FUNDING SHORTAGE REDUCES
HEARING SCHEDULING
The Board is presently short of the funds needed to
allow it to schedule hearings in all of its approximately 100
pending cases as well as those cases which are yet to be filed
before fiscal year 1991 ends on June 30. In an attempt to
ameliorate the problem, the Board will again be requesting a
non-general revenue fund supplement from the General
Assembly that would allow unused appropriations from fiscal
year 1990 to be used for hearings this fiscal year. The request
was not granted during the Fall and January sessions.
In the meantime, the Board has contacted its
hearing officers requesting them to give priority to cases such
as permit appeals and variances where failure to hold a
hearing and reach a decision would give the petitioner the
relief it seeks by operation of the law. In all other types of
cases, including administrative citations, adjusted standards
and enforcement cases, the Board has asked its hearing
officers to defer hearings unless otherwise notified by the
Clerk's office. The Board has also requested that the number
and length of hearings be kept to a minimum.
The Board will contact its hearing officers to
schedule hearings in selected cases this fiscal year as the
status of available funds becomes clearer.
PRO BONO LAWYERS AVAILABLE
The Board maintains a list of attorneys who, for no fee, may
be willing to represent persons or groups before the Board.
The decision to take on a case is up to the attorney and all
arrangements are made solely between the attorney and the

BOARD ADOPTS UST UPDATE (R90-12)
The Underground Storage Tank (UST) program regulates
petroleum and hazardous substances in underground storage
tanks. It is mandated by Section 7.2 and 22.4(d) of the Act. It
is contained in 35 Ill. Adm. Code 731, which reflects USEPA
regulations in 40 CFR 280.
On February 28, 1991, in R90-12, the Board updated the
UST rules to include USEPA regulations adopted during the
period January 1 through June 30, 1990. The major action
during this period was the extension of time for compliance
with financial responsibility rules for owners and operators of
13 through 99 USTs.
R90-12 will not address the effects of P.A. 86-1050 and 86-
1484, pending possible revisions to the legislation. The text
of the adopted rules will appear in the Illinois Register after
March 30, 1991. Questions should be directed to Morton

BOARD PROPOSES NEXT
UST UPDATE (R91-2)
On February 28, 1991, in R91-2, the Board proposed to
update the UST rules to include USEPA regulations adopted
between July 1 and December 31, 1990. The major action
during this period is the extension of the time for compliance
with the financial assurance requirements for owners and
operators of fewer than 13 tanks, and for units of local
government.
The R91-2 proposal does not address the effects of P.A. 86-
1050 and 86-1484, pending possible revisions to that
legislation.

BOARD MODIFIES RCRA
DELISTING PROCEDURES (R90-17)
The RCRA hazardous waste program regulates the
generation, transportation, treatment, storage and disposal of
hazardous waste. Sections 7.2 and 22.4(a) of the Act requires
the Board to adopt regulations which are "identical in
substance" to USEPA regulations. The Board's RCRA
regulations are in 35 Ill. Adm. Code 702 through 705, and 720
through 728. These are derived from USEPA regulations at 40
CFR 260 through 270. This rulemaking concerns 35 Ill. Adm.
Code 720 and
721, which are derived from 40 CFR 260 and 261.
On March 1, 1990, USEPA delegated authority to
Illinois to "delist" hazardous waste. The Board opened this
Docket to make technical changes to the Board's delisting
procedures.
On February 28, 1991, in R90-17, the Board
modified its delisting procedures to require the use of
"adjusted standards" instead of site specific rulemaking for
original delistings. "Adjusted standards" are allowed by
Section 28.1 of the Act. The procedures are in 35 Ill. Adm.
Code 106.Subpart 701 et seq. The "level of justification" for
the adjusted standard is the showing which would have to be
made to USEPA under 40 CFR 260.
The rules will be filed and will appear in the Illinois
Register after March 30, 1991. Questions should be directed

BOARD SPLITS DOCKET IN GROUNDWATER
QUALITY STANDARDS (R89-14) AND SENDS
AGENCY'S NEW PROPOSAL TO FIRST NOTICE
UNDER DOCKET B
On February 28, 1991, the Board split the docket in
R89-14 (35 Ill. Adm. Code 620) and sent the Illinois
Environmental Protection Agency's proposal as filed in its
recent comment #47 to First Notice under Docket B. The
Board took no substantive position concerning the new
proposal but sent it to First Notice to maximize the opportunity
for public comment and to assist the most expeditious
disposition of this matter. After the Docket B amendments are
published in the Illinois Register, comments will be accepted
for 45 days.
The Board proposal published in the November 2, 1990
Illinois Register (14 Ill. Reg. 17822, 17862) remains under
Docket A and remains active.

