GOVERNOR SIGNS MAJOR AMENDMENTS
TO ILLINOIS UST AND LANDFILL PROGRAMS
On September 13, 1993, Governor Edgar signed into law Public Act 88-496 (effective upon becoming law; formerly
known as House Bill 300), which made some sweeping changes to the regulation of Illinois landfills and the cleanup of
leaking underground storage tank sites. This legislation was intended to allow Illinois to obtain federal authorization of a
state landfill regulation program pursuant to Subtitle D of the federal Resource Conservation and Recovery Act of 1976
(RCRA), as amended by the Hazardous and Solid Waste Amendments of 1984 (HSWA). (

P.A. 88-496 was further intended to significantly modify the Illinois system for corrective action and financial assurance
for corrective action at leaking underground storage tank sites under Subtitle I of HSWA. (

U.S. EPA EXTENDS THE DEADLINE FOR COMPLIANCE WITH ITS
SUBTITLE D LANDFILL REGULATIONS IN ILLINOIS FOR SIX MONTHS
In a press release issued on September 29, 1993, U.S. EPA announced that it had extended the deadline for compliance
with its new RCRA Subtitle D landfill regulations for six months, until April 9, 1994, in nine states affected by flooding
this summer. Illinois is among the nine states, which also include Iowa, Missouri, Wisconsin, South Dakota, North
Dakota, Nebraska, and Kansas. U.S. EPA Administrator Carol M. Browner signed the order on September 27. U.S.
EPA stated that the additional landfill capacity is needed for disposal of flood debris. The extension is available to any
landfill if the state determines that the extension is needed so the landfill can receive flood-generated wastes. The release
stated that the order also issues a blanket extension of the deadline until April 9, 1994 in all other states, but only for
small landfills--i.e., those designed to receive less than 100 tons per day. The small landfill extension is unrelated to the
flood debris landfill extension. (

EMERGENCY RULE TO ALLOW ON-SITE BURIAL OF DEAD
ANIMALS IN FLOOD-AFFECTED COUNTIES, R93-25
On September 23, 1993, the Board adopted an emergency
rule that allows the burial of animals without a permit on the
property on which they are found in certain counties. The Board
found the existence of "a threat to the public interest, safety or
welfare" and that "no harm will result from such burning" in
response to an Agency proposal filed on August 18.
The emergency rule allows the on-site burials of animals in 43
counties that lie along the Mississippi River and its tributaries
which have been designated a federal and state "disaster area"
due to severe flooding this summer. These counties are Adams,
Alexander, Boone, Brown, Calhoun, Carroll, Cass, Cook,
DuPage, Fulton, Greene, Hancock, Henderson, Henry, Jackson,
Jersey, Jo Daviess, Kane, Knox, Lake, Lee, Madison, Massac,
McHenry, Mercer, Monroe, Morgan, Ogle, Peoria, Pike, Pope,
Pulaski, Randolph, Pock Island, Schuyler, Scott, Stephenson, St.
Clair, Union, Warren, Whiteside, and Winnebago. The rule
imposes certain conditions on the burials in order to protect water

