NEW ON BBS: "AIR POLLUTION" SECTION AND REGULATORY STATUS
The Board has added two new items to the electronic bulletin board: the text of "fast track" Clean Air Act regulatory
proposals and a listing of the status of all rulemaking proceedings presently pending.
Text of Clean Air Act Regulatory Proposals
The recent signing of the Pollution Prevention Act has created a new "fast track" air pollution rulemaking procedure at
the Board, under new Section 28.5. This new procedure reduces the time for evaluation of the proposed regulatory
language, which places greater emphasis on prompt public distribution of the regulatory text. To improve the prompt
distribution of information, the Board has opened a new File Section and Conference on BBS called "Air Pollution."
In the "Air Pollution" File Section and Conference, the Board will place the full text of regulatory proposals adopted
for first notice. Because these documents contain strike-through and underscore notations, only the Wordperfect 5.1 file
will be available; it will not be possible to keep an ASCII file.
The first file, "R92-21N1.WPF", is now available. It is the New Source Review (docket R92-21) First Notice (N1)
proposed regulatory text, in Wordperfect 5.1 format (WPF). The BBS will use this same notational format for future
regulatory filings. The New Source Review docket is the Agency's proposal to modify the New Source Rules.
The Board plans to add new information in this File Section in the future. Such anticipated additional information may
include the "Participants of Record" listing, as well as on-line readable summaries of the regulatory proposal. We hope
the availability of this information on BBS is useful to users.
Regulatory Status Sheet
Another new file on BBS appears in file Area #1 - General Information. This file, the Regulatory Status Sheet
(REG-STAT.WPF), is a listing of all pending regulatory dockets at the Board including a brief description and status. It
appears in Wordperfect 5.1 format.

RULEMAKING UPDATE
SDWA UPDATES DISMISSED, R91-15 & R92-12
On December 3, 1992, the Board dismissed Safe Drinking
Water Act update dockets R91-15 and R92-12 because no
federal amendments occurred during the periods covered.
Formerly, docket R91-15 included the federal Lead and Copper
rules, adopted by USEPA on June 7, 1991. However, the Board
adjusted the time-frame of docket R92-3 to cover the period from
June 1 through December 31, 1991. No federal amendments
occurred in the changed time-frame of docket R91-15, between
February 1 and May 31, 1991. The Board adopted amendments
in docket R91-3 based on the federal only amendments that
occurred between January 1 and June 30, 1992, the time-frame
of R92-12. With no federal amendments outstanding for this
period, the Board dismissed R92-12 also. Direct questions to

The Pollution Control Board
operates an electronic BBS at 312-814-1590. The BBS is available 24 hours a day, 7 days a week, to anyone with
access to a computer and a modem - there is no charge for access to the BBS. The best communications settings are 8
data bits (or data length 8), no parity (or parity = none) and 1 stop bit, i.e., 8-N-1. The best terminal emulation is ANSI-
BBS or just ANSI. The BBS contains Board Agendas, Environmental Registers, Annual Reports, and various documents
about the Board. You may download these documents to your computer. For additional information contact Bill Forcade

SUBSCRIPTION SERVICE OF BOARD OPINIONS AND ORDERS.
The subscription service comprises all the Opinions
and Orders issued by the Pollution Control Board in a fiscal year (July 1 through June 30). The Board meets
approximately twice monthly in order to issue Opinions and Orders.. Usually no later than the end of each month, a
volume is issued containing the Opinions and Orders of the Board from the preceding month.

MEDICAL WASTE RULES PROPOSED, R91-20
On December 3, 1992, the Board proposed regulations for the
treatment, storage, and transfer of potentially infectious medical
waste (PIMW) and standards for the transportation, packaging,
and labeling of PIMW. The First Notice proposed amendments
closely follow the recommendations of the Governor's Medical
Waste Tracking Study Group, as that group's consensus
recommendations have been presented to the Board in the
proposal submitted by the Illinois Environmental Protection
Agency (Agency). The few substantive departures from that
proposal are identified and discussed in the Board's opinion.
Pursuant to the Illinois Administrative Procedure Act, a 45-day
public comment period will commence upon publication of a
Notice of Proposed Amendments in the
Illinois Register
.
Persons interested in submitting public comments on this
proposal, or in responding to inquiries posed by the Board in its
opinion, should submit written filings to the Clerk of the Board
prior to the expiration of the 45-day comment period: Clerk of

