ORDER OF THE BOARD

Satchell):
Petitioner filed a request for a modification on
July 9,
1976.
The Board on June
3, 1976 had granted a
variance from Rule 203(h)
of the Chapter
3: Water Pollu-
tion Regulations to Petitioner to allow application of
the herbicide 2,4—D to Lake Sara.
Lake Sara is the
supplemental water supply for the City of Effingham.
As
a condition of the variance water from Lake Sara was not
to be used for
30 days.
In a letter dated July 8,
1976
the City informed the Board that only a fifteen day supply
of water was left in the reservoir normally used and that
the water
in Lake Sara was needed to supply the City.
Any
action taken by the Board would have occurred too late to
alleviate the problem.
In this emergency situation there
is no alternative but to rely on tests of the water supply
made by the Environmental Protection Agency and the best
judgment of the City and the Agency of how to resolve the
situation.
The request for modification is denied.
