CLEAN AIR ACT OMNIBUS CLEANUP RULEMAKING
PROPOSAL ACCEPTED, PUBLISHED FOR FIRST NOTICE,
R93-9
On March 25, 1993 the Board accepted for First Notice
publication in the
Illinois Register
, under docket number R93-9,
the proposal filed by the Illinois Environmental Protection Agency
(Agency) for an omnibus cleanup of Illinois' Air Pollution Control
regulations pertaining to emissions of volatile organic materials.
The proceeding, entitled
In the Matter of: Omnibus Cleanup of
Volatile Organic Materials RACT Rules Applicable to Ozone
Nonattainment Areas
, would amend Parts 203 (permitting), 211
(general VOM provisions), 218 (Chicago metropolitan area VOM
provisions), and 219 (Metro E. St. Louis metropolitan area VOM
provisions). The Agency filed the proposal with the Board on
March 16, 1993, pursuant to Section 28.5 of the Environmental
Protection Act. (415 ILCS 5/28.5 (Ill. Rev. Stat. 1991 ch. 111½,
par. 1028.5), as added by P.A. 87-1213, effective September 26,
1992.) The proposal represents one segment of Illinois'
submittal of a complete State Implementation Plan (SIP) to the
U.S. Environmental Protection Agency (USEPA).
Section 182(a) of the Clean Air Act Amendments of 1990
(CAAA) required Illinois to have adopted and submitted its
proposed SIP by November 15, 1992. The purpose of the R93-9
proposal is to make certain corrections to parts 218 and 219 as
suggested by USEPA for approval, to correct typographical
errors, and to clarify the rules.
As previously reported for the earlier-filed CAAA proceeding,
R92-21 (

issues 461 (Dec. 2, 1992),
462 (Dec. 16, 1992), 465 (Feb. 24, 1993), and 467 (Mar. 24,
1993)), Section 28.5 requires the Board to proceed within set
time-frames toward the adoption of the proposed amendments.
The Board lacks any discretion under the statute to adjust these
time-frames under any circumstances.
The statute requires the Board to schedule three hearing dates
in this matter, each for a prescribed purpose. The first day of
hearing is reserved for presentation by the Agency and questions
of Agency witnesses. The second scheduled day of hearing, if it
occurs, is reserved for presentation by affected entities and all
other interested persons. The third scheduled day of hearing, if it
occurs, is reserved for any Agency response and responses of
other parties. The hearings will be continued from day to day, as
necessary, until all business is completed. However, the second
and third hearing dates are subject to cancellation if the level of
public interest and participation so warrant.
All hearings will be held at the State of Illinois Center at 100
W. Randolph St., Chicago, Illinois and will begin at 10:00 a.m.

MEDICAL WASTE REGULATIONS PROPOSED FOR
SECOND NOTICE, R91-20
On March 25, 1993, the Board proposed regulations for the
treatment, storage, and transfer of potentially infectious medical
waste (PIMW) and standards for the transportation, packaging,
and labeling of PIMW for second notice. The proposed
amendments would amend 35 Ill. Adm. Code 1420 and add new
Parts 1421 and 1422.

The second notice proposal continues to follow the
recommendations of the Governor's Medical Waste Tracking
Study Group, as that Group's consensus recommendations have
been presented to the Board in the proposal submitted by the
Illinois Environmental Protection Agency (Agency). At Second
Notice, the Board addressed all comments received and made
some additional changes in response, as discussed in the
Board's opinion document.
Pursuant to the Illinois Administrative Procedure Act, the
proposal will now be submitted for review by the Joint Committee
on Administrative Rules (JCAR). The Second Notice period ends
on May 13, 1993. The proposed rules will be on the agenda for
JCAR's May 11, 1993 meeting. After the Second Notice period
has ended or JCAR submits a Certificate of No Objection, the
Board is free to proceed and adopt rules based on the proposal.

