ORDER OF THE BOARD (by R.C. Flemal):
On October 18, 1995 the Illinois Environmental Protection
Agency (Agency) filed a Motion For Extension of Time to File the
Agency Record and Motion to File Motion for Extension of Time
Instanter. The Agency requests the Board extend the time in
which it must file the Agency record in this matter until March
21, 1996.
Pursuant to Section 105.102 of the Board's procedural rules,
the Agency is required to file the entire Agency record of the
permit application with the Board within 14 days of notice of the
petition. (35 Ill. Adm. Code 105.1029(a)(4).) The Agency states
it received notice of the petition on September 20, 1995. The
Agency record was therefore due to be filed with the Board by
October 4, 1995.
In support of its motion, the Agency states that it wants
the opportunity to more fully discuss the issues with petitioner
in the eventuality that a hearing will not be necessary. The
Agency and petitioner met on October 4, 1995, the date the record
was originally due to be filed with the Board. Both parties
agreed that the issued raised in this appeal may be resolved
through additional information regarding petitioner's emissions.
According to the Agency, petitioner has no objection to the
Board granting the Agency the additional time to file the record
and will not be prejudiced by the Agency filing this motion
instanter.
The Board hereby grants the Agency's motion to file
instanter and grants the Agency until March 21, 1996 to file the
record in this matter.