The Board adopted the existing state landfill regulations in docket R88-7, in August, 1990. U.S. EPA adopted its Subtitle D landfill
rules in October, 1991, effective October, 1993. (
40 CFR 258; 56 Fed. Reg. 50978 (Oct. 9, 1991). See article, "U.S. EPA EXTENDS
THE DEADLINE" on page 1.
) The 1991 federal rules now constitute minimum standards for landfills. To obtain and maintain U.S. EPA
authorization of the Illinois landfill program, it was necessary to update the Environmental Protection Act and the R88-7 rules.
The P.A. 88-496 provisions relating to the Illinois Subtitle D program have three major aspects. First, they will require the Board to
adopt regulations that are identical in substance to rules adopted by U.S. EPA under Subtitle D of RCRA. Second, federal authorization
required that Illinois have a system for permitting all landfills covered by federal Part 258. Formerly, certain on-site industrial landfills
were exempted from the permitting requirements. P.A. 88-496 grants these formerly exempted facilities a permit by rule, and it
authorizes the Illinois EPA (IEPA) to review and permit all such facilities within a certain period of time. Finally, to aid in obtaining timely
federal authorization of the Illinois Subtitle D program, P.A. 88-496 has a number of implementation provisions. Primary among these is
that IEPA is authorized to directly implement certain of the 40 CFR 258 provisions that are more stringent than the existing Illinois rules,
while continuing to implement any more stringent existing Illinois regulations. The amendments provide that the Board's Subtitle D
amendments (
see Rulemaking Update
) to the existing landfill regulations will become effective only after U.S. EPA has approved them.
The other major amendments of P.A. 88-496 fundamentally rewrote the Illinois underground storage tank regulatory and
reimbursement programs. New Title XVI of the Act sets forth the requirements for governance of underground storage tanks; for
abandonment, repair, removal or corrective action for leaking underground storage tanks; and for reimbursement of corrective action
costs associated with underground storage tanks used to contain petroleum, which is specifically and narrowly defined. Initially, the
terms "facility", "owner", "operator", "underground storage tank", "petroleum", and "regulated substance", all key terms, are given the
same meanings as they have under Subtitle I of the federal HSWA.
Second, the Office of the State Fire Marshall (OSFM) regulates the removal, abandonment, or repair of underground tanks, and the
OSFM must have a representative on site during any tank removal, abandonment, or repair. If there is a release, the OSFM

representative must give the owner or operator reimbursement forms, direct the tank owner or operator to undertake remediation, and
offer on-site assistance with regard to eligibility and reimbursement for corrective action. If there is no release, the OSFM may issue a
certification that has the same effect as an IEPA "No Further Remediation" letter, creating a rebuttable presumption that no further
remedial action is necessary.
Third, there are fundamental changes in how reimbursement is obtained. If there is a release, the owner or operator may backfill the
preliminary tank excavation and seek reimbursement from the Agency before beginning corrective action, then complete the corrective
action later when funds become available, unless IEPA notifies it of a "threats due to the presence or migration . . . of petroleum in
concentrations sufficient to harm human health or human safety or to cause explosions . . . or to otherwise damage property."
Alternatively, the owner or operator may proceed with remediation and later seek reimbursement. If the owner or operator seeks
reimbursement prior to undertaking corrective action, it must submit a plan for IEPA review, and reimbursement is available only for the
amounts approved by IEPA. IEPA must audit corrective action plans and budgets using "generally accepted auditing and accounting
principles".
Fourth, the structure of remedial actions is changed. If there is a release, the owner and operator may remove the tank and a limited
amount of contaminated soil (only that which is visibly contaminated, up to four feet from the tank) and groundwater (only that with a
visible sheen) from the hole at the time of initial excavations. The owner or operator must then undertake a study of the site to determine
whether it is a high priority, low priority, or no further action site. This is based on the type of soil at the site, according to U.S. Geological
Survey records and a professional engineer's verification; the absence or presence of groundwater contamination from the product at a
critical distance from the tank (the nearer of the property boundary or 200 feet from the tank); whether there is any Class III groundwater
within 200 feet of the tank; whether the tank is located within the setback zone of a potable water supply well or a regulated recharge
area; or whether there are any "threats."
The site cleanup standards are primarily based on groundwater contamination. For a high priority or site, the owner or operator must
submit a corrective action plan for IEPA approval. For a low priority site, the owner or operator must submit a monitoring plan. The
objective in either case is to assure that there is no "threat" to human health or property (as quoted above) or contamination of the
groundwater at the critical distance from the tank. Groundwater monitoring is to occur over a minimum of three years at a diminishing
frequency (quarterly the first, semiannually the second, and annually the third), unless there is detection of contamination. If
contamination is present, the site may be classified as a high priority site, and the owner or operator must then submit a corrective action
plan. After the remediation is complete, the IEPA must issue a "No Further Action" letter.
Further, P.A. 88-496 sets forth new deductible and maximum limitations on reimbursability. It also sets forth the Board's role in the
UST regulatory and reimbursement scheme: review of IEPA reimbursement determinations and plan reviews, reviewing state requests
for recovery of payments, and adopting regulations. The amendments establish an advisory committee composed of representatives of
the regulated community to study and propose regulations that set forth indicator contaminants, the types of corrective action activities
eligible for reimbursement, costs that do not constitute corrective action, and the procedures for requesting payment, for submitting
corrective action plans, for collection of excess payments, and for IEPA audits of corrective action and groundwater monitoring plans.