DEADLINE EXTENDED FOR CONTINGENCY PLAN RULES,
R92-18
The Board entered an order in the Contingency Plan Update
docket, R92-18, that extends the deadline for Board Adoption for
an indefinite time. Section 22.7 of the Environmental Protection
Act (415 ILCS 5/22.7 (Ill. Rev. Stat. 1991 ch. 111½, par. 1022.7)
mandates that the Board adopt regulations that are identical in
substance to rules promulgated by USEPA pursuant to Section
105 of the Comprehensive Environmental Response and Liability
Act (CERCLA), 33 U.S.C. § 9605. Those regulations, at 40 CFR
300, govern the allocation of liability and the recovery of costs
incurred in remediation of hazards posed by sites due to the
improper disposal of wastes.
In issuing its order to extend the deadline, the Board noted
that it could not "specify an anticipated completion deadline, due
to the current pendency of legislation [SB 534] seeking to amend
the statutory mandate that will directly affect the scope of this
rulemaking." The Board stated that it anticipated issuing an
order in July, 1993 that will appraise interested persons and the
regulated community of the status of the pending legislation.

APPELLATE UPDATE
THIRD DISTRICT AFFIRMS THAT
REPLACEMENT OF PAVEMENT WAS NOT
REIMBURSABLE; A MOTION FOR
RECONSIDERATION IS NOT NECESSARY TO
APPEAL, PCB 91-205
In
In re Strube v. PCB
(3d Dist. Mar. 15, 1993), No.
3-92-0468, the Third District appellate court affirmed the
Agency's denial of reimbursement from the Underground
Storage Tank Reimbursement Fund. The Board had
affirmed the Agency in its denial of reimbursement for
the costs associated with replacement of pavement.
The Strubes owned a property under which were buried
multiple underground petroleum storage tanks beneath
pavement. In the course of removing the tanks, the
contractor observed that the tanks had leaked. The
Strubes undertook corrective action, which meant
removal of the pavement to remove contaminated soil,
and sought reimbursement from the Fund. The Agency
denied reimbursement for replacement of the pavement,
and the Board affirmed the Agency's determination on
review, in docket PCB 91-205 (May 21, 1992).
In affirming the Board's and Agency's determinations,
the court noted that Section 22.18(e)(1)(C) of the
Environmental Protection Act (415 ILCS
5/22.18(e)(1)(C) (Ill. Rev. Stat. 1991 ch. 111½, par.
1022.18(e)(1)(C))) defines "corrective action" as the
actions necessary to "stop, minimize, eliminate, or clean
up a release of petroleum or its effects to the extent as
may be necessary to protect human health and the
environment." The court agreed that this must be read
narrowly and specifically, denying the Strubes'
contention that the statute had a broad remedial purpose.
The court agreed that the restorative expenses associated
with repaving were outside the statutory definition of
corrective action because the Strubes failed to present
evidence the repaving helped "stop, minimize, eliminate,
or clean up a release of petroleum or its effects to the
extent as may be necessary to protect human health and
the environment."
The court also denied arguments made by the Strubes
that certain Agency actions entitled them to
reimbursement. First, the Strubes argued that
representations in an Agency guidance manual to the
effect that reimbursement was available for the cost of
"dismantling and reassembling structures" included
repaving. The court agreed with the Agency that
repaving was not "reassembly" of the concrete. Second,
they argued that by the Agency requesting that they
submit the repaving bills for review, the Agency did not
represent to them that the costs of repaving were
reimbursable. The court agreed with the Board's finding
that the record contained no evidence of any Agency
representations regarding reimbursability of repaving.
Finally, the court rejected the Strubes' argument that the
Agency violated due process by failing to establish
regulations, rather than follow unpublished internal
guidance. The court noted that although Section
22.18b(f) of the statute authorizes the Agency to adopt
reasonable and necessary rules to administer the fund, it
nowhere requires it to adopt "detailed rules to cover
every conceivable claim for reimbursement." The court
affirmed the Agency determination as upheld by the
Board.
In the course of the appeal, the addressed a
jurisdictional issue raised by the Board. Citing

