This matter comes before the Board upon a September 20,

1982 filing of a petition for variance on behalf of the City

of West Frankfort.

That petition purports to waive hearing

but does not include an affidavit as

required by Procedural

Rule Section 104.124.

However, given that the petibion is

signed by the Mayor of the City,

the Board will waive that re-

quirement.

The Board also hereby grants the request for expedited

consideration.