potable water supply well, and they may not be within one foot of
the water table. The emergency rule allows the burials without a
permit. The rule became effective on September 30, 1993, for a

FEDERALLY-DERIVED RCRA SUBTITLE D LANDFILL
AMENDMENTS ADOPTED, R93-10
At a special Board Meeting held on September 15, 1993 the
Board voted to adopt amendments to the Illinois non-hazardous
landfill regulations that incorporate changes necessary to make
them as stringent as the federal RCRA Subtitle D regulations.
The amendments are based on October 9, 1991 U.S. EPA rules
that apply to municipal solid waste landfill facilities (MSWLFs).
Federal law presently requires that the states must adopt
regulations that are no less stringent than the new federal
regulations on or before October 9, 1993 in order to maintain
state primacy in this area. (
See lead story: "U.S. EPA Extends
Deadline".
) New P.A. 88-496, effective September 13, 1993,
mandates that the Board adopt these amendments using
identical-in-substance rulemaking procedures. (
See lead story:
"Governor Signs Major Amendments"; see also issue 471 (June
16, 1993).
) The Board will delay filing of the adopted
amendments until at least October 1, 1993 to allow U.S. EPA
further opportunity to comment on the rules. (As of this writing,
the Board had received requests from both U.S. EPA and the
Illinois EPA to extend this period.)
The amendments affect Parts 810, 811, and 814 of the Illinois
landfill rules. The amendments to Part 810 add various
definitions relating to MSWLF units and incorporate U.S. EPA
test methods for evaluating solid waste and an extensive federal
listing of numerous of organic and inorganic contaminants for
which these facilities must test groundwater. The amendments
to Part 811 include several changes to the existing new landfill
standards. Briefly, they amend to the landfill location, operating,
closure and post-closure care, recordskeeping, groundwater
monitoring and corrective action, and financial assurance
requirements, as they apply to MSWLFs, to make them as

stringent as the federal new rules. The amendments to Part 814
include several similar changes to the standards applicable to
existing landfills in order to make them also as stringent as the
U.S. EPA Subtitle D regulations. Additionally, they clarify the
applicability of Part 814 to existing MSWLFs and to lateral
expansions, set forth permitting requirements for existing
MSWLF units and for lateral expansions, and establish
foundation and mass stability standards, and impose
groundwater monitoring, quality, and assessment requirements

CLEAN AIR ACT OMNIBUS CLEANUP RULEMAKING
ADOPTED, R93-9
On September 9, 1993 the Board adopted, under docket
number R93-9, amendments based on the proposal filed this
spring by the Illinois Environmental Protection Agency (Agency)
for an omnibus cleanup of Illinois' Air Pollution Control
regulations pertaining to emissions of volatile organic materials.
(See issues 468, (April 7, 1993) and 473 (August 4, 1993).)
The
proceeding, entitled
In the Matter of: Omnibus Cleanup of
Volatile Organic Materials RACT Rules Applicable to Ozone
Nonattainment Areas
, amended Parts 203 (permitting), 211
(general VOM provisions), 218 (Chicago metropolitan area VOM
provisions), and 219 (Metro E. St. Louis metropolitan area VOM
provisions). This rulemaking represents one segment of Illinois'
submittal of a complete State Implementation Plan (SIP) to the
U.S. Environmental Protection Agency (U.S. EPA).
Section 182(a) of the Clean Air Act Amendments of 1990
(CAAA) required Illinois to have adopted and submitted its
proposed SIP by November 15, 1992. The purpose of the R93-9
proposal is to make certain corrections to parts 218 and 219 as
suggested by U.S. EPA for approval, to correct typographical
errors, and to clarify the rules.
The Board conducted two public hearings on the proposal on
May 7 and June 4, 1993. Public comments were received until
June 22. Certain revisions from the First Notice version of the
proposal occurred as a result of the testimony and comments
received. The majority of those revisions related to corrections of
grammar and punctuation, changes in certain choices of wording,
and changes in regulatory format. Certain other revisions have a
more substantive impact. These included changes to certain
definitions and the deletion of a requirement that facilities submit
notices and reports to U.S. EPA under certain limited
circumstances.

