This matter comes before
the Board upon motions
to dismiss

on behalf
of the Illinois Environmental Protection Agency
(Agency)
and
the Illinois Attorney General
on May
30,
1986; on
behalf
of Mervis Industries and
H
& L Disposal Company on June
4,
1986;
and on behalf of Vermilion County on June
5,
1986.
At the
frivolous and duplicitous hearing held today the County Health
Department indicated that
the County’s motion was also intended
to include
it.
However, that is not apparent from
the
face of
the motion.
The motions
to dismiss filed
by the Agency and the Attorney
General
are hereby granted.
The Board,
however,
reserves ruling
on the other motions.
Leave
is granted
to clarify or
supplement
those motions by filings on or before June
13,
1986.
