ORDER OF THE BOARD (by R.C. Flemal):

This matter is before the Board on a Motion to Modify the Board’s Order of November

7, 1996 filed by Envirite Corporation and Envirite of IL, Inc. Specifically the petitioners

request that the Board modify the effective date of the Board’s November 7, 1996 order. The

petitioners request a change in the effective date from November 7, 1996 to January 1, 1997 or

at such time as a corporate reorganization is completed which will result in Envirite of IL, Inc.

assuming Envirite Corporation’s Illinois assets.

The Board recognizes that such a modification in the effective date will better serve the

petitioners to ensure continuity during the reorganization. However the Board must state a

date certain as the effective date of the order. Accordingly the Board hereby modifies its

November 7, 1996 order, paragraph 1 to reflect an effective date of January 1, 1997.

IT IS SO ORDERED.

Section 41 of the Environmental Protection Act (415 ILCS 5/41 (1994)) provides for

the appeal of final Board orders within 35 days of the date of service of this order. The Rules

of the Supreme Court of Illinois establish filing requirements. (See also 35 Ill.Adm.Code
