
quality, since operations began in 1955. The company indicated
that no known mortality or other effects have occurred in the
aquatic community during this time, that there is no authorized
use of the stream water for agricultural irrigation, that there is no
use of the water as a potable water source, and that there is no
impact on human health through recreational use of the stream.
The power company argued that the record it presented indicated
no support for the Board-established water quality standards for
the three contaminants.
The Sierra Club and the Committee on the Middle Fork of the
Vermilion River argued that the Illinois Power Company based its
conclusions on incomplete and unreliable data. It asserted that
the company could comply at a nominal cost per customer. It
claimed that adjusted standards are appropriate only where the
stream involved is more polluted and less ecologically diverse
than those considered by the Board in promulgating the general
use water quality standards, so an adjusted standard was
inappropriate for the Middle Fork due to the greater diversity and
presence of endangered species.

The Board focused on the statutorily-prescribed factors for
issuance of an adjusted standard from Section 28.1 of the Act
and concluded that the Illinois Power Company had failed to
justify an adjusted standard by these factors. First, the utility
failed to show how the burden of compliance imposed on it was
different from that borne by other, similar utilities. The Board
rejected the argument that the fact that the stream was still pure
after many years of discharge was sufficient justification.
Second, the company had failed to show that no environmental
harm more adverse than that considered in the rulemaking would
result. Further, the Board stated that the fact that a stream is not
used in a certain way is not persuasive, since the Board did not
wish to foreclose such future use.
Third, the Board observed from the record that compliance
with the general use standards was technically possible. The
Board rejected the argument that an adjusted standard was
justified based on the costs of compliance just because the
record might indicate no environmental benefits to be derived
through compliance with the general rule.
Finally, the Board concluded that granting the requested
adjusted standard would violate federal (and state) anti-
backsliding provisions. The Board noted that the high quality of
the Middle Fork and its federal- and state-protected status
warranted special consideration. The Board noted that the
record indicated that at no time in the past--even in periods of
low flow--did the levels of
contaminants in the stream go as high as those requested. The
Board felt that the proposed adjusted standard would have
represented a degradation of stream water quality.
