    ORDER OF THE BOARD (by J. Yi):
    On August 19, 1996 the Illinois Power Company (petitioner) filed two separate permit
    appeals and a motion to consolidate those appeals. Both permit appeals concern petitioner’s
    “Request to Revise Air Permit” submitted to the Illinois Environmental Protection Agency
    (Agency) on June 24, 1996 and are brought pursuant to Section 40 of the Environmental
    Protection Act. (415 ILCS 5/40) On September 5, 1995 the Board consolidated these matters.
    On October 17, 1996 petitioner filed a motion for summary judgment. On October 24,
    1996 the Agency filed a motion to extend time to file a cross-motion for summary judgment in
    response to petitioner’s motion for summary judgment. The Agency requests an extension
    until November 1, 1996. The Agency’s motion is granted.
