    HEARING OFFICER ORDER
     
    On November 23, 2005, respondent filed a motion for an extension of time until
    December 5, 2005 to respond to petitioner’s motion for summary judgment. Petitioner did not
    file an objection to the motion. Accordingly, the extension is granted. It is noted that respondent
    did file its response on December 5, 2005.
      
    The parties are reminded to participate in a telephone status conference with the hearing
    officer at 10:30 a.m. on January 3, 2006. The status conference shall be initiated by the
    petitioner.
     
    Petitioner filed an open waiver of the decision deadline in this case.
