ORDER OF THE BOARD (by G.T. Girard):
On July 24, 1996, the DeKalb Sanitary District (District) filed a petition for variance
for its main wastewater treatment facility. The District’s petition is deficient, as it fails to
contain much of the information required by 35 Ill. Adm. Code 104.121. The Board will not
set out the provisions of 35 Ill. Adm. Code 104.121; rather we direct petitioner’s attention to
those provisions.
An amended petition curing the deficiencies shall be filed within 45 days of the date of
this order. Failure to file an amended petition will result in the dismissal of this proceeding.
The filing of an amended petition will restart the Board’s timeclock pursuant to Section 38(a)
of the Environmental Protection Act.
