BOARD ADOPTS REVISIONS TO TIRE
MANAGEMENT STANDARDS, R90-9(B)
On February 6, 1992, the Board voted (6-0) to
adopt amendments to "Management of Used and Waste
Tires" (35 Ill. Adm. Code 848) and to repeal "old"
management standards set out at 35 Ill. Adm. Code 849.
The amendments clarify exemptions for certain tire
retreading, stamping and die cutting facilities and for
sites with tire removal agreements. The amendments
also revise the applicability of tire management
standards. Businesses which may be affected include
those involved in the storage, transportation, disposal and
processing of used and waste tires. The amendments
were published in the Illinois Register, 16 Ill. Reg. 3114,
effective February 14, 1992.

BOARD ADOPTS FINAL NOTICE FOR DIESEL
OPACITY, R90-20
On February 27, 1992, the Board adopted the
final notice in Diesel Vehicle Exhaust Limits (R90-20).
This rulemaking will set limits for diesel opacity for
heavy-duty powered vehicles operating in the state of
Illinois. The Board has set a standard of 40% peak
opacity in 1991 and later model year vehicles and 55%
opacity in all other vehicles. The Board made no
substantive changes in the rule from second notice to the
final notice. Questions concerning this rulemaking

BOARD SENDS STAGE II GASOLINE VAPOR
RECOVERY RULES TO FIRST NOTICE, R91-30
On February 27, 1992, the Board sent the
Agency's proposal to first notice. The proposed rules are
intended to regulate the installation and operation of
systems for gasoline vapor recovery of emissions from
the fueling of motor vehicles. Pursuant to Section
182(b)(3) of the Clean Air Act, as amended in 1990
(CAAA), Illinois is to submit these regulations as a
revision to its state implementation plan (SIP) by
November 15, 1992. This proposal is directed at both
Illinois non-attainment areas. These include the Chicago
area counties of Cook, DuPage, Kane, Lake, McHenry,
and Will, as well as Oswego township in Kendall County
and Aux Sable and Goose Lake Townships in Grundy
County; and the Metro-East area, consisting of Madison,
Monroe, and St. Clair Counties.
Also in this docket, the Board is proposing non-
substantive changes to Section 215.123 involving the
form of the incorporation by reference. Although not
part of the Agency's proposal, the Board stated that this
docket serves as a means to make that section conform to
current requirements.
The Board emphasized that in sending this
proposal to first notice, it adopts no substantive position
on the merits of the proposal. The Board believes that
publishing the proposal at this time will maximize the
opportunity for public comment on the proposal, and
allow for greater opportunity for amendments to be
adopted within the CAAA deadline.

BOARD CONSOLIDATES DOCKETS IN MEDICAL
WASTE PROPOSED RULE PROCEEDINGS
On February 27, 1992, the Board consolidated
dockets R91-20, (dealing with treatment, storage, and
transfer facilities), with Board docket R91-21 (dealing
with transportation, packaging, and labeling). The Board
stated that the consolidation is necessary due to the
overlap of issues in the two proceedings, and is in the
interest of administrative economy. The Board
accomplished the consolidation by closing the R91-21
docket, and incorporating the material from that docket
into docket R91-20. To reflect the action, the title to
docket R91-20 was changed to

R91-20, POTENTIALLY INFECTION
MEDICAL WASTE (PIMW):
TREATMENT, STORAGE AND

BOARD ACCEPTS PROPOSAL IN THE RACT
EXPANSION FOR THE CHICAGO AREA
PROCEEDING, HEARING SET, R91-28
On February 27, 1992, the Board accepted for
hearing the Illinois Environmental Protection Agency's
(Agency) proposal in this docket. The proposal is
intended to expand the geographical applicability of
reasonably available control technology (RACT)
regulations to certain stationary sources of volatile
organic material (VOM) in Goose Lake and Aux Sable
Townships in Grundy County, Illinois, and to Oswego
Township in Kendall County, Illinois. On July 25, 1991,
the Board adopted revisions to the State implementation
plan (SIP) to make it consistent with the existing Federal
implementation plan (FIP) (Board docket R91-8). The
revised SIP contains a complete set of RACT regulations
applying to stationary VOM sources located in the six
Chicago area counties of Cook, Lake, DuPage, Kane,
McHenry, and Will. However, the RACT regulations do
not include Aux Sable and Goose Lake Townships in
Grundy County and Oswego Township in Kendall
County. The Agency believes that because these
townships have now been included within the Chicago
area boundaries designated by USEPA as nonattainment
for ozone, they also must be included in the SIP.
Pursuant to a provision of the Clean Air Act
Amendments (CAAA)(42 USC ยง7511a(c) and a(b)(2)),
Illinois is to submit regulations changing the applicability
of parts 215 and 218 as a revision to its SIP by November
15, 1992.
After a review of the proposal, the Board found
that the proposal substantially meets the requirements of
the Environmental Protection Act (Act) (Ill.Rev.Stat.
1991, ch. 111 1/2, par. 1001 et. seq) and the Board's
procedural rules. The Board also noted that the Agency
certified, pursuant to Section 28.2 of the Act, that this
rule is federally required. The Board accepted that
certification.

BOARD PROPOSES EXTENSION OF
EXEMPTIONS FROM THE DEFINITION OF VOM
TO INCLUDE ALL SOURCES IN THE CHICAGO
METROPOLITAN AND METRO EAST ST. LOUIS
AREAS, R91-24
In R91-24, the Board proposed updates to various
provisions of Parts 203, 211, 215, 218, and 219 to reflect
the most recent pronouncement of USEPA's
"Recommended Policy on the Control of Volatile
Organic Compounds." In effect, this docket completes
the amendments effected in R91-10, effective October
11, 1991. In that proceeding on September 12, 1991, the
Board amended the Part 211 and 215 rules in response to
USEPA additions to the list of chemicals exempted from
the definition of volatile organic materials (VOMs).
Unaffected by the R91-10 rulemaking were the definition
of "volatile organic compound" at 35 Ill. Adm. Code
203.145 and the definitions of "volatile organic material"
at recently-adopted Sections 218.104 and 219.104. Part
203 sets forth the rules applicable to construction and
modification of major stationary sources. Part 218
governs emissions of volatile organic material from
stationary sources located in the Chicago metropolitan
area. Part 219 governs the emissions of volatile organic
material from stationary sources located in the
metropolitan East St. Louis area. R91-24 extends the
exemption to include all federally-exempted compounds
for all organic emissions from stationary sources in
Illinois.
