BOARD ADOPTS AMENDMENTS TO 35 ILL. ADM CODE
501 MANAGEMENT OF LIVESTOCK WASTES, R90-7
On June 20, 1991, the Board adopted by a 7-0 vote
(Opinion and Order of the Board by Board Member R.C.
Flemal; Board Member Joan Anderson concurring) a Final
Opinion and Order in R90-7, Amendments to 35 Ill. Adm.
Code 501 Agriculture-Related Pollution (Management of
Livestock Wastes).
The amendments modify existing regulatory provisions
dealing with the siting of new livestock management facilities,
and livestock waste-handling facilities. New livestock
management facilities and waste-handling facilities are
prohibited from locating within 1/2 mile of a populated area or
within 1/4 mile of a non-farm residence, unless located within
a designated Agricultural Area, or the facility undergoes
expansion or complies within local zoning requirements, as
specified in the amendments.
The amendments also allow for expanded use of
vegetative filters for the treatment of livestock waste generated
at small-to medium-sized facilities.
The amendments further establish requirements for the field
application of livestock wastes. Operators are required to
practice odor control methods so as not to cause air pollution.
The amendments are designed to reduce the potential for
odors which constitute air pollution with minimum disruption of
farming practices.
On June 11, 1991, the Joint Committee on Administrative
Rules ("JCAR") issued a certification of no objection to the
proposed amendments. JCAR had no questions or problems
with the amendments, therefore, the amendments were
adopted by the Board in the same form as the Second Notice
version of the amendments.

BOARD SENDS PROPOSED GROUNDWATER
PROTECTION RULES TO A SECOND FIRST NOTICE
On June 20, 1991, the Board adopted a Second First
Notice in R89-5, Groundwater Protection: Regulations for
Existing and New Activities Within Setback Zones and
Regulated Recharge Areas (35 Ill. Adm. Code 601, 615, 616,
and 617). The proposed amendments contain groundwater
monitoring requirements for surface impoundments, pesticide
storage and handling units, road oil storage and handling
units, and de-icing agent storage and handling units; general
closure and post-closure requirements for land treatment units,
surface impoundments, pesticide storage and handling units,
and fertilizer storage and handling units; and other regulations
pertaining to landfills, surface impoundments, waste piles,
underground storage tanks, pesticide storage and handling
units, fertilizer storage and handling units, road oil storage and
handling units, and de-icing agent storage and handling units.
The Board adopted the Opinion and Order by a 7-0 vote
(Opinion and Order of the Board by Board Member R.C.
Flemal; Board Members J. Anderson and B. Forcade
concurred).
Once the proposed rules are published in the Illinois
Register, a 45 day comment period will begin. Persons
wishing to comment should call the hearing officer, Michelle

This rulemaking amends existing Board regulations pertaining to Agriculture Related Pollution found at 35 Ill. Adm.
Code: Subtitle E, Part 501. Major provisions are: clarifies the relationship between livestock odors and air pollution,
amends existing regulations dealing with the siting of new livestock management facilities and livestock waste-
handling facilities, provides for the expanded use of vegetative filter strips for the treatment of livestock waste
generated by 300 animal units or less, and requires operators to practice field application procedures in such manner
as to not cause air pollution. Board Member Joan Anderson concurred.
