Protection Agency by Section 31.1
of the Illinois Environmental
Protection Act, 415

FACTS
1.
That Christopher Coleman
(“Respondent”) is the present owner and
operator of a
facility located directly Northwest of theintersection of Route 127 and Main Street, Alto Pass, Union
County, Illinois.
The property is commonly known to the Illinois Environmental Protection Agency as
Alto Pass/Coleman.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating
Permit and
is designated with
Site Code No.
1810105001.
3.
That Respondent has owned and operated said facility at all timespertinent hereto.
4.
That on
August 29, 2003,
Sheila Williams of the Illinois
Environmental
Protection
Agency’s Marion Regional Office
inspected the above-described facility.
A copy of her inspection
report setting
forth the results of said inspection is attached
hereto
and made a part hereof.
VIOLATIONS
Based
upon direct observations made
by Sheila Williams during the course of her August
29, 2003
inspection of the above-named facility, the Illinois Environmental
Protection Agency has
determined that Respondent has violated the Illinois Environmental Protection Act (hereinafter, the
“Act”) as
follows:
(1)
That
Respondent
caused
or allowed
the
open
dumping
of waste
in
a
manner
resulting
in
litter,
a
violation
of Section
2l(p)(1) of
the Act, 415
ILCS
5/21(p)(1)
(2002).
(2)
That
Respondent
caused or
allowed
the
open
dumping
of waste
in
a
manner
resulting
in
deposition
of
general
construction
or
demolition
debris
or
clean
construction ordemolition debris, a violation of Section 21(p)(7) of the Act,415 ILCS
5/21 (p)(7)
(2002).
CIVIL PENALTY
Pursuant
to
Section
42(b)(4-5) of the Act, 415
ILCS 5/42(b)(4-5)
(2002),
Respondent is
subject
to
a
civil
penalty of
One Thousand
Five
Hundred
Dollars
($1,500.00) for
each
of
the
violations identified above, for a totalof Three Thousand Dollars ($3,000.00).
If Respondent elects
notto petition the Illinois Pollution
Control Board, the statutory civil penalty specified above shall be
due and payable no later than
November15, 2003, unless otherwise provided by order of the Illinois
Pollution
Control Board.
If Respondentelects to contestthis Administrative Citation by petitioning the Illinois Pollution
Control Board
in accordance with Section 31.1 of the Act, 415 ILCS 5/31.1(2002), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondent shall be assessed the associated
hearing costs
incurred by the Illinois Environmental

Protection Agency and the Illinois Pollution Control Board.
Those hearing costs shall be assessed
in
addition
to
the One Thousand
Five
Hundred
Dollar
($1,500.00) statutory civil penalty for each
violation.
Pursuant to Section 31.1 (d)(1) of the Act, 415
ILCS 5/31.1 (d)(1) (2002), if Respondentfails
to petition or elects not to petition the
Illinois Pollution Control Board for reviewof this Administrative
Citation within thirty-five (35) days of the date
of service, the
Illinois
Pollution

Board
shall
adopt
a final
order,
which shall include
this Administrative
Citation and
findings
of violation
as
alleged herein,
and shall impose

is a field inspector employed by the Land Pollution Control Division ofthe
Illinois Environmental Protection Agency and has been so employed at all times pertinent hereto.

inspection ofa disposal site operated by Chris Coleman,
located in Union County, Illinois, and
known as Alto Pass/Coleman by the Illinois Environmental Protection Agency.
Said
site has
been assigned site code number 1810105001
by the Agency.

Affiant inspected said Alto
Pass/Coleman site by an on-site inspection which included
walking and photographing the site.