RCRA UPDATE ADOPTED, R93-4
On September 26, 1993, the Board adopted certain
amendments to the Illinois RCRA regulations to include federal
actions from July 1 through December 31, 1992. This docket,
R93-4, involves amendments to 35 Ill. Adm. Code 703, 720, 721,
722, 724, 725, 726 and 728, and it added a new Part 739, The
Management of Used Oil. The Board will follow its usual
procedure in RCRA update dockets and delay filing the rules and
amendments until after October 26, 1993 to allow U.S. EPA
additional opportunity for comment.
This rulemaking included numerous significant amendments to
the Illinois RCRA regulations. Among the more significant
amendments it included were a new set of regulations for
managing used and waste oil; a lifting of the administrative stay
on certain wood preserving rules requiring the use of drip pads;
the addition of land disposal restrictions (LDRs) for hazardous
debris and newly-listed wastes; corrections to the Third-Third
LDRs; treatment, storage, and disposal facility standards for
containment buildings (presently known as indoor waste piles);
10 new hazardous waste listings for coking wastes; standards for
the use of sorbents for disposal of liquid wastes in landfills;
alternative emissions standards for hazardous waste burners;
and treatment standards for hazardous debris and soils. Direct

CLEAN AIR ACT AIR PERMIT APPEAL PROCEDURE
PROPOSAL ACCEPTED, PUBLISHED FOR FIRST NOTICE,
R93-24
On September 26, 1993 the Board accepted for First Notice
publication in the
Illinois Register
, under docket number R93-24,
a proposal filed by the Illinois Environmental Protection Agency
(Agency) for amendments to the procedural rules pertaining to air
permit appeals. The proceeding, entitled
In the Matter of:
Amendments to the Rules for Clean Air Act Permit Appeals and
Hearings Pursuant to Specific Rules 35 Ill. Adm. Code Parts 105
and 106
, would amend the Board's procedural rules as they
apply to permits sought under the federal Clean Air Act
Amendments of 1990 (CAAA). The Agency filed the proposal
with the Board on September 14, 1993, pursuant to Section 28.5
of the Environmental Protection Act. (415 ILCS 5/28.5.) The
proposal represents one segment of Illinois' submittal of a
complete State Implementation Plan (SIP) to the U.S.
Environmental Protection Agency (U.S. EPA).
Section 182(a) of the Clean Air Act Amendments of 1990
(CAAA) required Illinois to have adopted and submitted its
proposed SIP by November 15, 1992. The purpose of the R93-
24 proposal is to make certain modifications to Parts 105 and
106 of the Board's procedural rules for U.S. EPA approval.
Among other amendments, the proposed amendments would
require the Agency to provide notice of a permit denial to the
U.S. EPA, the permit applicant, "any person who participated in
the public comment process", and "any other person who could
obtain judicial review under Sections 40.2 and 41 of the Act . . .".
These persons would also have a right to obtain Board review of
an Agency permit decision or its failure to take action on the
permit application within certain prescribed times. The proposed
amendments would add certain requirements for petitions for
CAAA permit review and set forth other procedural requirements.
Section 28.5 requires the Board to proceed within set time-

frames toward the adoption of the proposed amendments. The
Board lacks any discretion under the statute to adjust these time-
frames under any circumstances. The statute requires the Board
to schedule three hearing dates in this matter, each for a
prescribed purpose. The first day of hearing is reserved for
presentation by the Agency and questions of Agency witnesses.
The second scheduled day of hearing, if it occurs, is reserved for
presentation by affected entities and all other interested persons.
The third scheduled day of hearing, if it occurs, is reserved for
any Agency response and responses of other parties. In these
"fast-track" proceedings, the hearings are continued from day to
day, as necessary, until all business is completed. However, the
second and third hearing dates are subject to cancellation
without further notice if the level of public interest and
participation so warrant.
All hearings will be held at the Capitol Building, Room 400,
Springfield, Illinois, and will begin at 10:00 a.m. The Board has
scheduled the following hearing dates and rooms:

Each day of hearing will be continued from day to day, as
necessary, until business is complete. The second and third

ARMY CORPS. DREDGING WATER QUALITY RULE
PROPOSED FOR FIRST NOTICE, R92-17
On September 26, 1993, the Board proposed a rule for First
Notice publication in the Illinois Register that would govern the
placement of dredged material along the Illinois River between
miles 80.2 and 291 by the Army Corps. of Engineers during
dredging operations. The Army Corps. filed a proposal on
September 17, 1992. The Board held public hearings on June
22, 1993, in Peoria, and June 23, 1993, in Morris. Following the
hearings, the Board received public comments in favor of the
proposal.
This rule would impose alternative limitations on the
placement of dredged material, in place of the current prohibition
against causing offensive conditions or a violation of the water
quality limitations for dissolved oxygen, total, lead, total zinc, and
ammonia nitrogen and un-ionized ammonia. The alternative
limitations would allow bankline deposition during dredging
operations, and would govern the percent of fine-grained material
in the dredge cut and the area of the water that does not comply
with the water quality standards. The limitations would require
the Army Corps. to hold a Water Quality Certification for the
dredging operations issued by the Agency pursuant to Section
401 of the Clean Water Act (33 U.S.C. § 1341). Direct questions

On September 23, 1993, the Board proposed certain
amendments to the Illinois landfill regulations for First Notice
publication in the
Illinois Register
that would govern the landfill
disposal of certain wastes generated by the iron and steel
industries. The Board took this action without comment on the
merits of the proposed rules after receiving a second amended
proposal from the proponent foundry and steel industries.
The Illinois landfill regulations, adopted in August, 1990,
included a provision that allowed an exemption for certain wastes
generated by the foundry and steel industries, provided the
subject industries filed a proposal by December 1, 1990 setting
forth alternative regulations. The industries filed such a proposal
on December 12, 1990. The Board adopted an order sending
proposed rules for First Notice publication on February 7, 1991
and held public hearings on May 19, June 7, and June 21, 1991.
The proponent industries filed an amended proposal on May 13,
1991 and a second amended proposal on March 4 and May 13,
1993.
The proposed amendments would impose certain alternative
requirements for the landfilling of foundry sand and steel slag in
landfills accepting only waste from the iron and steel industries.
They would establish standards for waste testing, waste
classification, waste mining, waste use, and long-term storage of
wastes. The applicable limitations imposed would include landfill
design, operation, maintenance, closure, and post-closure care
requirements. The Board held a public hearing on the second
amended proposal on October 1, 1993, and another hearing is
presently scheduled for November 19, 1993, in Chicago. Direct

CROSS-CONNECTIONS PROCEEDING DISMISSED, R87-37
On September 9, 1993, the Board determined that the record
lacked sufficient information to allow the Board to proceed in
docket R87-37, cross-connection control. The Agency-proposed
rules would have regulated cross-connections, connections
between potable and non-potable water supplies, to assure
protection of the potable supplies.
In dismissing the docket, the Board noted that the Agency, the
participants, and the Board had each dedicated a significant
amount of time and effort to this rulemaking. However, there
were several areas within the record that were lacking. The
Board specifically stated that the record did not indicate that the

rule as proposed was economically reasonable and that the costs
associated with by cross-connection control as proposed were far
outweighed by the benefits to be gained.
Although the Board noted that cross-connection control is an
area in which regulation could prove beneficial, it chose not to
proceed with the rulemaking. Noting that cross-connections are
currently regulated by 35 Ill. Adm. Code 607.104 of the Board's
water pollution regulations and by the Illinois Plumbing Code,
administered by the Illinois Department of Public Health, the
Board closed the R87-37 docket. J. Anderson concurred. Direct

