OPINION AND ORDER OF THE BOARD (by G.T. Girard):
On May 10, 1996, the Illinois Environmental Protection Agency (Agency) filed a
petition for rulemaking to amend the list of emission units and activities that are exempt from
state air permitting requirements. The proposal also amends Section 201.146 to establish
consistency between the exemptions from state permit requirements and the insignificant
activities provision of the Clean Air Act Permit Program. The petition meets the information
requirements of 35 Ill. Adm. Code 102.121 and 102.141 and shall therefore proceed to
hearing.
The Agency has also filed a motion asking that the Board waive several requirements
which govern the filing of a regulatory proposal. Specifically, the Agency asks that it be
allowed to submit the original and five complete copies of the proposal and four partial copies
of the proposal, rather than the original and nine complete copies to the Board. Further, the
Agency asks that it not be required to supply the Attorney General or the Department of
Natural Resources with a complete copy of the proposal. Lastly, the Agency asks that it not
be required to submit documents which are readily available to the Board on which the Agency
will rely at hearing.
The Board grants the Agency's motion.
