(Variance - Public Water Supply)
ORDER OF THE BOARD (by J. Theodore Meyer):
On October 15, 1996 the City of DeKalb (DeKalb) filed a document which outlines two
options by which DeKalb will attempt to inform all users of its water supply, including renters,
of the variance granted in this matter. These options were presented in response to Paragraph
J of the Board’s final order which directed DeKalb to take measures to ensure that a full copy
of the variance notification is sent to, and can be retained by, all users of its water supply,
including renters. (City of DeKalb v. IEPA, (September 19, 1996) PCB 96-246.) DeKalb
offers to inform its water users by direct mail and through monthly newspaper notices.
The Board will construe this document as a motion to clarify its September 19, 1996
order. On October 16, 1996 the Agency filed its response by pre-approved facsimile, stating
its belief that DeKalb’s notification methods meet the requirements of Paragraph J of the
Board’s final order, and recommending that the methods be accepted.
The Board grants DeKalb’s motion. DeKalb may proceed with its plans to send
variance notification and notification of non-compliance with the MCL for combined radium by
direct mail and through monthly newspaper publication as outlined.