EIGHT FEDERAL PROGRAM UPDATE DOCKETS
RESERVED, FOUR DISMISSED, R93-17 THROUGH R93-23
On September 26, 1993, the Board reserved eight new
identical-in-substance rulemaking dockets to accommodate
federal amendments in the various covered programs that
occurred during the period from January 1 through June 30,
1993. The Board promptly dismissed four of these routine
dockets because no federal amendments occurred in the
respective programs.
The identical-in-substance dockets dismissed pertained to the
Illinois underground injection control (UIC), underground storage
tank (UST), Safe Drinking Water Act (SDWA), and Clean Air Act
programs (exemptions from the definition of VOM (R93-17,
R93-18, R93-19 and R93-21, respectively). U.S. EPA did not
amend its UIC and SDWA rules (40 CFR 141, 142, 146 & 148)
during this update period. U.S. EPA further did not amend its
exemptions from the definition of VOM (40 CFR 51.100(s))
during this time. The amendments that U.S. EPA made to its
UST rules (40 CFR 280 & 281) did not affect those aspects
within the Board's identical-in-substance mandate.
The four dockets retained included those for the RCRA
(Subtitle C, hazardous waste) program (R93-16), the wastewater
pretreatment program (R93-20), the RCRA Subtitle D (non-
hazardous waste landfill) program (R93-22), and the Illinois
contingency plan (CERCLA) program. U.S. EPA amended its
RCRA Subtitle C regulations during the January 1 through June
30, 1993 time-frame. The Board will consider corresponding
amendments at a future time. During this time, U.S. EPA
promulgated its federal sludge management regulations, and the
Board is studying the impact of the federal program on the state
wastewater pretreatment and Subtitle D programs to determine
appropriate further action in these two corresponding dockets.
Although U.S. EPA did not amend its CERCLA regulations
during the period, the Board has temporarily delayed further
action in the state contingency plan update docket. Direct

Pursuant to Section 28.1(d)(3) of the Environmental
Protection Act, the Board is publishing in this issue of the
Environmental Register a list of all final determinations
on adjusted standards made within fiscal year 1993 (July
1, 1992 through June 30, 1993). Accompanying that
listing is a list of all final determinations on combined
sewer overflow exceptions during the fiscal year. To
receive a copy of any of these determinations, please
write to the Clerk of the Board and specify the docket
number of the case.

BOARD MEMBERS SPEAK AT ENVIRONMENTAL
REGULATIONS IN ILLINOIS CONFERENCE
Chairman Claire Manning and Board Member Bill
Forcade addressed the participants at a conference on
environmental regulations in Illinois, presented by the
Institute of Business Law at the Swissotel in Chicago, on
September 28 and 29, 1993. The conference included
speakers from federal, state, county and municipal
agencies, along with consultants and environmental
attorneys.
Chairman Manning explained the structure of
environmental law and regulations in the state. The
Chairman provided a historical overview of the
environmental system in Illinois. She also addressed the
role of the Board in rulemaking and adjudicatory
proceedings. She also spoke on the environmental issues
that the Board will face in the future.
Mr. Forcade spoke on recent trends in rulemaking and
enforcement actions. He addressed the use of penalties
by the Board and compared the penalties used by the
Board with penalties from circuit court actions and
federal enforcement procedures. Board member Forcade
also addressed the relationship between rulemaking and
enforcement actions. He stressed the importance of
public participation in the rulemaking process. He also
reviewed the areas where new rulemakings are
anticipated in the future.

