BOARD BEGINS ACTION ON NEW MEDICAL WASTE
RULES IN RESPONSE TO LEGISLATIVE MANDATE
At its August 22 and 26, 1991 Board meetings, the Board
opened four rulemaking dockets (R91-18, R91-19, R91-20
and R91-21) in response to House Bill 2491, presently
awaiting the Governor's signature.
Changes made by House BIll 2491 include a
requirement at new section 56.2(d) of the Environmental
Protection Act that the Board repeal 35 Ill. Adm. Code
809.Subpart I: Hazardous (Infectious) Hospital Waste by
January 1, 1992. Therefore, to comply with this mandate
within the timeframe given, the Board opened Docket R91-
18 and sent the proposed repealer to first notice. Should
the governor not sign HB 2491, the proposed repealer will
be withdrawn. Hearings have been set on the proposal for
Wednesday, September 18,1991 at 9:00 a.m., Room 9-031,
State of Illinois Center, 100 W. Randolph St., Chicago, and
Thursday, September 19, 1991 at 10:00 a.m., 148 N. Third
St., DeKalb.
New section 56.2(e) of the Act requires the Board to
adopt rules that "are identical in substance to the list of
etiological agents identified as Class 4 as set forth in
'Classification of Etiological Agents on the Basis of Hazard,
1974', published by the Centers for Disease control [CDC]",
or any amended list. The Board opened docket R91-19 to
provide a vehicle to accomplish this mandate.
New Sections 56.2(a) and 56.2(c) require the Board to
adopt regulations for the design and operation of potentially
infectious medical waste treatment, storage and transfer
facilities, and to adopt regulations prescribing standards for
transporting, packaging, segregating, labeling, and marking
potentially infectious medical waste. The Board opened
dockets R91-20 (treatment, storage, transfer, etc.) and R91-
21 (transportation, packaging, labeling, etc.) to initiate
rulemakings for these mandates. An inquiry hearing has
been set for these dockets for Wednesday, September 18,
1991 at 11:00 a.m. at Room 9-031, State of Illinois Center,
100 W. Randolph St., Chicago.

BOARD ADOPTS SECOND NOTICE IN RECYCLED
PAPER RULEMAKING (R90-24)
On September 12, 1991, the Board adopted (7-0) a
second notice opinion and order in its recycled paper
rulemaking. The proposed rule would require all
documents, excluding exhibits, filed with the Board by
attorneys or organized environmental or trade groups to be
submitted on recycled paper. The Board responded to
public comments received during the first notice period, and
made some revisions to the proposed rule. First, the
language was modified to clarify that exhibits are excluded
from the recycled paper requirement. Second, stationery,
such as letterhead, is exempted from the requirement when
that paper is submitted merely as a cover letter or for other
similar purposes. Third, new language encouraging the use
of double-sided copying of documents was added. Finally,
the effective date of the requirement was delayed from
December 1, 1991, to January 1, 1992.

The rule will be submitted to the Joint Committee on
Administrative Rules for the statutory 45-day second notice
period. The Board's second notice opinion and order can

BOARD MODIFIES RCRA UPDATE (R91-1)
On September 12, 1991, the Board modified the final
order entered August 8, 1991, in R91-1, the RCRA Update
docket for the second half of 1990. The Board corrected
the entry in Section 720.111 for "Test Method 8290" to
conform with the title and document number of the
document actually received from USEPA.
BOARD WITHDRAWS R90-11 CORRECTION (RCRA
UPDATE)
On August 22, 1991, the Board withdrew its August 8,
1991 correction to the rules adopted in R90-11. Due to an
editorial error, the entry in 35 Ill. Adm. Code 728.Table A for
F024, Lead, Non-wastewaters was incorrect as filed and
published in the Illinois Register. A correction appeared in
the Illinois Register as an amended rule on August 23,
1991, at 15 Ill. Reg. 11937. The correction will now be
withdrawn, and the rule will revert back to the prior text.