HEARING SET FOR R89-5,
GROUNDWATER PROTECTION
The Economic Impact Study conducted by the Department
of Energy and Natural Resources for R89-5, Groundwater
Protection: Regulations for Existing and New Activities within
Setback Zones and Regulated Recharge Areas (35 Ill. Adm.
Code 601, 615, 616 and 617) (Technical Standards), is
expected to be filed shortly. Therefore, a combined merit and
economic hearing on this proposal has been set for:

BOARD PROPOSES RACT DEFICIENCY
RULES (R91-7 & R91-8) FOR FIRST
NOTICE AND SCHEDULES HEARINGS
On February 28, 1991, the Board adopted orders sending
the two Illinois Environmental Protection Agency (Agency)
RACT deficiency proposals (R91-7 and R91-8) to first notice.
The two proposals seek to remedy deficiencies in Illinois's air
pollution rules requiring the implementation of reasonably
available control technology (RACT). The Board noted in the
orders that the rules were sent to first notice exactly as
proposed by the Agency, and stated that the Board takes no
position on the merits of the proposed rules at this time.
However, because these rulemakings are on a very tight time
schedule as required by the federal Clean Air Act
amendments, early first notice publication will speed the
disposition of the rulemakings, as well as maximize the
opportunity for public comment. The proposed rules will be
published shortly in the Illinois Register. Copies of the first
notice orders are available from the Clerk's office (312/814-
3620).
Additionally, the Board has scheduled two hearings on

FIRST NOTICE FOR R91-6,
PM-10 EMISSION LIMITS
The Board issued for First Notice a proposed rule
involving the PM-10 emissions for the portland cement
manufacturing plant and quarry operations of Lone Star
Industries in Oglesby, LaSalle County. This rulemaking is
federally required and will become part of the Illinois State
Implementation Plan ("SIP") for PM-10. As only one facility is
affected by the proposed amendments to 35 Ill. Adm. Code
Parts 211 and 212, the Board also made a determination that
no economic impact study ("EcIS") would be required.
Hearings will be held in this matter in Chicago and Oglesby on
April 17 and 19.

AS89-3 ADJUSTED STANDARD FROM
35 Ill. Adm. Code 304.105, 302.208
The Board granted an adjusted standard from
Sections 304.105 and 302.208 of the Board's water
regulations for the total dissolved solids ("TDS") discharge of
The NutraSweet Company and Consumers Illinois Water
Company. The facilities are located in University Park, Will
County. The discharge is to Deer Creek, which joins Thorne
Creek, a tributary of the Little Calumet River. The Board found
the adjusted standard would result in negligible environmental
impact. Relief was conditioned upon revisions to the
Petitioners' NPDES permits.

BOARD AND STAFF ACTIVITIES
Chairman John Marlin spoke at the meeting of the American
Public Works Association on February 27 in Addison. Dr.
Marlin spoke on regulatory proposals that could affect
wastewater treatment facilities. On March 4, Chairman Marlin
spoke to University of Illinois students about the structure and
function of the Pollution Control Board. The students are
enrolled in a multidisciplinary graduate course called Metro
Apex which simulates the operations of planning and
environmental agencies in a hypothetical county.
Board Member Bill Forcade gave a speech before the
Friends of the Chicago River at their conference in Lake Forest
on February 9. Mr. Forcade's speech addressed the issue of
integrating information and interests when planning projects.
Board Member Ronald C. Flemal attended the "Community
Water Fluoridation" conference conducted by the Illinois
Department of Public Health and held at Kishwaukee College
in Malta on February 21.
WATERWAYS CRUISE
The "Waterways Cruise and Environmental Workshop" will
be held on April 27, 1991. Speakers from state and federal
agencies, industry and others will discuss progress in pollution
abatement and current environmental problems. The 72-mile
cruise on Lake Michigan and Chicago waterways will afford
views of the Chicago skyline, forest preserves, Water
Reclamation District plants, steel mills and other industries.

WORKING TOGETHER TO MANAGE WASTE
The twenty-second annual "Working Together to Manage
Waste" conference will be held on May 7 and 8, 1991 at the
Bismark Hotel in Chicago. Co-sponsors are the Illinois
Environmental Protection Agency, the Pollution Control Board,
the Department of Energy and Natural Resources and some
industries.
Speakers from state and federal agencies, industry,
research, and other areas will attend. Topics to be covered
include incineration systems, waste reduction and
minimization, landfill capacity, new technologies for dealing
with hazardous waste, new legislation, and regulations on
RCRA, Superfund and UST. For program and registration

Availability of Landfill
Regulations Information
Diskette
The Board regulations for the design and operation of nonhazardous waste landfills were filed and effective on
September 18, 1990. Based on the interest shown by participants at the IEPA held workshops on December 6,
1990 and December 12, 1990 and calls received to date regarding these regulations, several documents have
been compiled in a set of diskettes. The compilation includes the Board's Opinions and Orders in the R88-7 and
the predecessor R84-17D dockets (approximately 850 pages) and the supporting background document and
detailed responses to comments of the Scientific/ Technical Section (approximately 775 pages). In addition, the
compilation contains executive summaries and an overview of the Board's functions and operations. The
diskettes totalling over 1600 pages have been put together using Wordperfect 5.0 word processing software.
The diskettes, available in either 5.25" or 3.5" size, can be purchased from the Illinois Pollution Control Board for
$100 per set. Please use the form below to speed your request. Diskettes will be sent by First Class mail.
