ORDER OF THE BOARD (by G.T. Girard):

This matter is before the Board on a petition for review filed by the City of Sullivan
(City) to appeal a September 13, 2004 determination of the Illinois Environmental Protection
Agency (Agency). The Agency modified the City’s high priority corrective action plan budget
for its leaking underground petroleum storage tank facility located on North Park Street,
    Sullivan, Moultrie County.

On November 28, 2005, the City filed a motion for voluntary dismissal of its appeal. The
motion asserts that the matters for which the petition was filed have been fully compromised and
settled. The City asks that the petition be dismissed with prejudice. The motion for voluntary
dismissal is granted. The Board hereby dismisses the petition with prejudice as requested and
    closes the docket.

    IT IS SO ORDERED.

I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the Board
adopted the above order on December 1, 2005, by a vote of 4-0.

    Dorothy M. Gunn, Clerk
