OPINION
AND ORDER
OF THE BOARD

Petitioner Lake County Department of Public Works operates
a sewage treatment facility consisting of
a contact stabilization
package plant and tertiary lagoon at Grandwood Park,
Illinois.
Petitioner
is required to meet an effluent standard of
4 mg/i
BOD and 5 mg/i suspended solids by December 31, 1973 under
Rule 404(f)
of Chapter
3, Water Pollution Regulations.
Monthly
operational reports and Agency sampling indicate that BOD and
suspended solids are now substantially above the Standard to be
met.
In an effort to meet the Standard, Petitioner has requested
an EPA permit for expansion of
the sewage treatment plant.
The
Project Completion Schedule establishes a completion date of
June 1974
for this facility rather than the December
31, 1973
deadline established by Rule 404(f).
The Agency refused to
approve the Project Completion Schedule since it did not meet the
requirements of 404(f).
Rule 921(d) of Chapter
3 prohibits the issuance of a Construction
Permit when a Project Completion Schedule has not been approved.
Petitioner requests a variance from 921(d)
so that the Construction
Permit may issue.
The Agency recommends grant of the variance since a denial
would only delay the construction of needed sewage treatment
plant improvements.
We agree that the construction should proceed
as quickly as possible,
and therefore grant the variance.

ORDER
For the purpose of proceeding rapidly with its construction
of sewage treatment plant improvements Petitioner
is granted a
variance from the provisions
of Rule
921(d) of Chapter
3, Water
Pollution Regulations.
