the above-referenced matter.
It is my understanding that the President ofWhiteway Santitation,
Mrs. Myrtle Pointer, sent a letter to the Illinois Pollution Control Board which was received by
the Board on August

I have received a copy of that letter from Javonna Homan from the
State ofIllinois Attorney General’s Office.
I had an
opportunity to discuss with Mrs. Pointer her
letter and the Illinois
Pollution and Control Board letter ofAugust
5,
2004 indicating that the
Illinois Pollution and Control Board was construing her letter as a reconsideration request.
I have
discussed this matter in detail with Mrs. Pointer and she did not intend the letter to be a
reconsideration request ofthe Stipulated Agreement.
