HEARING OFFICER ORDER
On December 30, 2004, all parties participated in a telephonic conference with the
hearing officer to discuss the joint motion for an extension of time to file the parties respective
pleadings, filed on December 21, 2004. In the joint motion, the petitioner requested that it be
allowed to file its response to the Illinois Environmental Protection Agency (Agency)
supplemental decision until 7 days after service of the Board’s ruling on petitioner’s motion to
strike. The Board order of November 4, 2004, directed the petitioner to file its response to the
Agency’s supplemental decision by December 31, 2004. Also in the joint motion, respondent
requested until January 10, 2004, to file its response to petitioner’s motion to strike.
Respondent’s response to petitioner’s motion to strike was due to be filed on or before December
23, 2004.
The joint motion for an extension of time to file the parties respective pleadings was
granted to the extent as follows: petitioner must file its Board ordered response to the Agency’s
supplemental decision on or before February 22, 2005; respondent’s response to the petitioner’s
motion to strike is due to be filed on or before January 10, 2005.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on February 10, 2005, at 11:15 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
