DRINKING WATER LEAD AND COPPER, PHASE IIB
AMENDMENTS PROPOSED, R92-3
On February 4, 1993, the Board proposed amendments to the
SDWA drinking water rules that would incorporate major federal
amendments that occurred between June 1 and December 31,
1991. These amendments included incorporation of a new
program for regulating lead and copper in drinking water and the
addition of maximum contaminant levels (MCLs) for five new
chemical contaminants: barium, aldicarb, aldicarb sulfone,
aldicarb sulfoxide, and pentachlorophenol. The Board will accept
public comments on the proposal for 45 days after a Notice of
Proposed Amendments appears in the
Illinois Register
.
The lead and copper amendments would immediately impose
an obligation for water suppliers to select a pool of consumer
taps for monitoring and require the suppliers to obtain samples
for testing. If a sufficient number of taps contain lead or above a
certain level, the rules could then require the suppliers to engage
in various remedial actions, including public education, corrosion
control treatment, source water treatment, and removal of lead
service lines.
The Phase IIB rules would add five new MCLs to an existing
scheme of drinking water monitoring and testing. The federal
EPA has stayed the MCLs for the three aldicarbs, and the
Board's proposal similarly stays their effectiveness, but suppliers
would still be required to commence monitoring and testing for
them.

THE AGENCY MUST ANSWER QUESTIONS AT THE
SECOND CAAA HEARING; MISREADING A DATE IN A
BOARD ORDER IS NOT "GOOD CAUSE" THAT WOULD
ALLOW A WAIVER OF THE STATUTORY FILING DEADLINE,

On January 21, 1993, the Board upheld a hearing officer order
that required the Agency to answer questions at the second
hearing in the New Source Review rules docket, R92-21. The
Agency challenged the hearing officer's order, arguing that
requiring the Agency to answer questions at the second hearing
was beyond the scope of new Section 28.5 of the Act (P.A. 87-
1213, §50, 1992 Ill. Legis. Serv. (West) 3223, 3233). This states
that in Clean Air Act Amendments (CAAA) proceedings the first
day of hearings is "confined to" the Agency presentation, and the
second day is "devoted to" presentation by "affected entities and
all other interested parties" (Section 28.5(g)(2)). The Agency
maintained that this language did not allow its participation by
subjecting its primary witness to questions at the second hearing,
as ordered by the hearing officer.
The Illinois Environmental Regulatory Group, the Steel Group,
and Stepan Chemical Company all filed responses in support of
the hearing officer's ruling. These groups essentially argued that
the Agency position was an extreme interpretation of language of
Section 28.5. They argued that adhering to the Agency position
could possibly slow down the Section 28.5 rulemaking process,
which the General Assembly intended for expedited adoption of
CAAA rules.
In affirming the hearing officer order, the Board determined
that reading Section 28.5 to allow questions at a second hearing
would ensure the development of a complete record. The Board
also felt it would comport with the legislative goal of fast-paced
rulemaking. Thus, the Board held that the Agency must make its
principal supporting witness available at the second day of
hearing for questioning by the regulated community.

On February 4, 1993, the Board denied a waiver of the Section
28.5 filing requirements because a misreading of a Board order
"does not rise to the level of 'good cause'", as intended by
Section 28.5(g). The Chicago Lung Association and the Illinois
Chapter of the Sierra Club had requested the waiver because it
had not presubmitted its hearing testimony at least 10 days
before hearing, as required by the statute. The Lung Association
and Sierra Club had submitted their testimony 10 days prior to
the date set forth in a Board order for the last possible date for
hearing (a Saturday), which was only nine days prior to the actual
date for hearing (a Friday). The Board cited its long-standing
practice of setting hearing dates by hearing officer order rather
than by Board order and the fact that the Board order only set
forth the last date allowed by law, rather than the actual hearing
date. The Board stated that the Lung Association and Sierra
Club could testify, despite the denial of prefiling, as time allowed
at the end of hearing.
After the public hearing of February 5, the hearing officer
cancelled the third hearing after the Agency indicated it did not
intend to present any additional material. That hearing was
scheduled for February 19, in Chicago.
UIC UPDATE ADOPTED, R92-13
On February 4, 1993, the Board adopted a final opinion and
order in the UIC Update, R92-13. This docket included
amendments to the USEPA rules that appeared in the Federal
Register between January 1 and June 30, 1992. This docket
included the most recent corrections to USEPA's "third-third" land
disposal restrictions. This included an exemption for injection of
diluted hazardous waste, which is the subject of pending federal
litigation, in Chemical Waste Management v. USEPA (D.C. Cir.
1992), 976 F.2d 2. This litigation may result in the repeal or
modification of the federal restriction at 40 CFR 148.1(d), from
which Illinois Section 738.101(d) derives. The Board added a
Board note referencing the federal court decision, stating that the
Board views any federal court decision on the effectiveness or
enforceability of the USEPA rule as binding with regard to this
subsection.
Although USEPA approved use of the water-brine interface
mechanical integrity test during this period, no rule change
resulted. Existing Section 730.108(d) provides for Agency
approval of alternative tests of mechanical integrity. Anyone
wanting to use the water-brine interface test in Illinois can apply
to the Agency for approval. Therefore, Board action on this test
was unnecessary.
The Board will not file the rules until after March 5, 1993, to
allow time for post-adoption comments from the agencies
involved in the authorization process. Direct questions to Morton

