ORDER OF THE
BOARD

On June 23,
1994, the Board received a motion filed by the
respondent asking the Board to consolidate PCB 94-148 with PCB
94—162,
94—169 and 94—170 (consolidate).
The Board has not
received a response to the motion from the petitioner.
Therefore, pursuant to 35 Ill.
Adin. Code 101.241(b), petitioner
is deemed to have waived objection to the granting of the motion.
The respondent maintains that the cases should be
consolidated as all the permits being appealed relate to the
petitioner’s facility in Sauget, Illinois and all are related to
requirements under RCRA.

The respondent further
asserts that the denial of the RCRA part B permit was based in
“whole or in part on the same underlying facts and data that
formed the basis
of the Agency’s decisions with respect to the
air permits”.

The Board hereby grants the motion to consolidate PCB 94-148
with the previously consolidated cases PCB 94-162,
94—169 and 94—
170.
