    HEARING OFFICER ORDER
     
    On September 28, 2004, petitioners participated in a telephone status conference with the
    hearing officer. Respondent did not appear. Petitioners have exchanged comments with the
    Office of the Attorney General (OAG) on the draft consent decree pertaining to a related
    enforcement case. The OAG sent petitioners additional comments on legal issues, but petitioners
    are still waiting to hear from respondent on technical issues. Petitioners hope to receive
    respondent’s comments before the next status conference.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 11:30 a.m. on December 21, 2004. The status conference shall be initiated by the
    petitioners. At the status conference, the parties must be prepared to discuss the status of the
    above-captioned matter.
     
    Petitioners have filed an open waiver of the statutory decision deadline in this matter.