UST UPDATE DISMISSED, R93-5
On February 4, 1993, the Board dismissed R93-5, a Docket
reserved for updating the UST (underground storage tank) rules.
This update covered USEPA actions during the period July 1
through December 30, 1992. No USEPA actions requiring Board
action occurred during that time. Therefore, the Board dismissed

UNO-VEN SITE-SPECIFIC RULEMAKING PETITION
ACCEPTED, R93-8
On February 4, 1993, the Board accepted a petition filed by
UNO-VEN for a site-specific rule. In the petition, UNO-VEN
seeks to amend 35 Ill. Adm. Code 304.213 for its wastewater
treatment at its Lemont refinery. The proposed changes would
amend the existing ammonia nitrogen site-specific discharge
limitations applicable to Union Oil as follows: 1) They would
reflect the change in ownership of the refinery from Union Oil of
California to UNO-VEN; 2) they would add a concentration-based
limitation for ammonia nitrogen on a monthly basis; 3) they would
require reporting on nitrogen in feedstock within 60 days after the
end of the calendar year; and 4) they would extend the expiration
date for the site-specific rule from December 31, 1993 until
December 31, 2001. UNO-VEN currently discharges to the
Chicago Sanitary and Ship Canal, a tributary of the Illinois River.

UPCOMING PUBLIC AFFAIRS AWARD LECTURE
A Public Affairs Award lecture titled "Odyssey of a
Scientist" will be given by Dr. Walter C. McCrone at the
March 19th meeting of the Chicago Section of the,
American Chemical Society. The lecture will highlight
the use of the light microscope in the identification of
various forms of asbestos, particles and fibers in air
samples and materials from a variety of other
environments. The techniques developed by Dr.
McCrone have been adapted for use in environmental,
forensic and industrial laboratories as well as museums.
The lecture will be presented at 8:00 p.m. at the Como
Inn, 546 Milwaukee Ave., Chicago. For additional

UPCOMING ANNUAL ILLINOIS WASTEWATER
OPERATORS CONFERENCE
The Illinois Association of Water Pollution Control
Operators (IAWPCO) will hold it's Annual Conference
April 19-22, 1993 at the Holiday Inn East Exhibition and
Convention Center, Springfield, Illinois. The 3½ day
conference includes a 2½ day technical program and
emphasis on wastewater treatment plant operations and
maintenance, a first day wastewater treatment plant
operation workshop, an equipment exhibition, a spouse's
program, and the IAWPCO plant and operator-of-the-
year awards.

Chicago and sponsored by the Lake Michigan States
Section of the Air & Waste Management Association,
considered such topics as pollution prevention, regional
environmental issues, liability concerns, pending state
and federal regulations, and environmental auditing. The
speakers included state and federal regulators, practicing
attorneys, consulting engineers, and Bob Kustra, Lt.
Governor of Illinois.

RESTRICTED STATUS LIST
In order to comply with 35 Illinois Administrative Code Section 306.401 Illinois Pollution Control Board Regulations, the Illinois EPA has
prepared the following list of facilities which are on Restricted Status. Restricted Status is defined as the Agency determination that a
sewer or lift station has reached hydraulic capacity or that a sewage treatment plant has reached design capacity, such that additional
sewer connection permits may no longer be issued without causing a violation of the Act or Regulations. Please note that the list is
continually being revised to reflect the current situation. Therefore, if you have any questions on the capability of a treatment facility or
transport system, please contact this Agency for a final determination. This listing reflects the status as of December 31, 1992.
Facility names followed by an asterisk (*) indicates that construction is underway to ultimately alleviate problems which resulted in
imposition of Restricted Status. Facilities followed by a double asterisk (**) are additions to the list.
