    ORDER OF THE BOARD (by J. Yi):
    On October 20, 1995, Illinois Environmental Protection
    Agency (Agency) filed a motion for extension of time in which to
    file recommendation until November 17, 1995.
    On May 23, 1995, Marathon Oil Company (Marathon) filed a
    petition for variance from 35 Ill. Adm. Code 216.361(a) with
    respect to the emissions of carbon monoxide (CO) from its CO
    Boiler located at its refinery in Robinson, Illinois.
    On June 22, 1995, the Agency filed its recommendation
    requesting the Board to deny the petition for variance because
    the Agency did not have adequate information in which to evaluate
    the petition. On September 20, 1995, a meeting was held between
    the Agency and Marathon representatives and subsequently, on
    September 22, 1995, Marathon filed an amended petition for
    variance.
    Under 35 Ill. Adm Code 104.180(a), the Agency must make a
    recommendation to the Board within 30 days after the filing of
    the petition. The Agency states that the time imposed by 35 Ill.
    Adm. Code 104.180(a) is not adequate and is requesting additional
    time to review the additional information submitted by Marathon
    in its amended petition. Petitioner's attorney has agreed to the
    extension and the Agency feels that extending the time for the
    filing of the recommendation does not prejudice the petitioner.
    A hearing has been scheduled for December 12, 1995.
    The Board grants the Agency's motion to file recommendation
    until November 17, 1995.