DEADLINE EXTENDED FOR SDWA UPDATE, R92-3
On December 3, 1992, the Board entered an order that
extended the deadline in Safe Drinking Water Act update docket
R92-3. The Board adjusted the time-frame of this docket to
include federal amendments occurring in June, 1991. At present,
this docket includes the federal Lead and Copper rules, adopted
by USEPA on June 7, 1991, and segments of the federal Phase
IIB rules not adopted in docket R91-3, adopted by USEPA on
July 1, 1991. The Board cited the delays in adoption of the R91-
3 federal Phase II and coliform rules and the recent receipt of
federal guidance documents as the reasons for the delay in this
rulemaking. The Board estimated that it will have a proposal for
public comment in February and will adopt rules based on the
federal amendments in early June, 1993. Direct questions to

deadline for the recent state contingency plan (CERCLA or
"Superfund") rules update docket, R92-18. The Board opened
this Docket on October 1, 1992 for the purpose of updating the
State contingency plan rules. Those rules, derived from
corresponding federal regulations, address spills of hazardous
materials and prioritization of remediation projects to be funded
by the State. The Board has begun developing a proposal to
update the rules and anticipates completion by April 1, 1993.
Two significant recent events necessitate revision of the state
contingency plan rules. The Board adopted the Illinois CERCLA
rules in June, 1984, in docket R84-5. USEPA significantly
amended its CERCLA rules in March, 1990, completely
replacing the prior rules. Further, the R84-5 rules required the
Agency to adopt the State Remedial Action Priorities List
("SRAPL") by rulemaking. Recently, an appellate court held that
the Agency had no authority to adopt its SRAPL rules. (States
Land Improvement Corp. v. IEPA (June 25, 1992), 231 Ill. App.
3d 842, 596 N.E.2d 1164 (4th Dist.).) Refer questions to Morton

BOARD OPEN HOUSE A SUCCESS
The Board hosted an after-hours open house at its
Chicago offices on November 20, 1992. Board members
and staff provided food and refreshments. Over 200
persons attended, including persons from government and
industry.
UPCOMING AUTOMOBILE EMISSIONS
LECTURE
A lecture titled "The Science and Politics of
Automobile Emissions" will be given by Dr. Donald H.
Stedman of the University of Denver at the January 22
meeting of the Chicago Section of the American
Chemical Society. The lecture will be presented at 8:00
p.m. at the Holiday Inn North Shore, 5300 Touhy
Avenue, Skokie, Illinois. For further information contact

On Tuesday, December 1, 1992, Board Member Bill
Forcade spoke to the Environmental Law Committee of
the Chicago Bar Association on upcoming regulatory
matters under the Clean Air Act, and utilization of the
Board's electronic Bulletin Board System (BBS).
BOARD ATTORNEY ADDRESSES AGRICULTURE
On October 26, 1992, Phil Van Ness, the Board's
Intergovernmental Affairs Attorney, addressed members
of the Growmark Environmental & Regulatory Services
Division, in Bloomington. Growmark is affiliated with
Farm Bureau in Illinois.

The Board continually receives calls from persons
asking questions. Many of the questions are dealt with
by the Clerk's office, but each business day one of the
attorney staff is designated as the primary recipient of
those calls the Clerk's office cannot answer.
The subject matters of the questions frequently range
from the status of rulemakings and contested cases
pending before the Board to dates of hearings and
procedural and regulatory questions. Board staff is
usually able to promptly provide the requested
information or to send copies of orders or rules
containing the information. (Reprints of Board
regulations are often available. There is no charge for
the first copy of Board opinions and orders; all
subsequent copies are billed at 25ยข per page.)
Board staff is generally free to answer questions as they
arise. If the staff person receiving a call cannot answer a
question, he or she may redirect the call to someone
more able to do so.

BOARD ESTABLISHES CLEAN AIR ACT
RULEMAKING MASTER LIST
As noted above, the legislature recently added new
fast-track Clean Air Act Amendment (CAAA)
rulemaking procedures to the Environmental Protection
Act, at Section 28.5. (P.A. 87-1213, effective
September 26, 1992.) These fast-track procedures
establish specific, and very tight, deadlines for action on
CAAA rulemaking proposals filed with the Board by the
Illinois Environmental Protection Agency. One of those
deadlines requires the Board, within 14 days of receipt of
a proposal, to file a proposed rule for first notice,
schedule all hearings, and cause public notice to be
given. So that the Board will be prepared to send its first
notice opinion and order to all those who might be
interested in a specific proceeding, the Board is now
establishing a CAAA "master list". As discussed in RES
92-2, this master list, along with any additional names
provided by the Agency from their outreach list for a
specific proposal, will serve as the initial notice list for
mailing the Board's first notice opinion and order and
hearing notice. This first mailing will also include a
coupon requiring those who want to continue to be
included on the notice list for that individual proposal to
return the coupon to the Board within a specified time.
Those interested in CAAA rulemakings should return
the coupon below for inclusion on the CAAA master list.