As a result ofthe material actions referred to
in paragraph 3
above, Affiant completed the

GENERAL
REMARKS
On August 29, 2003 I conducted an inspection of the Alto
Pass/Coleman
dump
site.
I
was accompanied
by Doug Hayward,
also, of the Illinois
EPA.
A Non-Compliance
Advisory (NCA) referencing
a July
15, 2003
inspection
conducted
by Scott Arnold
of the
Bureau of Air (BOA),
Illinois
EPA,
has
been
sent to Chris Coleman, the owner & operator
of this site.
According to Agency records, the
BOA had
received at least two complaints
prior to the July 15,
2003 inspection.
One of the complainants explained that
Mr.
Coleman operates
a second
hand
store at this location.
Mr. Arnold reported
in his July
22, 2003 memo that waste
had
been
burned
on site.
It
is apparent from
photographs
taken by Mr.
Arnold on July
15,
2003 that refuse has
been
burned
on site.
Two
complaints received in August 2003 expressed
Mr.
Coleman continues to dump & burn
waste,
According to one of the complainants, since receiving
the
NCA from the
BOA,
Mr.
Coleman
burns
in the evening
& on weekends.
The August 29,
2003
inspection
was
conducted as
a result of complaints that violations are ongoing.
No one other than
Mr.
Hayward
& myself was present during the course of the
inspection.
Two permanent buildings,
two trailers, one truck/trailer & three covered
portable structures were observed at the site.
Observations support
a type of second
hand business is
operated at this site.
Two
areas of apparent violations were
observed.

These have
been
designated

Other than the designated
areas, a
wide range of items were noted to
not be covered or protected
from
the elements in any
manner.
These materials
included,
but were not limited to, approximately
nine
computer towers & monitors,
two copy machines,
eighteen appliances,
a television,
several
pieces of cloth covered & wooden furniture,
books,
clothes, & a
clothes washing
machine liner & a
clothes drying
machine liner both
containing
ash
& burned
refuse.
It
was apparent some of the items
had
been
staged whereas other things were scattered
about.
Two types
Of what appeared to
be fresh
rock were present along
the southwest
corner of the site, near the tree
line.
One type of rock appeared to
be
a
2”-3” river
rock.
The other rock looked to be a
road
pack type of rock.
It was apparent the rock was
fresh
because of the comparison of conditions
noted
during the August 29, 2003
inspection with photographs taken
on July
15,
2003
by the
BOA.
Also,
the gravel
covering the rest of the site
had small
pieces of general
debris scattered through it
whereas the
road
pack &
river
rock appeared to
be virtually free of any debris.
It should
be
noted the new rock is
now present in areas
where
waste had
been
observed during
the July 15, 2003
inspection.
Refuse in Area A included,
but was not limited to demolition debris,
plastics,
a variety
of metal, cardboard
boxes that did not appear to
be the
least bit weathered,
ash,
charred
debris,
clothing & general refuse.
The debris
in Area
A
was observed trailing
down
gradient into
a wooded area.
Area
A was estimated to
be approximately eleven
cubic
yards (25’x4’x3’)
in size.
Among the waste in Area
B were eleven
‘.‘5-gallon buckets
labeled “Fibrous
Roof & Foundation Coating”, five tires,
a variety of metal,
hoses &
general refuse.
Due to thick vegetation,
it is
possible
additional waste in Area
B was
present but not visible.
Area
B was estimated to
be approximately
10 cubic yards
(15’x12.5’xl.5’)
in
size.
According to the
Union County Supervisor of Assessments, the two acre
piece of
property
on which
this site is
situated was purchased
by Christopher Coleman
of
Cobden,
Illinois
in
March
2003.
The following apparent violations
were observed at the
Alto
Pass/Coleman
site:

of any
waste in

occurrences at the dump

litter;
deposition of general construction or demolition debris.
A variety of waste was
observed on the ground
in Area A & Area
B.
Area
A also contained demolition
debris.
Line #6,
#7 & #10: Conduct any waste-storage, waste-treatment or waste-disposal
operation: without a
permit;
in violation of any Regulations or Standards adopted by
the
Board.
Dispose, treat, store or abandon
any waste or transport
any waste into the
state at/to sites not
meeting requirements of the Act and
Regulations.
Failure to
submit an
application for a
permit to develop
& operate a landfill.
Agency files do not
reflect that there
has
been
a permit applied for or
issued
by the
IEPA which would
allow the development for and/or operation of waste activities
at this site,
thus not
fulfilling requirements of the Act & Regulations.
Due to the apparent business
operated at this location
& the
presence, of several
of the
same items
(computers,
appliances, copiers, etc.), it is
apparent waste
has
been
brought from off site.