Castenada v. Illinois Human Rights Commission
(1989),
132 Ill. 2d 304, 547 N.E.2d 437, the Board contended
that the Strubes had failed to exhaust their administrative
remedies by not filing a petition for rehearing before the
Board. The court distinguished
Castenada
on the basis of
the respective procedures of the Board and the Human
Rights Commission. It noted that by statute decisions of
the Commission are made by a three-member panel; by
law, rehearing is before the entire nine-member
Commission,
en banc
. All Board determinations are
made by the entire seven-member Board,
en banc
. Thus,
the court adopted the Strubes' position that petitioning the
Board for rehearing under these circumstances would
waste both the petitioners' and the Board's time.
FIFTH DISTRICT REVERSES BOARD VARIANCE
DENIAL, PCB 91-173
By a March 23, 1993 opinion, in
Marathon Oil Co. v.
PCB
(5th Dist Mar. 23, 1993), No. 5-92-0147, the
Appellate Court for the Fifth District of Illinois reversed
the Board's denial of a variance. The Board decision
under review was rendered in
Marathon Oil Co. v. IEPA
(Jan. 9 and Feb. 27, 1992).
Marathon sought a variance from the effluent discharge
and stream water quality limitations for chloride. The
limitations were imposed by a site-specific rule, 35 Ill.
Adm. Code 303.323, granted by the Board in 1988, in
docket R87-2. The Illinois Environmental Protection
Agency recommended that the Board not grant the
requested variance, primarily because Marathon had not
violated the site-specific standards in the year preceding
the recommendation. Marathon contended that its studies
of control alternatives indicated no method for chloride
control whose cost did not exceed any improvement it
would confer in the receiving stream. Additionally, in
R87-2, the Board had found that no viable alternatives
were available to Marathon.
The appellate court noted that in denying the variance,
the Board had found that Marathon failed to show that the
denial would impose an arbitrary and unreasonable
hardship. The court noted that the Board observed that
Marathon had shown that compliance was difficult, but
not that it was not impossible. The Board held, as noted
by the court, that difficulty alone was an insufficient
basis for a grant of a variance. The Board's order made
no findings with regard to environmental impact of the
requested variance because the Board held that Marathon
had failed in the required proof of arbitrary or
unreasonable hardship.
On appeal, Marathon argued that the Board had
improperly rewritten the variance statute. According to
Marathon, the Board had effectively added a requirement
that a petitioner show that a violation of the existing
standard had occurred as a condition precedent to a grant.
Marathon also argued that it had proven that an arbitrary
or unreasonable hardship would occur if the variance
were denied. It averred that the record demonstrated that

continued compliance was virtually impossible and the
inevitable result of a denial would be a violation of the
chloride limitations. Further, Marathon argued that the
record indicated that no environmental harm would result
from the grant of a variance. The Agency responded on
appeal that the lack of a violation was but one factor
relied upon by the Board and that Marathon had failed in
its proof on the arbitrary or unreasonable hardship
standard.
The appellate court held that the Board's denial was
against the manifest weight of the evidence. The court
observed that the case law requires the Board to "balance
the hardship of continued compliance against the adverse
environmental impact the variance will have on the
environment" in making a variance determination.
Proving that compliance is difficult is insufficient; the
petitioner must demonstrate that the hardship of
compliance outweighs any injury through a grant.
Although the court had no problem with the Board
establishing a procedure whereby a petitioner must make
a
prima facie
showing of hardship, it stated that the
Board must move forward to balance hardship against
harm once the petitioner has done so. The court stated
that the Board had erred by specifically not reaching the
issue of environmental harm and by basing its finding of
a lack of a showing of arbitrary or unreasonable hardship
on Marathon's past compliance. The court noted that the
statutory language focuses on the future burden of
compliance, and not on past compliance. The Board had
not discounted the record testimony relating a virtual
certainty of future violation if the variance were denied.
In the court's opinion, the record was unrefuted in
indicating that the denial would face Marathon with the
future option of violating the chloride standard or slowing
or ceasing production. This was a sufficient threshold
showing of harm.
The court reversed the Board's denial and remanded
the case for further deliberations to balance the hardship
against any harm. The court could not complete its
analysis with regard to any arbitrary or unreasonable
hardship because the Board had specifically avoided any
finding with regard to environmental harm.

