ORDER OF THE BOARD
(by Dr.
Odell)
On July 21,
1975, the Complainant filed with the
Illinois Pollution Control Board
(Board)
a Motion for Exten-
sion of Time in Which to File Parties’ Response to the Board’s
Order of May 8,
1975.
An extension to August
20, 1975 was
requested.
Complainant also requested that the Board order
Respondent to file his proposal for compliance on or before
August
6,
1975.
Complainant’s Motion stated that “A meeting was held
on June 12,
1975 among the parties and several of the afore-
mentioned Homeowners wherein Counsel for Respondent agreed to
prepare a specific proposal for compliance in preparation for
timely response to the Order entered on the atoresaid date.
On July 14,
1975, the Complainant contacted Counsel for Res-
pondent as to the status of that proposal.
As of Friday,
July 18, 1975 there had been no communication as to the pro-
posal by Counsel for Respondent.
It is Complainant’s position
that the interests of the affected Homeowners would best be
served by continuing negotiations in order
to reach an agree-
ment with them rather than to order the terms
of Respondent’s
compliance.”
Complainant’s Motion for Extension of Time to File
Parties’ Response to the Board’s May 8,
1975 Order is hereby
granted.
Respondent is hereby ordered to file his proposal
for compliance on or before August
6, 1975.
IT
IS SO ORDERED.
I, Christan L. Moffett, Clerk of the Illinois Pollution Control
Board, hereby certify that the above Opinion and Order was
adopted on the
