(Trade Secret Determination-Air)
ORDER OF THE BOARD (by G.T. Girard):
On May 9, 1996 the Board received a petition for review of a determination by the
Illinois Environmental Protection Agency denying trade secret status for certain information.
Pursuant to the Board's procedural rules at 35 Ill. Adm. Code 120.225, the Board is required
to make a determination regarding the materials within 10 working days unless the Board
extends that time an additional 10 working days upon notice to the parties. Thus, the Board
must either extend the time for a determination or make such a determination by May 23,
1996.
The Board believes that a response from the Agency will be helpful in making the
determination whether or not to accord trade secret status to the information. Therefore, the
Board will extend the time to make a determination by an additional 10 working days. The
determination will be due on June 7, 1996. Given the limited time in which the Board must
make its decision, the Board asks that the Agency to file a response on or before May 28,
1996.
