This matter

is before the Board on Petitioner Land and Lakes

Company’s Motion to Supplement Agency record filed July

1990.

The Illinois Environmental Protection Agency filed

its

Objection on August

9,

1990.

Thereafter, on August

13,

1990,

the

Petitioner

filed its Reply to the Agency’s Objection.

The motion requests permission to supplement the record in

this permit appeal with four other permits granted by the Agency.

The Agencyts response argues that the four permits are irrelevant

to the determination in this permit appeal.

At the hearing held in this matter on August

16,

1990,

the

permits were introduced by the Petitioner and accepted into

evidence over the Agency’s objection.

The Board will decide the

admissibility of the permits when it decides this case.
