ORDER OF THE BOARD (by E. Dunham):
On May 16, 1996, Commonwealth Edison Company (ComEd) filed a petition for an
alternative thermal standard for its Joliet, Will County, Crawford and Fisk Generating
Stations. The petition is filed pursuant to 35 Ill. Adm. Code 304.141(c). The Board has
entered this petition as an adjusted standard from the requirements of 35 Ill. Adm. Code
302.211(d) and (e)

and will follow the procedural rules for a heated effluent demonstration as
found in Subpart A of 35 Ill. Adm. Code 106. Hearing on the petition will be held pursuant
to 35 Ill. Adm. Code 106.105. The Board finds that the petition as filed by ComEd does not
meet the requirements for an adjusted standard petition. Therefore, the Board finds that the
petition filed by ComEd is insufficient for Board consideration and directs ComEd to file an
amended petition satisfying the requirements of 35 Ill. Adm. Code 106.Subpart A.
ComEd also filed a request for waiver of filing requirements. ComEd requests that it
be allowed to file the original plus three copies of the exhibits to the petition instead of the
original plus nine copies as required by 35 Ill. Adm. Code 101.103(b). The Board requests
that at least the original plus four copies of documents be filed in order to supply each Board
office with a copy of the document and maintain the original document in the Clerkâs file.
Therefore, the Board directs ComEd to file one additional copy of the exhibits with the Board.
If ComEd does not file an amended petition, addressing the above issues, on or before
July 26, 1996 this matter may be subject to dismissal.