SUPREME COURT DENIES HEARING APPEAL
FROM FOURTH DISTRICT
GRIGOLEIT
DECISION
On October 6, 1993, the Illinois Supreme Court denied
the Illinois EPA's petition for leave to appeal a Fourth
District appellate decision in
Grigoleit Co. v. PCB
(May
6,
1993), 245 Ill. App. 3d 337, 613 N.E.2d 371 (4th Dist.;
before the Board as docket PCB 89-184). The appellate
court had affirmed all aspects of the Board's order that
the Agency must issue a permit, except to the extent the
Board denied an award of attorneys' fees against the
Agency. (

On appeal, the Agency had asserted that the court
lacked jurisdiction because Grigoleit did not file for
reconsideration by the Board before filing an appeal.
The court ruled that a motion for reconsideration was not
a necessary prerequisite to appellate jurisdiction over a
Board decision.
The Fourth District further held that once the Board
issues a mandate in a permit appeal, the Agency lacks the
discretion to do anything but follow that mandate if it
chooses not to appeal the Board's order. The Agency had
argued that it retains the same discretion to review a
permit request after reversal on appeal and a remand by
the Board as it had before the Board order.
Finally, the court reversed a Board denial of the
sanction of an award of attorneys fees expended by the
permit applicant on the second appeal. Rather than
award attorneys' fees, the Board ordered the Agency to
issue the permit. The court felt that ordering the Agency
to grant the permit applicant something to which it was
already entitled was an insufficient sanction.
Nevertheless, the court held that the Board had properly
denied the request for dismissal of a separate enforcement
action filed by the Agency against Grigoleit.
The Illinois Supreme Court will issue its mandate in
this matter on October 28, 1993.

Restricted Status List
-- Public Water Supplies
The Restricted Status List was developed to give additional notification to officials of public water supplies
which are in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois
Environmental Protection Act.
The Restricted Status List will include all Public Water Supplies for which the Agency has information
indicating a violation of any of the following requirements: Finished water quality requirements of 35 Ill.
Adm. Code, Part 604, Subparts B and C; maintenance of adequate pressure on all parts of the distribution
system under all conditions of demand; meeting raw water quantity requirements of 35 Ill. Adm. Code 604.502;
or maintenance of treatment facilities capable of providing water "assuredly adequate in quantity" as required
by Section 18 of the Illinois Environmental Protection Act.
A public water supply on the Restricted Status List will not be issued permits for water main extensions,
except for certain limited situations, or unless the supply has been granted a variance from the Illinois
Pollution Control Board for the violation, or from permit issuance requirements of Section 39 of the Act.
This list is continually being revised as new information becomes available, and therefore, specific inquiries
as to the status of any public water supply should be directed to the Division of Public Water Supplies for
final determination. This list reflects the status as of October 1, 1993.

The Critical Review List was developed to give additional notification to officials of public water supplies
which may be close to being in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I
or the Illinois Environmental Protection Act.
A supply will be placed on the Critical Review List when Agency records indicate that it is approaching any of
the violations which would place it on the Restricted Status List.
This list is continually being revised as new information becomes available, and therefore, specific inquiries
as to the status of any public water supply should be directed to the Division of Public Water Supplies for
final determination. This list reflects the status as of October 1, 1993.

CLEAN AIR ACT PERMIT PROGRAM PROCEDURES

The hearing will be held for the purpose of gathering public comments on the Illinois Environmental Protection Agency's
("Agency") Clean Air Act Permit Program Procedures, 35 Ill. Adm. Code 270.
These rules are being proposed to provide additional detail regarding the State of Illinois Clean Air Act Permit Program
("CAAPP"), as provided by 35 Ill. Adm. Code 5/39.5 (formerly Ill. Rev. Stat. ch. 111½, par. 1039.5), to assist the
affected sources. The proposed rules provide specific procedures regarding the preparation and submittal of permit
applications, permit reopenings, and permit fee billing and payment.
Persons interested in presenting oral testimony will be initially limited to fifteen (15) minutes for the presentation of such
testimony. No person will be recognized to speak for a second time until all persons wishing to testify have done so.
The hearing will be held under the provisions of the Agency's "Procedures for Informational and Quasi-Legislative
Public Hearings", 35 Ill. Adm. Code 164. Information about the hearing process and copies of these rules may be had
