    HEARING OFFICER ORDER
     
     
    On August 26, 2004, all parties participated in a telephonic status conference with the
    hearing officer. The respondent represented that settlement discussions have been ongoing and
    that the Illinois Environmental Protection Agency (Agency) is reviewing a Supplemental
    Environmental Project (SEP) that may offset the penalty demand. The complainant agreed but
    stated that even if the Agency were to approve the SEP, the parties would not be close to settling
    the penalty demand. The respondent made an oral motion for an extension of time to file its
    answer. The complainant objected based on its evaluation that this matter will not be settled in
    the near future, if at all. Respondent’s motion is denied. Respondent’s answer is due to be filed
    on or before September 27, 2004.
     
    The parties or their legal representatives are directed to appear at a telephonic status
    conference with the hearing officer on October 28, 2004, at 9:45 a.m. The telephonic status
    conference must be initiated by the complainant, but each party is nonetheless responsible for its
    own appearance. At the conference the parties must be prepared to discuss the status of the
    above-captioned matter and their readiness for hearing.
