    R97-2
    SAFE DRINKING WATER ACT UPDATE
    )
    (Identical-in-Substance)
    (January 1 through June 30, 1996)
    )
    (Public Water Supplies Rules)
    Proposed rule.
    Dismissal order.
    ORDER OF THE BOARD (by R.C. Flemal):
    Pursuant to Section 17.5 of the Environmental Protection Act (Act), the Board would
    normally propose amendments to Illinois regulations that are "identical-in-substance
    1
    " to
    drinking water rules adopted by USEPA pursuant to Sections 1412(b), 1414(c), 1417(a), and
    1445(a) of the Safe Drinking Water Act (P.L. 93-523), as amended (SDWA). In accordance
    thereto, the Board reserved this docket to incorporate into Illinois law those USEPA
    amendments made during the period from January 1 through June 30, 1996.
    However, during the specified update period, USEPA amended its 40 CFR 141 SDWA
    regulations on May 14, 1996, at 61 Fed. Reg. 24354, to establish an information collection
    rule (ICR) relating to disinfection and disinfection byproducts. USEPA explained in its
    preamble discussion of the requirements that the ICR is a temporary rule, and USEPA will
    implement it directly without the assistance of the various states (61 Fed. Reg. 24363-64).
    This means that the Board need not amend the Illinois drinking water regulations to
    incorporate this federal ICR.
    For the foregoing reason, the Board hereby dismisses this proceeding.
    IT IS SO ORDERED.
    Board Member K. Hennessey abstained.
    1
    The term "identical-in-substance" is defined at Section 7.2 of the Act.
