The third hearing in the above combined proceedings will
begin at 10:00 a.m. on June 7, 1991, at 1341 North Ninth

BOARD ADOPTS AMENDMENTS TO THE ILLINOIS
UNDERGROUND INJECTION CONTROL PROGRAM, R90-
14
In R90-14, adopted by the Board on May 23, 1991, the
Board adopted amendments to the Illinois underground
injection control program that correspond to the federal Third
Third land disposal restrictions. On June 1, 1990, USEPA
promulgated the restrictions on land disposal of Third Third
Scheduled Wastes. That rulemaking included restrictions
under both the RCRA and UIC programs. On January 31,
1991, USEPA published a series of corrections to the Third
Third prohibitions. The R90-14 rulemaking deals only with
those portions of the federal proceedings that impact the
Illinois UIC program. Docket R90-11 dealt with those portions
impacting the Illinois RCRA program.
The R90-14 and corresponding federal rulemaking primarily
completes the list of Third Third Wastes prohibited from
underground injection (35 Ill. Adm. Code 738.116,
corresponding to 40 CFR 148.16). It also adds First Third
Wastes (35 Ill. Adm. Code 738.114, corresponding to 40 CFR
148.14) and Second Third Wastes (35 Ill. Adm. Code 738.115,
corresponding to 40 CFR 148.15) and adds an exception from
the general prohibition against underground injection for
certain characteristic wastes (35 Ill. Adm. Code 738.101,
corresponding to 40 CFR 148.1).

On May 13, 1991, the Third District Appellate Court, after
vacating the August 9, 1990 Board Order in PCB 85-95,
reversed and remanded this matter to the Board with
directions.
BOARD AND STAFF ACTIVITIES
On May 16-18, LouAnn Burnett attended a conference held
by the Ozark-Prairie Chapter of the Society of Environmental
Toxicology and Chemistry in St. Louis, Missouri. She is also
on the Board of
Directors for the Society.
On May 21st and 22nd, Chairman John Marlin, Staff
Attorney Marie Tipsord and Attorney Assistant Deborah
Stonich attended the Illinois Environmental Compliance
Management Conference held by the Institute of Business Law
at the Marriott Hotel in Chicago. Chairman Marlin was also a
featured speaker at the conference.
Board Member Jacob D. Dumelle spoke to the Environmental
Quality Task Force of the Northeastern Illinois Planning
Commission on May 30th in Chicago. He discussed air and
water pollution and relationships to land-use planning and the
Clean Air Act Amendments concerning reasonably available
transportation control measures.

requirements for its Pope County facility.

DISKETTE OF REGULATIONS FOR THE DESIGN AND OPERATION OF NONHAZARDOUS WASTE
LANDFILLS
The Board regulations for the design and operation of nonhazardous waste landfills were filed and
effective on September 18, 1990. Based on the interest shown by participants at the IEPA held workshops on
December 6, 1990 and December 12, 1990 and calls received to date regarding these regulations, several
documents have been compiled in a set of diskettes. The compilation includes the Board's Opinions and Orders
in the R88-7 and the predecessor R84-17D dockets (approximately 850 pages) and the supporting background
document and detailed responses to comments of the Scientific/ Technical Section (approximately 775 pages). In
addition, the compilation contains executive summaries and an overview of the Board's functions and operations.
The diskettes totalling over 1600 pages have been put together using Wordperfect 5.0 word processing
software. The diskettes, available in either 5.25" or 3.5" size, can be purchased from the Illinois Pollution Control
Board for $100 per set. Please use the form on the back to speed your request. Diskettes will be sent by First

POLLUTION CONTROL BOARD ENVIRONMENTAL REGISTER NEWSLETTER
The Environmental Register provides a variety of information on Board activities and environmental

taken at the Board meeting, contains the Board's hearing calendar and provides other useful information on