PUBLIC WATER SUPPLIES RESTRICTED STATUS
AND CRITICAL REVIEW LISTS
The Illinois Environmental Protection Agency,
Division of Public Water Supplies, Permit Section, is
publishing copies of the Division's Restricted Status and
Critical Review lists in this issue of the Environmental
Register. The lists are being published here as part of the
quarterly notification to the public. The lists have been
slightly modified to reflect changes made since the
previous publication.
"AIR POLLUTION" FILES ON THE BBS FOR
RAPID ACCESS TO PROPOSALS
The Board has added an "Air Pollution" Files area on
the BBS, to increase rapid public access to regulatory
proposals for certain air pollution proceedings conducted
pursuant to Section 28.5 of the Environmental Protection
Act. These proceedings must be completed within a very
short time frame, and public review and comment times
are limited. For this reason, they are called "fast track"
regulatory proposals.
The Board has chosen to place certain documents from
these proceedings on the BBS in electronic format.
Unfortunately, the text contains substantial formatting
codes such as underlining and strike-throughs. As a
result the files will only be uploaded in Wordperfect
format. No ASCII format files will be available. In
addition to the file name and file description, the Board
has left detailed file information about most files, which
you can read online. This detailed information shows up
as *Info* when you list the files. It can be read by using
the [I]nfo command and marking the appropriate file.
Some of these files are large and may take a long time to
download (over an hour at 2400 baud for some files; even
longer at 1200 baud).
The on-line files include two types. First are the Board
resolutions pertaining to the process for fast-track rules.
These are called RSXX-YY.WPF, where XX-YY refers
to the particular Resolution docket number. Where
multiple documents are adopted under one resolution
number, the suffix a, b, c, etc. is employed. For example
the first resolution is RS92-02a.wpf
The second type of on-line files are the actual
documents from the proceedings. For example, the first
proceeding was docket R92-21, which was filed on
11/13/92. The Board adopted the first notice order and it
is listed as R92-21N1.WPF. N1 or FN means first notice
and .WPF means a wordperfect file. In a similar
manner, the "Participants of Record" list (also called the
Service List) is R92-21PR.WPF. PLEASE NOTE, the
Participants of Record list changes over time. You must
make sure that you have the correct version for your
particular hearing. Hearing officer orders and notices are
called RXX-XXHY.WPF, where Y increments with each
successive order: R93-09H1.WPF, R93-09H2.WPF, etc.

On Tuesday, March 23, 1993 Board Member Bill S.
Forcade gave a speech, entitled "Environmental
Enforcement--From Beginning to End", to ARATEX
Services and ARA Services at the Woodfield Hilton Hotel
in Arlington Heights. ARATEX is America's largest
uniform service company, laundering items from a large
variety of industries subject to pollution control laws.
The meeting was attended by environmental and health
and safety professionals.

One Board member and various members of present
and past Board attorney staff will participate in an Illinois
State Bar Association seminar on environmental law on
May 12, 1993. Board member Ronald C. Flemal will

Chicago, and Mark P. Miller, presently of Tock &
Miller, P.C., Champaign, and present Board attorneys

THE BOARD HOLDS THAT IT LACKS
AUTHORITY TO GRANT A VARIANCE FROM
PERMIT CONDITIONS, PCB 92-179
On March 25, 1993, the Board granted a variance from
certain of the underground injection control regulations in
Cabot Corp. v. IEPA
(Mar. 25, 1993), PCB 92-179. In
the course of granting the variance from the regulation,
the Board denied a requested variance from certain
permit conditions for the petitioner's facility. The Board
relied on Illinois case law in holding that it lacked any
authority to grant a variance from permit conditions. The
Board noted that the petitioner must seek permit
modification from the Agency.

