ORDER OF THE BOARD (by J. Yi):
On November 18, 1996 petitioner, Riverside Laboratories Inc., filed a motion to
consolidate pursuant to 35 Ill. Adm. Code 103.141. Petitioner requests the Board to
consolidate the already consolidated matters PCB 90-164 and 91-161 with PCB 95-157.
All three matters concern the air emissions from petitioner’s facility located in Geneva,
Illinois. In the consolidated matters PCB 90-164 and 91-161 petitioner is requesting variance
from 35 Ill. Adm. Code Part 218 as it applies to its papercoating operations. In PCB 95-157
petitioner is also requesting relief from 35 Ill. Adm. Code Part 218 as it applies to its facility.
In support of its motion petitioner states that: 1) both the consolidated petition and PCB 95-157
pertain to Riverside’s manufacturing facility located in Geneva, Kane County, Illinois; 2) both
the consolidated petition and PCB 95-157 pertain to Riverside’s regulation under the
papercoating rules and concern common facts and issues; 3) the parties have submitted to the
hearing officer status reports concerning the consolidated petition and PCB 95-157
approximately every three months; 4) the consolidated petition was recently assigned to the
same agency counsel as PCB 95-157; and 5) the three variance petitions concern common facts
and issues and since their resolution is related, it is more convenient and expedient for these
matters to be consolidated.
The Board agrees with petitioner and grants the motion to consolidate these
consolidated matters, PCB 90-164 and 91-161 with PCB 95-157 for the purposes of hearing.
