    ORDER OF THE BOARD BY
    (J. Anderson):
    This matter comes before the Board on •its own motion and
    with regards to the transfer of the petitioner’s delisting files
    from the United States Environmental Protection Agency
    (USEPA)
    to
    the Board.
    In
    a prior Order of September
    13,
    1990 the Board
    directed the petitioner
    a)
    to indicate whether or not
    it wishes
    to proceed in the site-specific rulemaking procedure mode,
    b)
    to
    indicate whether or not the record received is complete and c)
    to
    supplement the record
    if desired.
    The petitioner has not responded to the Board’s Order or
    request.
    If the petitioner does not file a response
    in the
    Board’s office by October 25, 1990 this matter
    is subject to
    dismissal.
    The Board notes that if dismissed,
    petitioner would
    have to refile for its petition.
    If refiled, this matter will
    not be construed as transferred from the United States
    Environmental Protection Agency and the petitioner will have to
    pay the $75.00 filing fee for a site—specific petition.
