CROSS-CONNECTION STANDARDS PROPOSED FOR FIRST
NOTICE, R87-37
On October 1, 1992, the Board proposed for First Notice
standards for the placement of cross-connection control devices.
Under the proposed rules, control devices will be required at
connections where non-potable water or chemicals might enter
the public water supply distribution system. Single-family
dwellings and multi-family dwellings that do not contain fire
safety systems will be exempt from the requirements. The Board
is accepting comment on the proposal until December 1, 1992.

GENERAL MOTORS SITE-SPECIFIC CARBON MONOXIDE
STANDARD ADOPTED, R90-23
On October 1, 1992, the Board adopted a site specific rule for
the carbon monoxide emissions from the General Motors ferrous
foundry located in Vermilion County. The regulation imposes a
CO limitation of 2,000 ppm on emissions from the foundry. The
present state-wide standard is 200 ppm on CO emissions from

COMMENTS SOUGHT ON TOXIC AIR CONTAMINANTS
(STYRENE), R90-1(D)
On October 1, 1992 the Board requested comments in docket
R90-1(D), the Toxic Air Contaminants List, Styrene proceeding.
The Board requested that all parties interested in the Styrene
proceedings submit any additional comments by November 2,
1992. The Board made it clear that the Board intends to make a
decision in the near future. Additionally, the Board incorporated
the record in R90-1(A) by reference. The Order established that
following the close of the comment period, the Board will issue
an Opinion and Order which will determine either to propose a
listing for styrene for First Notice or to dismiss the docket. The
Board did not anticipate extending the present comment period
beyond November 2, 1992, and it encouraged participants to
timely file any comments before the Board takes its next action in

AMENDMENTS TO LANDFILL REGULATIONS PROPOSED
FOR FIRST NOTICE, R92-19
On October 1, 1992, the Board proposed for First Notice
amendments to Parts 811 and 813 of the landfill regulations to
delete requirements for monitoring toxic air contaminants. In
Waste Management of Illinois, Inc. v. PCB, 231 Ill. App. 3d 278,
595 N.E.2d 1171 (1st Dist.1992), the First District appellate court
invalidated segments of the landfill regulations adopted in 1990.

.) In response, the
Board opened this docket to repeal those segments held invalid.
These include the Section 811.310(d)(1)(F) and 813.106(b)
references to the list of toxic air contaminants, which effectively
require a landfill owner or operator to monitor for those

the Agency lacked the express or implicit authority to
promulgate the State Remedial Action Priority List
(SRAPL), 35 Ill. Adm. Code 860.210. The Agency had
evaluated a parcel owned by States Land and determined
that the site warranted the number one position on the
list. On writ of
certiorari
the court held that the listing
"has elements of permanence and finality", and the
Agency had no authority to issue the list.

AND CRITICAL REVIEW LISTS
The Illinois Environmental Protection Agency,
Division of Public Water Supplies, Permit Section, is
publishing copies of the Division's Restricted Status and
Critical Review lists in this issue of the Environmental
Register. The lists are being published here as part of the
quarterly notification to the public. The lists have been
slightly modified to reflect changes made since the
previous publication.

Restricted Status List -- Public Water Supplies
The Restricted Status List was developed to give additional notification to officials of public water supplies which are in violation of 35 Ill.
Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental Protection Act.
The Restricted Status List will include all Public Water Supplies for which the Agency has information indicating a violation of any of the
following requirements: finished water quality requirements of 35 Ill. Adm. Code, Part 604, Subparts B and C; maintenance of adequate
pressure on all parts of the distribution system under all conditions of demand; meeting raw water quantity requirements of 35 Ill. Adm.
Code 604.502; or maintenance of treatment facilities capable of providing water "assuredly adequate in quantity" as required by Section
18 of the Illinois Environmental Protection Act.

A public water supply on the Restricted Status List will not be issued permits for water main extensions, except for certain limited
situations, or unless the supply has been granted a variance from the Illinois Pollution Control Board for the violation, or from permit
issuance requirements of Section 39 of the Act.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the status of any public
water supply should be directed to the Division of Public Water Supplies for final determination. This list reflects the status as of October
1, 1992.

Critical Review List -- Public Water Supplies
October, 1992
The Critical Review List was developed to give additional notification to officials of public water supplies which may be close to being in
violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental Protection Act.
A supply will be placed on the Critical Review List when Agency records indicate that it is approaching any of the violations which would
place it on the Restricted Status List.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the status of any public
water supply should be directed to the Division of Public Water Supplies for final determination.
This list reflects the status as of October 1, 1992.
Indicates public water supplies which have been added to the list since the previous publication.
Indicates actions are being taken by officials to bring the public water supply into compliance.
