NEW SOURCE REVIEW RULES PROPOSED FOR SECOND
NOTICE, R92-21
On March 11, 1993, the Board proposed for Second Notice
certain amendments to the air permitting rules that govern review
of major modifications or construction of air pollution sources in
Illinois. The proposal addresses construction and operation
permitting for new or modified major stationary sources in
nonattainment areas.
The proposal represents one segment of Illinois' ultimate
submittal of a complete State Implementation Plan (SIP) to the
U.S. Environmental Protection Agency. Pursuant to Section
182(a) of the Clean Air Act, as amended in 1990, Illinois was to
have adopted and submit its plan by November 15, 1992. The
Agency filed its rulemaking proposal on November 13 pursuant to
Section 28.5, the Board proposed the rules for First Notice on
November 19, and the proposal appeared in the
Illinois Register
on December 11, 1992.

The Board held public hearings on January 6 and February 5,
1993, and the Agency, several representatives of the regulated
community, and other interested persons participated--both at
hearing and through public comments. The Board observed that
there was agreement between the parties on major portions of
the proposed rules, and that the participants had negotiated the
changes from First Notice prior to final briefing. The Board
estimated that the impact of the federal CAAA-required
amendments embodied in the proposal on any particular source
could range from negligible to $6500.00 per ton of reductions for
offsets and controls, depending on the particular circumstances.
The Second Notice period will end on April 26, 1993, and the
Joint Committee on Administrative Rules (JCAR) will consider
the proposed amendments at its April 13 meeting. After the
Board receives a Certificate of No Objection from JCAR or the
Second Notice period ends, it will be free to adopt the proposed

STAY DENIED IN WATER TOXICS PROCEEDING;
ADDITIONAL HEARINGS SET, R92-8
By an order dated March 11, 1993, the Board denied a motion
for stay filed and joined by several representatives of the
regulated community. The Agency and the proponents opposed
the February 3 motion.
Several members of the regulated community sought to stay
the proceedings during the
pendency of an appeal to the Illinois
Supreme Court, in
Granite City Div. of National Steel Co. v.
PCB
, No. 72850, and until USEPA adopts guidance
implementing the Great Lakes Water Quality Initiative.
Granite
City Steel
is an appeal from the appellate court's affirmance of
the water toxics amendments made in dockets R88-21(A) and
R88-21(B)). The federal guidelines, which would necessitate the
states' adoption of water quality standards and procedures, was
due by Congressional mandate in June, 1992.
The Board found neither a sufficient basis for delay. The
appellate court has already affirmed the rules now under review
by the supreme court, and the issues on appeal involve only a
"mere fraction" of the rulemaking proposal in this proceeding. As
to the prospective adoption of federal guidance, the Board found
that the record indicated no time-frame for USEPA adoption.
Finding that the Board was "preempted" from regulating an area
also under federal scrutiny prior to the promulgation of the
federal action would "unacceptably delay resolution of Illinois
issues." The Board believed that the proponents should have an
opportunity to proceed and assemble a record in this matter.
The Board has set two additional hearings in this matter for
mid-April in Chicago. This is to allow the proponents

The Pollution Control Board operates an
electronic BBS at 312-814-1590. The BBS is available 24 hours a day, 7 days a week, to anyone with access to a computer and
a modem - there is no charge for access to the BBS. The best communications settings are 8 data bits (or data length 8), no
parity (or parity = none) and 1 stop bit, i.e., 8-N-1. The best terminal emulation is ANSI-BBS or just ANSI. The BBS contains
Board Agendas, Environmental Registers, Annual Reports, and various documents about the Board. You may download these

SUPPLEMENTAL REVISIONS TO RCRA UPDATE, R92-10
The Board issued a supplemental opinion and order on March
11, 1993 to make a minor correction to a certain provision in the
latest RCRA update, adopted January 21. The action was based
on informal communications between USEPA and Board staff.
Also based on that communication was reaffirmation of the
Board's approach to certain issues involved in adapting the
federal amendments involved in the update docket. For

BOARD IMPOSES SANCTIONS AGAINST
COUNSEL FOR DISREGARDING HEARING
OFFICER ORDER, PCB 92-156
In its January 21, 1993 order in
Citizens Against
Regional Landfill v. the County Board of Whiteside
County
, PCB 92-156, the Board granted a motion for
sanctions against the attorney for Citizen's Against
Regional Landfill (CARL) for failing to follow the
hearing officer's order and filing a brief not supported by
evidence. On March 11, 1993, the Board granted
reconsideration of the sanctions and affirmed that the
sanctions were appropriate considering the circumstances
involved in the proceeding.
Counsel for CARL had submitted a complete
deposition transcript to the Board and had extensively
referenced this transcript in his brief, despite a hearing
officer order to the effect that the hearing officer would
review the transcript and submit only a portion to the
Board. The Board found this attempt to circumvent the
hearing officer's ruling as warranting sanctions.
The Board also reviewed the billing statement
submitted by Waste Management and determined that the
amount of the statement should be reduced. The Board
found that the amount of time specified for preparing the
reply brief was not reasonable compared to the time
required to prepare the motion to strike. The Board also
found that the billing statement was not specific enough
for the Board to determine the exact relationship between
some of the listed services and the motion to strike. The
Board ordered the attorney for CARL to pay sanctions in
the amount of $2697.50 within 30 days of the order.

The Board has recently made two additions to the
electronic bulletin board system (BBS). These are the
creation of two new files: "Procedural Matters",
presently containing the full text of the Board's
procedural rules, and "General Information", presently
containing certain aids for citizens seeking to enforce the
Environmental Protection Act before the Board.
First, as to the files section called "Procedural
Matters", see Files Section 12. This section contains the
full text of the Board's procedural rules. The procedural
rules files are broken down by regulatory part, and
include: Part101.wpf (General Provisions), Part102.wpf
(Regulatory Proceedings), Part103.wpf (Enforcement),
Part104.wpf (Variances), Part105.wpf (Permit Appeals),
Part106.wpf (Hearings pursuant to Specific Rules),
Part107.wpf (Repealed), Part120.wpf (Trade Secrets),
and PROC-TOC.wpf (a table of contents file for all the
procedural rules). The official version of the Board's
procedural rules is maintained at the office of the
Secretary of State. The Board is not responsible for any
errors or omissions contained in this electronic version.
Second, as to the information placed to help citizens in
enforcement actions, see Files Section 1, "General
Information". This now includes the file
ENFORCE.WPF, the information letter sent by the Clerk
of the Board to any citizen interested in filing a formal or
informal citizen complaint. The letter describes
generally the citizen enforcement process and includes
the up to date list of pro bono attorneys who may be
willing to represent citizens without charge before the
Board. In the future, the Board may add additional
public participation information to this section of the
BBS.

During January 1993, Board Member Dr. G. Tanner
Girard gave evening and Saturday slide presentations on
Illinois Bald Eagles to three different community groups
in the Alton area. Prior to his Board appointment, Dr.
Girard conducted field research on Bald Eagles in Illinois
and Florida.
Dr. Girard has also accepted an invitation to provide
pro bono
consultation to the National Commission for the
Environment of Guatemala. In that capacity, Dr. Girard
will be consulting with Commissioner Michael Dix on
setting regulatory priorities for the handling of toxic
wastes in Guatemala. Dr. Girard was a visiting professor
in Guatemala in summer 1988.
