    DISSENTING OPINION (by J. Theodore Meyer):
    I concur in part and dissent in part from the majority opinion in this matter. I agree
    with the majority that Marathon should be granted a prospective variance from 35 Ill. Adm.
    Code 216.361(a) concerning Marathon’s emissions of carbon monoxide at its oil refinery in
    Robinson, Illinois. However, I also believe that the facts warrant a granting of a retroactive
    variance from Section 216.361(a) as well.
