RULEMAKING UPDATE
MEDICAL WASTE REGULATIONS ADOPTED,
R91-20
On June 17, 1993, the Board adopted, in docket R91-
20, final regulations for the treatment, storage, and
transfer of potentially infectious medical waste (PIMW)
and standards for the transportation, packaging, and
labeling of PIMW. The adopted rules amend 35 Ill.
Adm. Code 1420 and add new Parts 1421 and 1422 to the
Board's regulations.
The adopted amendments follow the recommendations
of the Governor's Medical Waste Tracking Study Group,
as that Group's consensus recommendations have been
presented to the Board in the proposal submitted by the
Illinois Environmental Protection Agency. Changes were
made prior to Second Notice in response to comments,
and additional changes were made at the recommendation
of Joint Committee on Administrative Rules (JCAR) and
in response to a JCAR objection, as discussed in the
Board's opinion document. (

PROVISIONS OF LANDFILL RULES FOUND
INVALID BY APPELLATE COURT ARE
DELETED, R92-19
On June 17, 1993, the Board adopted a final opinion
and order deleting three provisions from the Illinois non-
hazardous landfill regulations. This was in response to
the June 11, 1992 appellate court decision in
Waste
Management of Illinois, Inc. v. IPCB
(1st Dist. 1992),
231 Ill. App. 3d 278, 595 N.E.2d 1171, that affirmed
those regulations in all respects but two. The
Waste
Management
court invalidated two of the landfill
provisions: the requirement of Section 811.310(d)(1)(F)
for monitoring air toxics, based on a legislatively-
mandated but yet then yet-to-be-adopted list of
chemicals, and the provision in Section 813.106(b) that
provided, for the purposes of an appeal to the Board of an
Agency action, the Agency's final action will be that
taken on reconsideration if the permittee submitted a
request for Agency reconsideration. The appellate court
issued its mandate on August 13, 1992, and the Board
initiated this proceeding by proposing amendments on
October 1, 1992. (

In addition to the two provisions held invalid by the
First District, the Board also deleted a third provision
from the rules. In the initial stages of this proceeding,
the Board requested comment as to whether it should do
so. That third provision, Section 811.310(c)(5), which
related to monitoring air toxics, was closely tied to
Section 811.310(d)(1)(F), which the court held invalid.

RESERVED CLEAN AIR ACT AMENDMENTS
RULEMAKING DOCKETS DISMISSED, R91-27,
R91-31, R91-32, R91-33, R91-34 & R91-37
On June 17, 1993, the Board dismissed six rulemaking
dockets relating to the Illinois air pollution control
regulations. The Board undertook the unusual action of
opening eleven dockets on October 24, 1991 in response
to the Clean Air Act Amendments of 1990 (CAAA). The
Board anticipated the filing of rulemaking proposals by
the Agency in response to that federal legislation. Each
docket dealt with a separate aspect of the changes in
federal law with which Illinois must comply. With each
docket, the Board intended to establish a time-frame for
the various required rulemaking activities in order to
timely comply with the federal deadlines for state
compliance. (

The Pollution
Control Board operates an electronic BBS at 312-814-1590. The BBS is available 24 hours a day, 7 days a week,
to anyone with access to a computer and a modem - there is no charge for access to the BBS. The best
communications settings are 8 data bits (or data length 8), no parity (or parity = none) and 1 stop bit, i.e., 8-N-
1. The best terminal emulation is ANSI-BBS or just ANSI. The BBS contains Board Agendas, Environmental
Registers, Annual Reports, and various documents about the Board. You may download these documents to your

The subscription service comprises all

Restricted Status List
-- Public Water Supplies
The Restricted Status List was developed to give additional notification to officials of public water supplies
which are in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois
Environmental Protection Act.
The Restricted Status List will include all Public Water Supplies for which the Agency has information
indicating a violation of any of the following requirements: Finished water quality requirements of 35 Ill.
Adm. Code, Part 604, Subparts B and C; maintenance of adequate pressure on all parts of the distribution
system under all conditions of demand; meeting raw water quantity requirements of 35 Ill. Adm. Code 604.502;
or maintenance of treatment facilities capable of providing water "assuredly adequate in quantity" as required
by Section 18 of the Illinois Environmental Protection Act.
A public water supply on the Restricted Status List will not be issued permits for water main extensions,
except for certain limited situations, or unless the supply has been granted a variance from the Illinois
Pollution Control Board for the violation, or from permit issuance requirements of Section 39 of the Act.
This list is continually being revised as new information becomes available, and therefore, specific inquiries
as to the status of any public water supply should be directed to the Division of Public Water Supplies for
final determination. This list reflects the status as of July 1, 1993.

Critical Revie w List -- Public Water Supplies
The Critical Review List was developed to give additional notification to officials of public water supplies
which may be close to being in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I
or the Illinois Environmental Protection Act.
A supply will be placed on the Critical Review List when Agency records indicate that it is approaching any of
the violations which would place it on the Restricted Status List.
This list is continually being revised as new information becomes available, and therefore, specific inquiries
as to the status of any public water supply should be directed to the Division of Public Water Supplies for
final determination. This list reflects the status as of July 1, 1993.
