BOARD SENDS USED AND WASTE TIRE
PROPOSAL TO SECOND NOTICE, R90-9B
On December 19, 1991 the Board voted (7-0) to
send refinements to the management standards for Used
and Waste Tires, Docket R90-9B, to second notice
review by the Joint Committee on Administrative Rules
(JCAR). The proposed rules repeal the present scrap tire
management standards (35 Ill. Adm. Code 849) and set
out certain exemptions for tire retreading facilities, tire
stamping and die cutting facilities and for site with tire
removal agreements with the Illinois Environmental
Protection Agency. The review period by JCAR expires
45 days from date of receipt.

BOARD ADOPTS SECOND NOTICE FOR DIESEL
OPACITY, R90-20
On November 27, 1991, the Board adopted a
second notice in Diesel Vehicle Exhaust Limits (R90-20).
The Board adopted a Supplemental Opinion and Order
on December 19, 1991. This rulemaking will set limits
for diesel opacity for heavy-duty powered vehicles
operating in the state of Illinois. The Board has set a
standard of 40% peak opacity in 1991 and later model
year vehicles and 55% opacity in all other vehicles. The
rulemaking will be submitted to the Joint Committee on
Administrative Rules for its review pursuant to the
Illinois Administrative Procedure Act. Questions

BOARD ADOPTS SECOND NOTICE FOR DMI
SITE SPECIFIC, R91-9
On January 9, 1992, the Board adopted a second
notice in R91-9, DMI site specific regulation 35 Ill.
Adm. Code 215.215. The regulation set the allowable
emission rate for volatile organic materials emitted from
DMI's paint deck operations at a daily average of 4.2
lb/gal in the dip top coat application tank, and a 30-day
rolling-average of 61 lb/day for the dip tank make-up
solvent addition. The rulemaking will be submitted to
the Joint Committee on Administrative Rules for its
review pursuant to the Illinois Administrative Procedure

BOARD DETERMINES ECONOMIC IMPACT
STUDY NOT NECESSARY IN PM-10, R91-35
The Board determined at its January 9, 1992,
meeting that an Economic Impact Study (EcIs) was not
necessary at this time in the statewide PM-10 regulation,
R91-35. The Board's action was taken after considering
comments by the Illinois Environmental Protection
Agency and the Department of Energy and Natural
Resources that an EcIs was not necessary in this
rulemaking at this time. The Board had previously
(December 19, 1991) proceeded to first notice with this
proposal.
BOARD AUTHORIZES FURTHER HEARINGS IN
CALIFORNIA MOTOR VEHICLE PROCEEDING,
R89-17(C)
On January 9, 1992, the Board authorized further
hearings in the California Motor Vehicle proceeding
(R89-17(C)). The Board has proposed, for second first
notice, rules which would adopt the California Low
Emission Vehicle (LEV) program in Illinois. Those
proposed rules were published in the Illinois Register on
December 13, 1991, at 15 Ill.Reg. 17863. In its second
first notice order, the Board established a comment
period (until December 31, 1991) to allow interested
persons to comment on the need for additional hearings.
The Board received a number of comments. All
commenters, except one, believe that further hearings are
necessary. The Board agrees that further merit and
economic impact hearings should be held, and directed
the hearing officer to schedule hearings.
Additionally, several commenters asked the Board
to formally request that the Department of Energy and
Natural Resources (ENR) prepare an economic impact
study (EcIS) on the proposal. The Board noted that it
asked ENR to prepare an EcIS on the first two proposals
in this docket (R89-17(A) & (B)), and that ENR
subsequently filed a two page "economic impact
statement". The Board found nothing in the
Environmental Protection Act or Board regulations which
require it to make more than one EcIS determination in a
regulatory proceeding. However, the Board noted that
the Act and the regulations allow the Board to reconsider
its prior determination. Therefore, the Board considered
the recent requests that an EcIS be prepared. The Board
agreed that some economic questions are unanswered, but
declined to request the preparation of an EcIS. The
Board noted that the record already contains some
information on economic questions, and that both the
Illinois Environmental Protection Agency and ENR have
committed to provide additional economic analysis. The
Board found that the economic questions can be readily
explored through the hearing process and written
comments. The Board directed the hearing officer to
schedule at least one hearing solely on the subject of

economic impact.
Hearings on this proceeding have not yet been

BOARD FINDS EXTENSION OF TIME NEEDED
FOR SDWA, RCRA, AND UST UPDATES, R91-3,
R91-13, AND R91-14
Pursuant to Section 7.2(b) of the Act, the Board
found at its January 9, 1992 meeting that an extension of
time was needed to complete adoption of identical in
substance rulemakings for SDWA, RCRA, and UST
regulations. Copies of the orders may be obtained from

RECYCLED PAPER REQUIREMENT EFFECTIVE
The Board's new recycled paper requirement went
into effect on January 1, 1992. The new rule (35
Ill.Adm.Code 101.103(d)) requires that all documents,
excluding exhibits, filed with the Board by attorneys or
organized environmental and trade groups be submitted
on recycled paper. In addition to the exemption for
exhibits, the rule excludes stationery, such as letterhead,
from the
recycled paper requirement when the stationery is used
for cover letters or similar purposes.
The Board has received a number of calls
questioning the requirement that recycled paper contain
at least 40% "postconsumer" material. The rules states
that "postconsumer material" is defined in Section 3(f) of
the Illinois Solid Waste Management Act.
(Ill.Rev.Stat.1989, ch. 111 1/2, par. 7053(f).) Several
callers have stated that their paper suppliers are unable to
supply paper with 40% postconsumer material.
However, upon an explanation that the Section 3(f)
definition is apparently broader that the usual definition
of "postconsumer" (for example, it allows for envelope
trimmings and other finished but not sold products), most
callers seem to feel that such paper is available. One
paper supplier suggested that a better term might be 40%
"post-industrial". The Board's recycled paper rule
requires only what the State of Illinois itself buys and
uses.