The Board issued its order in response to the parties'
March 15, 1993 joint motion for reconsideration. In
support of their motion, the parties contended, in part,
that the Board should vacate its dismissal order because
the Board failed to follow its own rules on continuances
and amendment of complaints and erred by entering the
order of dismissal with prejudice. The parties also
argued that the dismissal was in direct conflict with the
purpose of the Act and suggested that setting the case for
hearing would better served the interests of justice and
making cases proceed with due dispatch.
In vacating its prior order, the Board stated that it was
granting the parties' request because the parties had
submitted a signed stipulation and proposal for settlement
with their joint motion. The Board, however, was not
persuaded by the parties' arguments in favor of
reconsideration. Rather, the Board stated that it still
believed that dismissal of an enforcement case which had
nine scheduled hearings over seventeen months at which
the parties gave no substantive testimony or evidence was
justified and within the Board's authority.

Restricted Status List -- Public Water Supplies
The Restricted Status List was developed to give additional notification to officials of public water supplies which are in violation of 35
Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental Protection Act.
The Restricted Status List will include all Public Water Supplies for which the Agency has information indicating a violation of any of
the following requirements: Finished water quality requirements of 35 Ill. Adm. Code, Part 604, Subparts B and C; maintenance of
adequate pressure on all parts of the distribution system under all conditions of demand; meeting raw water quantity requirements of
35 Ill. Adm. Code 604.502; or maintenance of treatment facilities capable of providing water "assuredly adequate in quantity" as
required by Section 18 of the Illinois Environmental Protection Act.
A public water supply on the Restricted Status List will not be issued permits for water main extensions, except for certain limited
situations, or unless the supply has been granted a variance from the Illinois Pollution Control Board for the violation, or from permit
issuance requirements of Section 39 of the Act.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the status of any
public water supply should be directed to the Division of Public Water Supplies for final determination. This list reflects the status as of
April 1, 1993.

The Critical Review List was developed to give additional notification to officials of public water supplies which may be close to being
in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental Protection Act.
A supply will be placed on the Critical Review List when Agency records indicate that it is approaching any of the violations which
would place it on the Restricted Status List.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the status of any
public water supply should be directed to the Division of Public Water Supplies for final determination.
This list reflects the status as of April 1, 1993.

WATERWAYS CRUISE AND ENVIRONMENTAL WORKSHOP
EILEEN JOHNSTON and The LAKE MICHIGAN STATES SECTION of the AIR & WASTE
MANAGEMENT ASSOCIATION are co-sponsoring a waterways cruise and floating seminar on May 1,
1993. The floating seminar is planned to discuss areas of environmental concern and the progress made in
solving problems since the first Earth Day in 1970. Particpants will view the ever-changing and exciting
shoreline of Chicago and Northern Indiana. The cruise will pass huge complexes of steel mills, power
plants, treatment plants, foreign vessels loading and unloading products, barges, landfills, and the canyon
of skyscrapers as they return. The participants will view pictures of what the area looked like twenty years
ago when the pollution was unbelievable. They will then have an accounting of the environmental
progress made and what remains to be done.
Speakers will represent the Water Reclamation District of Greater Chicago, the Illinois Pollution
Control Board, the Illinois Department of Energy and Natural Resources, Illinois EPA, U.S. EPA, the
University of Illinois, and Acme Steel. What progress has been made? Can we eat the fish from the Lake?
How are regulations promulgated and enforced? The cruise demonstrates the environmental challenges
we face. It is a dramatic example of man's impact on the environment.
The cruise is on the Wendella and is 72 miles long. Participants meet at 8:45 a.m. at the foot of the
Wrigley Building, and return before 4 p.m. Parking facilities are located west of the building, allow time to
locate a space. Use public transportation if possible. Be prompt, don't miss the boat! Coffee and rolls are
served at boarding time and a box lunch at noon. Soft drinks are sold on board. Warm clothes and head
gear are in order. The cost is $55, $45 for full time students. Send checks to:
